COMPLAINT
1. Plaintiffs Peter and Isabelle Wozniak reside at 202 Walnut Street,
Lemoyne, Cumberland County, Pennsylva~ia.
2. Defendant C.G. Kitzmiller is an individual who conducts business
as C.O. Kitzmiller Roofing at 110 Third Street, Suite I, New
Cumberland, Cumberland County, Pennsylvania.
3. On March 29, 1.993, plaintiff and defendant executed a certain
written agreement for removal of existing roofing and installation of
shingle roofing on plaintiff's residence. A true and correct copy of
the agreement is attached hereto and marked Exhibit "A."
4. The plaintiffs have fulfilled all the provisions of the agreement
on their part to be performed.
5. The defendant has not fulfilled the provisions of the agreement on
his part to be performed.
6. Defendant has wholly neglected to do and perform certain things
which were expressly or by necessary implication required to be done
and performed by the agreement as follows: (a) install step flashing;
a true and correct copy of our invoice on which a note was written by
a Kitzmiller employee regarding the flashing is attached hereto and
marked Exhibit "S;" (b) repair broken boards.
7. Defendant has performed in a poor, improper, and unworkmanlike
manner certain other things which were expressly or by necessary
implication required by the agreement to be done and performed in a
proper and workmanlike manner, as follows: (a) improperly installed
ventilation fan; (b) roof leaks and leaking has resulted in stained
ceiling tiles in bathroom; (c) truck used in removing old roofing
damaged several blocks of sidewalk in front of plaintiff's residence.
8. Defendant has failed and refused, and despite defendant's
agreement to remedy the aforesaid breaches, defendant still fails and
refuses to cure the aforesaid breaches, despite plaintiff's repeated
demand. True and correct copies of letters written by plaintiff are
attached and marked Exhibit "c, D, E, F, G, H & I." True and correct
copies of letters written by defendant are attached and marked Exhibit

9. The reasonable cost of remedying the aforesaid breaches is in
excess of $2,358.
WHEREFORE, plaintiff demands judgment against defendant in an amount
not in excess of $3,500 with costs and interest.

Your last correspondence, dated November 24, 1993, stated
that you have contacted contractors to repair the sidewalk
and the bathroom ceiling.
The sidewalk repair is unacceptable. The new concrete that
was poured is all b=oken up and crumbles ~o the touch. !~
was a very sloppy job to begin with. There is smeared
concrete on adjacent blocks and no block lines drawn in.
Furthermore, no one ever came to inspect and clean up after
is was poured last November. My wife has recently removed
the boards and stakes that posed a danger to our children.
No one has ever contacted me to work on the bathroom
ceil inq.
I have called your office numerous times in the last several
months. I have even talked to Curtis Kitzmiller once. No
one has returned any of my calls or has taken any action.
I request that all repairs be completed to my satisfaction
by April 30, 1994. please send a notarized letter to my
address within 10 days of receipt of this letter stating
what you intend to do to remedy the situation and when you
intend to do it.

named Defendant is C.G. Kitzmiller. The named Defendant is C.G.
'Kitzmiller Roofing. The remainder of the paragraph is admitted
,with the clarification that C.G. Kitzmiller, the individual, does
business as C.G. Kitzmiller's Roofing.

due, Defendant avers that the parties' contract as set forth in
'Exhibit A to the Complaint does not require the Defendant to

. install step flashing. It is specifically averred that such
',flashing is not usually installed in roofing on older homes with
the type of siding which Plaintiff's possessed at the time of the
. parties' contract. However, Plaintiffs proceeded to change the
.siding to a type which could now accommodate flashing. In order to
avoid a dispute with the Plaintiffs, Defendant agreed to install

,the flashing as per Plaintiff's complaint Exhibit B, solely as a
; gratuitous gesture to promote good will with its customer. When the

!'scheduling of Defendant and Plaintiffs' siding contractor could not

be coordinated, Defendant subcontracted with David Clem to in fact
; make the flashing installation and paid Mr. Clem for same.

, denied that any of the work set forth in paragraph 7 was improperly
:performed by Defendant. It is averred that the ventilation fan was

I installed in a workmanlike manner. It is admitted that after
'installation, the roof did leak. However, it is asserted that the
leak resulted from conditions other than poor workmanship or any
.act or omission by the Defendant. It is asserted that the roof
,leaked due to bad weather conditions and ice blockage. It is
further admitted that the truck removing old roofing damaged
'several blocks of sidewalk in front of Plaintiff'. residence.
"However, it is averred that said damage was not caused by
,
: negligence of the Defendant. Rather, the damage resulted lrom the
, severely cracked and deteriorated nature of the Plaintiffs'
sidewalk prior to Defendant's use and its contact with the truck.
It is noted that use of the truck was necessary and critical part
, of the construction process of the roof replacement. It is further
asserted that Defendant, in trying to further appease the
Plaintiffs, made actual repairs to the sidewalk at such time as
directed by the Plaintiffs. Hence, no further liability exists for
said occurrence.
8. Admitted in Part, Denied in Part. it is admitted that
Defendant did not correct all of the items for which Plaintiffs
claim the Defendant is responsible. However, without consideration
or obligation, Defendant has made the repairs set forth in
paragraph six (6) and seven (7) of this Answer, which paragraphs

PBTITION TO WITHDRAW
1) Petitioner is steven J. Fishman, Esquire, O'Brien, Baric'
Scherex, 17 West South Street, carlisle, Pennsylvania.
2) On May 10, 1995, Petitioner was appointed as Chairman of the
Board of Arbitrators in the above-captioned action.
3) On May 10, 1995, Daniel Sodus, Esquire and Kathleen D.
Keating, Esquire were appointed to sit on the panel along with
Petitioner.
4) Fetitioner has been attempting to schedule the arbitration
hearing in this matter since June 13, 1995. Through telephone calls
with Defendant's attorney, Barbara Sumple-Su11ivan, Petitioner learned
that Defendant was considering bankruptcy.
5) On July 6, 1995, Petitioner received by facsimile a copy of
a cover sheet of a Chapter 7 Bankruptcy filing which was filed by
Defendant to the above-captioned action on June 26, 1995. A copy of
said cover sheet is attached hereto and incorporated herein by
reference.
6) Petitioner requests that his appointment be withdrawn and
the appointment of attorneys Sodus and Keating be vacated due to the
circumstances in this action.

reque.t. this Honorable Court permit him to withdraw as Chairman of
the Board of Arbitrators in this action, and vacate the appointments
