1. Plaintiff is Christine Spangler, who resides at 235 Ridge
Hill Road, MechanlCsburg, Pennsylvania,
2. Defendants are William Bailey and Ronald Leitzel
("Defendants"), trading as Bailey's Diamond Center, a business
partnership located at 423 Carlisle Plaza Mall, Carlisle,
Pennsylvania.
CREATION OF MUTUAL BENEFIT BAILMENT
3. Plaintiff was the owner of a diamond engagement ring and
a wedding band both of which were gifts from Plaintiff's husband
in 1980,
4. The Plaintiff's engagement ring was subject to a written
appraisal made in January 1984, a copy of which is attached as
Exhibit "A" and incorporated herein by reference.
5. On November 12, 1993 plaintiff deposited with defendant
Bailey ("Defendant"), her wedding band and diamond engagement ring.

6. That the rings were deposlted wlth de:e:\dant for the

9. Prior to leaving her rings in defendant Bailey's custody
and control, plalntiff had not had any work done on the rings,
10, Plaintiff Plcked up two rings from defendant Bailey and
paid defendant the sum of twenty two ($22,00) dollars for which she
was issued a receipt, a copy of which is attached as Exhibit "B"
and incorporated herein by reference,
11. Upon return of the rings plaintiff noted that the
engagement ring appeared to be thin at the bottom and that the
stone on the ring had a visible flaw on the surface of the diamond.
12. That the ring returned to plaintiff lacked distinctive
markings that are described by her appraisal, including a jewelers
insignia on the inside of the band.
13. Plaintiff believes and therefore avers that the engagement
ring which was returned to her was not her ring,
14. Upon presenting her concerns to defendant Bailey.
defendant told plaintiff that the rings did not fl~ together as a
matched set; that the engagement ring had "mill marks" and showed
unusual signs of wear; that the ring had in fact been sized down

to a 6.0 instead of up and furthermore, that defendant waz :f ~~e
opinion that the ring was not the plaintlffs.
PLAINTIFF'S ALLEGATIONS OF RES
~ LOQUITUR NEGLIGENCE
15. Defendant had a common law duty to use ordinary reasonable
care in the handling of the rings subJect to bailment,
16. That defendant and defendants' agents were in exclusive
control of the rings subject to the bailment.
17. That plaintlff believes and therefore avers that
defendants were in the best position to give an accounting for the
missing engagement ring.
18. Upon demand by the plaintiff to either return the ring
initially subject to the bailment or provide an adequate
explanation and accounting of the whereabouts of the ri~g,
defendant Bailey failed to do so,
19. The return of a ring other than the ring subject to the
bailment does not ordinarily occur in the absence of negligence.
20, That the negligent conduct is attributable to the
defendants or defendants' agents.
21, As a result of defendants failure to return Plaintiff's
ring. the plaintiff has been injured,
22. That plaintiff has been deprived of the value of her
property and that to replace her engagement ring plaintiff expects
to incur damages in the amount of two thousand eight hundred and
fifty ($2,850,00) dollars or the current replacement value of her
ring.

WHEREFORE. Pla1nt1ff Chr1st1ne Spanqler respectfully requests
the followinq relief:
(1) A jud;ment in favor ,,: the pla1nt1ff and aqunst
defendants william Bailey and Ronald t.e1tzel for dama;es 1n the
amount of $2,850.00 or the reasonable replacement value of
Plaintiff's rinq alon; w1th any reasonable attorney's fees incurred
by the plaint1ff.

proper under the circumstances.
