Andes, and moves the Court to compel the Defendants to answer interrogatories, or, in the altemative to impose sanctions pursuant to Pa. R.C.P. 4019 based upon the following: 1. Following a hearing before a panel of arbitrators on 21 February 1996, an Award of Arbitrators was entered in favor of the Plaintiff in this matter in the amount of $5,328.08. 2. Defendants timely appealed the Arbitrators' Award. 3. On to May 1996, Plaintiff, by its counsel, propounded interrogatories upon the Defendants and served copies of those interrogatories by regular, first-class mail on that date, Attached hereto and marked as Exhibit A is a copy of the set of Interrogatories propounded by Plaintiff. Plaintiff also attempted to serve copies of the interrogatories upon the Defendants by certified mail, but the Defendants refused to accept service by certified mail. . 4. To date, Defendants have tiled no answers or objections to Plaintiffs interrogatories. S, Plaintiff requires the infonnation sought in the interrogatories to properly prepare this matter for trial. 6. Plaintiff believes that the Defendants will not accept service by registered mail and requests that Plaintiff be pennitted to provide service on the Defendants, in this matter and all subsequent matters, by regular mail only. It is specifically denied that Joyce Trinen ever had any dealings with the Plaintiff. It is admitted that Michael Trinen and Joe Lapano agreed that Plaintiff would perform additional work, ha.;ever, it is denied that Michael Trinen agreed to pay $2,725.80. Admitted in part and denied in part. It is admitted that Michael Trinen and the Plaintiff discussed additional r.epair work. It is denied that Michael Trinen agreed to pay the - 2 - Plaintiff $856.53. It is also denied that the Plaintiff provided the Defendants with a copy of the estimate marked as Schedule 0 in Plain- tiff's Catplaint. To the contrary, Hichael Trinen told the Plaintiff to suhnit the estimate to the insurance carpany for approval. 5. Denied. To the contrary, Plaintiff breached the par- ties' contract by failing to restore the basanent to an "as good as new" condition. 6. Denied. Defendants are without knc1tlledge or information sufficient to form a belief as to the truth of the averment contained in Paragraph 6 of Plaintiff's Complaint. 7. Denied. When Mich.lel Trinen spoke with Joe Lapano about repair- ing tho basanent wall, Joe Lapano assured him that if Plaintiff were permitted to undertake and canplete the work specified by Plaintiff, the baserrent would be in an "as good as new" condition. 11. On the basis of the aforesaid representation by Joe Lapano, Michael Trinen permitted Plaintiff to undertake the work specified by Plaintiff as necessary to make the basement "as good as new". Despite this, the Trinen's baSBrent is not in as good a condi- tion as it was before the wall collapsed, in fact, it is virtually unusable. 12. Specifically, the basement walls are still supported by a tEll1pOrary wood bracing and water and mud continues to care in through the walls and collect on the floor. 13. During the repair work performed by the Plaintiff, Plaintiff negligently made several large gouges in the baserrent floor which it has failed and refused to repair. - 4 - WHEREFORE, Defendants respectfully request that this Court enter judgment in their favor and against Plaintiff, tCXJether with reasonable costs. Szeies. Inc., a Pennsylvania business corporation with its principal offices at 5110 Lancaster Street in Harrisburg, Dauphin County, Pennsylvania. 2. The Defendants are Michael Trinen and Joyce Trinen, his wife, adult individuals who reside at 34'1 East Meadow Drive in Mechanicsburg, Cumberland County, Pennsylvania. 3, The Defendants are the owners of property at 34'1 East Meadow Drive in Mechanicsburg, Pennsylvania, That property was damaged when a cellar wall collapsed in 1992. 4. The Plaintiff and Defendants reached a series of verbal agreements for Plaintiff to repair the dam~ge done to Defendants' residence. Those agreements were as follows: A. In early October of 1992, Plaintiff's representative, Joe Lapano, met with Trinens at the residence and reviewed with them the work which the Plaintiff proposed to do and the cost it intended to charge for that work, which was $6,015,75, A description of the specific work to be done by 2 Plaintiff is attached hereto and marked as Dchedule A. At that meeting, Trinens agreed to pay $6,015.75 for that work and directed Plaintiff to proceed. 8. After Plaintiff commenced work on the Trinens' residence, the parties di6covered additional damage which had to be repaired. In early November o( 19n, ,It a meeting between HI', Lapano and the Trlnens at the Trinen residence, the parties reviewed the additional work to be done and reached an agreem!!nt whereby Plaintiff would do the wurk and Defendants would pay the additional sum o( $2.725.80 for that work, The additional work which Plaintiff agreed to do is attached hereto and marked as Schedule B, C. In mid-November, 1992, Trinens decided to install windows in the cellar wall which Plaintiff was rebuilding, The parties agreed that Plaintiff would install thos!! windows and 1'rinens would pay an additional $150,00 for them. D, In late Novemb!!r of 1992, Trinens discovered additional repair work which they wanted Plaintiff to do to th!!ir resld!!nce. In early December, 1992, at a meeting at the 'l'rinen residence, Plalntltl and Trin!!nu agrel!d that Plaintiff would do the additional work and Trin!!nu would pay Plaintiff the uum of $856.53 (or that additional work. The additional work which the Plaintiff agreed to do in dencribed in Schedule D which is attached hereto, 5. Plaintiff well and truly per (armed its obligationH under the agreement between Plaintiff and Defendants and completed all of the work deHcribed in the schedules attached bereto in a good and workmanlike fashion. 3 6. The prices charged by Plaintiff for the work it did for Defendants, and the prices which Defendants agreed to pay, are all reasonable market prices for such work at the tiMe and in the area when such work was done. 7. Allhough Defendants have ..a de partial payment to PlaintiU for Plaintiff's work, Defendants have failed and refused to pay the balance due to Plaintiff for the work it did, in accordance with the oral agreements between the parties, which said balance is $5,748.08. 8, Defendantu, by their conduct, have injured Plaintiff in the amount of $5,748.08 plus interest from and after 1 June 1993.
