Attorney for Plaintiffs
pertinent to a parcel of real estate located at 4833 Charles Road. Mechanicsburg,
Cumberland Counry, Pennsylvania. A true and correct copy of the Agreement for Sale
and Purchase of Real Estate Is attached hereto and incorporated hsrein as Exhibit" A".
6. Under the Special Clauses portion of the Agreement for Sale and
Purchase of Real Estate there Is a notation which reads as follows: "Seller to have
chimney cleaned prior to Settlement".
7. On or about January 13, 1994 Settlement was conducted relative to the
real estate transaction and at that time the Defendants (Sellers) had not had the
chimney cleaned and were unable to provide the Plaintiffs (Purchasers) with a
certification that the chimney had been cleaned and was ready for use.
8. As a result of the Dsfendants' failure to have the chimney cleaned the
parties executed a document entitled Pre-Settlement Property Inspection which bears
a notation as follows: "Sellers will have chimney professionally cleaned within (7)
days of date of this document". A true and correct copy of the document entitled
Pre-Settlement Property Inspection is attached hereto and incorporated herein as
Exhibit "B".
9. Subsequent to the date of Settlement the Plaintiffs made arrangements
for the cleaning of the chimney by a company known as Chimney Sweep Systems.
10. On or about February 7, 1994 a representative of Chimney Sweep
Systems cleaned the chimney and In the process of doing so the Chimney Sweep
Systems representative found various defects in the chimney system, Including but
not limited to, cracked flue tiles. improper ventilation, and improper build-up of

creosote in the firebox and smoke shelf due to Improper hook-up. A true and correct
copy of the Report prepared by Chimney Sweep Systems Is attached hereto and
incorporated herein as Exhibit "C".
11. A representative of Chimney Sweep Systems informed the Plaintiffs that
the cost of rectifying the defects in the chimney system would amount to the sum of
.1,232.29. A true and correct copy of a Job Estimate provided by Chimney Sweep
Systems is attached hereto and incorporated herein as Exhibit "0".
12. "'.Ithough Plaintiffs made due demand upon the Defendants to remedy
the defects In the chimney system they failed and refused to do so.
13. So that the wood burning stove could be functional the Plaintiffs have
incurred the expense set forth on Exhibit "0" so as to rectify the defects In the
chimne'l system.
14. The Defendants marketed the home in question by representing that the
wood burning stove was the primary heat source for the residence.
15. Plaintiffs believe and therefore aver that the Defendants were aware that
there were defects and problems with the wood burning stove and chimney system
and that is the reason why they failed to obtain a certification that the chimney had
been cleaned prior to the date of Settlement.
16. Although demand has been made upon the Defendants to reimburse the
Plaintiffs for the cost of cleaning the chimney and remedying the defects In the
chimney, the Defendants have failed and refused to reimburse the Plaintiffs.

WHEREFORE, the Plaintiffs demands Judgment against the Defendants in the

AND NOW, comes the Plaintiffs. by and through their attorneys, Handler and
Wiener and responds to the Defendants' allegations of New Matter as follows:
17. Denied. After reasonable investigation Plaintiffs are without knowledge
or information sufficient to form a belief as to the truth of the averment contained In
Paragraph 17, and hence, proof of the same is demanded at the trial in this matter.
18. Denied. After reasonable investigation Plaintiffs are without knowledge
or information sufficient to form a belief as to the truth of the averment contained in
Paragraph 18. and hence, proof of the same is demanded at the trial in this matter.
By way of further answer, the Plaintiffs believe and therefore aver based upon
information received from the representative of Chimney Sweep Systems that the
chimney had significant build-up of creosote.

or information sufficient to form a belief as to the truth of the averment contained in
Paragraph 19, and hence, proof of the same Is demanded at the' trial In this matter.

implication and intention of the parties was that the chimney would be cleaned and
in proper working order as of the date of settlement. The Defendao1ts breached the
terms of the Agreement of Sale.
24. Denied. The allegation contained in Paragraph 24 paraphrases a clause
in the Agreement of Sale. The Agreement of Sale, being a writing, speaks for itself
and Plaintiffs refer the Court to the entire document. as well as the additional
documents and factual circumstances that arose at the time of settlement due to the
fact that the Defendants failed to comply with the terms of the Agreement of Sale.

25. Denied. The Defendants represented the property as being heated by the
wood-burning stove, however, the wood-burning stove was not in proper and
functioning order at the time of settlement, which Is a fact that the Defendants were
undoubtedly aware and that Is why they had failed to obtain the chimney cleaning
certification prior to the time of settlement. The Plaintiffs additionally aver that the
electric baseboard heating mechanisms In the lower level of the subject home were
also non-functioning, which was a fact that had not been disclosed to the Plaintiffs
by the Defendants at any time.
26. Denied. The allegation in Paragraph 26 paraphrases one of the
paragraphs in the Agreement of Sale. Since the Agreement of Sale is a writing, the
Plaintiffs refer the Court to the entire Agreement, as well as the documents and
factual circumstances that transpired at the settlement table. By way of further
answer, the Plaintiffs allege that they did seek the assistance of experts by requiring
the sellers to obtain a chimney cleaning, however, the Defendants specifically failed
to comply with that requirement of the Agraement of Sale thus causing the discovery
of the defects in the wood-burning stove/chimney mechanism subsequent to the date
of settlement. Consequently, the Plaintiffs aver that the Defendants should not now
be permitted to hide behind the clause that states that warranties do not survive
settlement.
