IN REI PRETRIAL CONFERENCE
At a pretrial conference held Wednesday, March 1,
1995, before the Honorable Harold E. Sheely, President Judqe,
present for the Plaintiff was John W. Weiqel, III, Eequire. The
Defendant did not appear althouqh it would appear to the Court
that she had notice of the pretrial conference today.
The Plaintiff leased to the Defendant an apartment at
7 pine Road known as pine Ridge Estates, the specific number of
the apartment being 406. This is located in Nt. Holly Springs,
Cumberland County, Pennsylvania.
The Plaintiff alleges that the Defendant had breached
several lease provisions, which provisions are set forth on Page
8 of the lease, and the allegation is that the following
provisions have been breached by the Defendant:
(bl Resident shall not enqage in any unlawful
activities in the apartment or on the premises of the apartment
complex nor shall resident permit unlawful activities on the
premises.
(cl Resident shall not use or operate any equipment or
machinery that ie harmful to the apartment or to the apartment
community or that is disturbing to other tenants of the
apartment community.
since the Defendant did not appear, I have no idea
what her position is on theee allegatione; but I will set a
trial date for the above case for Thursday, April 6th, 1995, at
3:30 p.m. in Courtroom Number One of the Cumberland county
Courthouse.
I would direct that counsel for the Plaintiff serve
the Defendant with a copy of this pretrial conference memorandum
which sets forth the trial date.

I. PACtS SUOWIIIG LIABILITY
Defendant April Day (McCoy) has been a tenant of Plaintiff at
the apartment complex known as pine Ridge Estates since March 1,
1991. Defendant has rented and is currently living at Apartment
406. During the summer of 1994, Defendant breached the lease
agreement with Plaintiff in a number of ways. On June 26, 1994,
Defendant frightened a number of tenants at pine Ridge Estates by
publicly brandishing an air capsule pistol resembling a handgun and
Shouting threats against her husband. Defendant later pled guilty
to disorderly conduct. She has also driven her automobile across
pine Ridge Estates at unsafe speeds and deliberately created
excessive noise while doing so.
On July 21, 1994, Defendant
collided with and destroyed a cherry tree on pine Ridge Estates
property.
Plaintiff now seeks to evict Defendant from pine Ridge Estates
and to recover damages.
II _ PACTS SHOIfIIIG DMlAGBS
Plaintiff has receIved an estimate from B & C Landscaping to
replace the cherry tree destroyed by Defendant. The amount of the
estimate, including labor, was $598.90. In addition, a provision

of the lease signed by Defendant requires Defendant to reimburse
plaintiff for all expenses incurred in evicting Defendant,
including attorney fees.

NOW COMES the plaintiff, National Development corporation
Asset Management, Inc., by its attorney, John Wesley weigel III,
Esq., alleging as follows:
1. The plaintiff, National Development Corporation Asset
Management, Inc., is a corporation trading and doing business as
pine Ridge Associates and maintaining an office at pine Ridge
Estates, 7 pine Road, Apartment 601, Cumberland County,
Pennsylvania.
2. The Defendant, April Day, is an adult individual residing
at pine Ridge Estates, 7 pine Road, Apartment 406, Cumberland
County, Pennsylvania.
3. Plaintiff owns the apartment complex known as "Pine Ridge
Estates."
4. Plaintiff and Defendant entered into a written lease
agreement on February 22, 1991, which provided for Plaintiff to
lease Apartment 406 at pine Ridge Estates to Defendant. Copies oC
the lease agreement and of the lease addendum dated March 1, 1994
are marked, Exhibit "A", attached hereto, and incorporated herein
by reference.
5. Defendant has disturbed other tenants on many occasions by
playing music recording at extremely high volumes during sleeping
hours at night.
6. Defendant has verbally harassed and offered threats of
physical harm to other tenants, including children, at Pine Ridge
Estates.
7. Defendant has driven her automobile across the property of
pine Ridge Estates at unsafe speeds. On one occasion, Defendant
collided with and ruined a cherry tree while driving her
automobile.
8. On June 26, 1994, Defendant frightened a number of tenants
at pine Ridge Estates by publicly brandishing an air capsule pistol
resembling a handgun, and shouting that she would shoot her own
husband. The police were called that night. Defendant later pled
guilty to disorderly conduct on August 25, 1994.

