COMPLAINT
1. The Plaintiff is Russell R. Bennett, who currently
resides in Summerdale, Cumberland County, with a mailing address
of P. O. Box 342, 313 Second Street, Summerdale, Pennsylvania
17093.
2. The Defendant is Crystal A. Bsnnett, who currently
resides in Harrisburg, Dauphin County, Pennsylvania, with a
mailing address of 808 Samoset Drive, Harrisburg, Pennsylvania
17109.
3. Plaintiff and Defendant have been bona fide
residents of the Commonwealth of Pennsylvania for at least eix
(6) months immediately previous to the filing of this Complaint.
4. Plaintiff and Defendant were married on May 23,
1987, in Cumberland County.
S. There have been no prior actions of divorce or for
annulment between the parties.
6. Divorce is sought pursuant to the provisions of the
Divorce Code, Section 3301(c), in that the marriage is
irretrievably broken.

property, which has increased in value during the marriage, all of which property is "marital
property" ,
12. Plaintiff and Defendant have been unable to agree as to an equitable division of

13. The Plaintiff is Russell R. Bennett, who currently
resides in Summerdale, Cumberland County, with a mailing address of
PO Box 342, 313 Second Street, Sumnlerdale, Pennsylvania
17093.
14. The Defendant is Crystal A. Bennett, who currently
resides in Harrisburg, Dauphin County, Pennsylvania, with a mailing
address of B08 Samoset Drive, Harrisburg, Pennsylvania 17109.
15. Plaintiff and Defendant have been bona fide residents of
the Commonweal th of Pennsylvania for at least six (6) months
immediately previous to the filing of this Complaint.
16, Plaintiff and Defendant were married on May 23, 1987, in
Cumberland County.
17. There have been no prior actions of divorce or for
annulment between parties.
lB. Divorce is sought pursuant to the provisions of the
Divorce Code, Section 3301 (d), in that the marriage is
irretrievably broken.
19, Defendant has been advised that counselling is available
and that Defendant may have the right to request that the Court
require the parties to participate in counselling.
20. Plaintiff is not a member of the armed services.
21. Defendant requests the Court to enter a Decree of
Divorce.
COUNT II - EOUITABLE DISTRIBUTIOij
22. Paragraphs 13 through 21 of this New Matter Complaint are
incorporated herein by reference as though set forth in full.
23, Defendant and Plaintiff have acquired property, both real

ancillary causee of action are preserved by the pleadings, no
prejudice will occur if a divorce is granted prior to the
adjudication of the party's ancillary claims.
7, Pursuant to the Divorce Code, 23 Pa. Cons, Stat. SS 101 et
seq., this Court is empowered to grant a divorce and to reserve
jurisdiction over the remaining ancillary issues.

ANSWER TO PETITION FOR BIFURCATION
Plaintiff Russell R. Bennett, by his attorney, Debra K. Wallet. Esq., answers the
Petition for Difurcation as follows:
1. ADMITIED,
2. ADMITIED.

4. ADMITIED.
5. It is ADMITIED that there are no discovery requests by Plaintiff Russell R,
Bennett to which Defendant Crystal A. Bennett has failed to respond. It is DENIED that
Plaintiff Russell R. Bennett "has been less than diligent" in providing discovery materials
requested by Defendant Crystal A. Bennett or in pursuing his claim for equitable distribution.
To the contrary, there are no discovery requests to which Plaintiff has failed to respond. It
is ADMITIED that Piaintiff has not requested the appointment of a Master to decide the
equitable distribution claim. but neither has Defendant requested the appointment of a
Master.
6. It is DENIED that "no prejudice will occur if a divorce is granted." To the
contrary. Plaintiff believes that Defendant, who has a significant interest in a closely-held
family business, the increase in value of which constitutes marital property, will have no
motivation to settle this case in an amicable fashion. without resort to the eltpense of a
fonnal hearing before the Master. if the divorce is granted at this time. Moreover, Plaintiff
would be prejudiced if the Defendant were to die after the grant of the divorce decree but
before the entry of a decree of equitable distribution of the marital property.
7. It is ADMITTED that the Court has the discretion to grant a divorce and
reserve jurisdiction over the remaining ancillary issues pursuant to 23 Pa.C.S.A. ~3323(O.
It is DENIED that the COilrt should eltercise its discretion to do so in this case.

8. The marital property to be divided in this divorce action consists of: (I) a
parcel of jointly-owned real estate in which Plaintiff resides; (2) Plaintiffs pension and
401(k) with PP&L; (3) Defendant's pension and other retirement benefits from Harrisburg
Hospital; (4) a pontoon boat; (5) several vehicles; and (6) the increase in value of
Defendant's 22.75% interest in a family-owned business, Maple Lawn Associates.
9, Maple Lawn Associates generated as much as $56,000 in yearly income to the
Defendant during the marriage, which income was claimed on joint talt returns but which
was not enjoyed by Plaintiff.
10. The Defendant's capital account in Maple Lawn Associates increased in value
during the course of the marriage from more than $85,000 to more than $203,000.
II. If the petition to bifurcate is granted and the divorce decree entered, Plaintiff
will have no protection afforded him by probate statute in the event of Defendant's death.
This could result in the panitlon of the real propeny in which Plaintiff resides at Defendant's
death and could result in the complet~ loss of his marital interest in the family-owned
business.
12. Defendant has pleaded no reason for granting bifurcation which would
outweigh the potential ham! to Plaintiff if the bifurcation petition were granted and the
D<:fendant were to die prior to a final decree of equitable distribution.
13. Defendant has no reason for granting bifurcation which would outweigh the
potential ham! to Plaintiff if the bifurcation petition were granted and the Defendant were to
die prior to a final decree of equitable distribution.
WHEREFORE, Russell R. Bennett respectfully requests that the Coun deny the
request to bifurcate and refuse to grant the divorce prior to the resolution of all issues
pertaining to this divorce action.