9. The allegations contained in paragraphs 1 through 7 are
incorporated herein by reference.
10. Defendant's conduct has breached several provisions of
the lease agreement related to a tenant's "USE OF APARTMENT." See
attached lease at page 8.
11. As a result of Defendant's breach, Plaintiff delivered a
violation warning notice on June 16, 1994. A copy of the violation
letter is marked Exhibit "B", attached hereto, and incorporated
herein by reference. Plaintiff gave Defendant notice to quit the
apartment on July 1, 1994. A copy of the notice to quit is marked
Exhibit "e", attached hereto, and incorporated herein by reference.
12. Nevertheless, Defendant has refused to vacate Apartment
406 of pine Ridge Estates.
WHEREFORE, Plaintiff requests that a judgement for possession
of Apartment 406 of Pine Ridge Estates be entered in its favor and
against Defendant.

13. The allegations contained in Paragraphs 1 through 11 are
incorporated herein by reference.
14. The tree ruined by Defendant had a value of approximately
$450.
WHEREFORE, Plaintiff requests judgement in its favor
against Defendant in the amount of $450.

15. The allegations contained in Paragraphs 1 through 14 are
incorporated herein by reference.
16. The attached lease provides that Defendant shall be
responsible for the expense incurred in obtaining possession of the
apartment and all other damages sustained by Plaintiff, including
attorney's fees.
WHEREFORE, Plaintiff requests judgement in its favor against
Defendant for all expenses incurred in obtaining possession of the
apartment and all other damages sustained by plaintiff, including
attorney's fees.

Pennsylvania State police have their records.On one occasion
a tenant at pine Ridge shot her boyfriend with an air capsule
pistol iin the buttocks and physicians could not remove the
embedded bullet. The tenant did this in front of several adults

at pine Ridge informed me that a tenant said to her to hurry
up and get all her complaints in to Donnas office betore "the
hearing so it can be used against me. I would like to inform
you that Ihave never recieved any complaints or warnings fro
the office besides what happened on June26 1994. I have live
here for 51/2 years and only a chosen few have been stirrin
up trouble on my brhalf. It has all just started recently.

NOW COMES the Plaintiff, National Development Corporation
Asset Management, Inc., by its attorney, John Wesley Weigel II!,
Esq., to answer the Defendant's New Matter, alleging as follows:
17. Denied. To the extent that Defendant's allegations are
intelligible, it is denied that Plaintiff has ever been aware of a
tenant a~ pine Ridge Estates using an air capsule pistol while on
the premises to shoot a boyfriend in the buttocks.
Plaintiff
believes that the incident referred to by Defendant may have been
one taking place off the premises and not involving a female tenant
at pine Ridge Estates. Even were Defendant's allegation correct,
it is denied that this in any way would mitigate Defendant's
liability for her breach of her own lease with Plaintiff.
18. Denied. It is denied that Donna Kapper, pr.operty Manager
for Plaintiff, has given out confidential information about
Defendant. At most, Ms. Kapper has discussed Plaintiff's case with
tenants who are potential witnesses to this action, and made
prospecti ve tenants aware that a rental assistance might be opening
up through these eviction proceedings, without mentioning Defendant
by name. It is denied that these discussions by Ms. Kapper in any
way violated a right to confidentiality benefitting Defendant.
20. Denied. After reasonable investigation, Plaintiff is
without knowledge or information sufficient to form a belief as to
the truth ot Defendant's allegation that another tenant discussed
the present litigation with Defendant. It is further denied that
this allegation in any way constitutes a defense of Defendant's
conduct.
WHEREFORE, plaintiff requests the Court to dismiss Defendant's
New Hatter and find in favor of the plaintiff.
