presentation and consideration of the within Petition, and upon
finding that the plaintiff, ETHEL D. BOOKER, now residing at 223
Plaza Drive, Boiling Springs, Cumberland County, Pennsylvania, is
in immediate and present danger of abuse from the defendant,
MELVIN L. WILLIAMS, the following Temporary Order is entered.
The defendant, MELVIN L. WILLIAMS, now residing at 29 Middle
Street, Gettysburg, Adams County, Pennsylvania, is hereby
enjoined from physically abusing the plaintiff, ETHEL D. BOOKER,
or placing her in fear of abuse and is ordered to stay away from
the residence located at 223 Plaza Drive, Boiling Springs,
Cumberland County, Pennsylvania, a residence which is leased
solely by the plaintiff. The defendant is hereby notified that
if he goes to the plaintiff'S domicile contrary to this Order, he
may be in indirect criminal contempt which is punishable by a
fine not to exceed $1,000.00 and/or by a sentence of up to si~
months in jail and any other appropriate punishment. Resumption
of co-residence on the part of the plaintiff and defendant shall
not nullify the provisions of the Court Order directing the
defendant to refrain from abusing the plaintiff.
The defendant is ordered to refrain from having any contact
with the plaintiff including, but not limited to, harassing or
stalking the plaintiff and harassing the plaintiff's relatives or
minor children.
This Order shall remain in effect until a tinal order is
entered in this case. A hearing shall be held on this matter on
the "-Itii day of October, 1994, at 1/,5(1 ".m. in Courtroom
No. 'I, Cumberland county Courthouse, Carlisle, Pennsylvania.
The plaintiff may proceed in forma DauDeris pending a
further order after the hearing.
The Cumberland county Sheriff's office shall attempt to make
service at the plaintiff's request, but service may be
accomplished under any applicable rule of civil Procedure.
This Order shall be docketed in the office of the
Prothonotary and forwarded to the Sheriff for service. The
Prothonotary shall not send a copy of this order to defendant by
mail.
The Pennsylvania State and Carlisle Police Department will
be provided with a copy of this Order by attorneys for plaintiff.
This Order shall be enforced by any law enforcement agency where
a violation occurs by arrest for indirect criminal contempt
without warrant upon probable cause that this Order has been
violated, whether or not the violation is commJ,tted in the
presence of the police officer. In the event that an arrest is
made under this section, the defendant shall be taken without

23 P.S. SECTION 6101
A. ABUSE
1. The plaintiff is an adult individual whose permanent
address is 223 Plaza Drive, Boiling springs, Cumberland County,
Pennsylvania, 17007.
2. The defendant is an adult individual residing at 29
Middle Street, Gettysburg, Cumberland County, Pennsylvania,
17325.
3. The defendant is the plaintiff's former intimate
partner.
4. Since approimately September 1994, the defendant has
attempted to cause and has intentionally, knowingly, or
recklessly caused bodily injury to the plaintiff, and by physical
menace has placed the plaintiff in fear of imminent serious
bodily injury. This ~as included but is not limited to ths
following specific instances of abuse:
a. On or about September 26, 1994, the defendant threatened
the plaintiff saying he would hit her or her son in the mouth.
When the plaintiff lay down on the sofa, the defendant hit the
plaintiff repeatedly in the face, breasts, arms, and legs with a
flyswatter. When the plaintiff asked the defendant to leave her
alone, the defendant replied, "I don't care; tonight I'm going to
give you a reason to call the police and put my name in the
paper," causinq the plaintiff to fear for her safety. Tho
defendant then held up a glass while counting and threatening to
throw it at the plaintiff forcing her to go into the bedroom.
When the plaintiff got to the bedroom, the defendant threatened,
"I'm going to kick off in your ass." The plaintiff, fearing for
her safety, hyperventilated. The plaintiff's daughter telephoned
911. The plaintiff was transported to the hospital, and when the
defendant followed the plaintiff into the room, security had to
be called to remove the defendant. The defendant again
threatened the plaintiff saying, "I'm going to kick off in your
ass." Fearing to return to the home, the plaintiff was placed
into shelter for the night.
b. On or about September 22, 1994, the defendant threw a
cordless phone at the plaintiff with such forca that it hit the
plaintiff in the chest, fell to the floor, and broke into pieces.
When the plaintiff went to leave the room, the defendant told her
to get back into the room because he was not finished with her
yet. The defendant punched the plaintiff in and about the
breast, grabbed her by the shirt, and shoved her backwards. The
plaintiff got her children, left the apartment, and called the
police. The defendant was cited for harassment. The plaintiff
suttered soreness to her breast.
c. On or about September 20, 1994, while the partie. were
in bed, the detendant hit the plaintitt torcetully in the back
with his elbow. The detendant tried to make the plaintitf leave
the house where her children were, threatened to beat her up, and
then beat the plaintitt about her body with a sneaker and raised
his tist turther threatening the plaintitt. This incident
continued tor approximately one and one halt hQurs. The
plaintift suttered pain and soreness about her body.
d. On or about September 9, 1994, the detendant punched the
plaintiff in the head where she has a plastic plate, causing the
plaintiff to fall against the wall and suffer severe pain and
dizziness.
5. The plaintitf believes and therefore avers that she will
be in immediate and present danger of abuse from the defendant,
and that she is in need of protection from such abuse.
6. The plaintiff desires that the defendant be restrained
from having any contact with her, harassing or stalking the
plaintiff, and from harassing the plaintiff's relatives or minor
children.
B. EXCLUSIVE POSSESSION
7. The home from which the plaintiff is asking
exclude the defendant is rented in the name of ETHEL BOOKER and
her children.
c. LOSSES
8. The plaintift asks for attorney fees to be paid to Legal
Services, Inc., pursuant to the Protection from Abuse Act.
D. STATUS TO PROCEED IN FORMA PAUPERIS
9. The defendant is employed at Ross Distribution and h~s
an hourly salary of approimately $5.50.
10. The plaintiff currently receives public assistance in
the amount of $312.00 per month and disability for her daughtsr
in the amount of $478.00 per month.
11. The plaintiff does not have funds available to pay the
tees tor tiling and service.
WHEREFORE, pursuant to the provisions ot the "Protection
from Abuse Act" of October 7, 1976, 23 P.S. section 6101 Jlt aiSI.,
as amended, the plaintiff prays this Honorable Court to grant the
following reliet:
A. Grant a Temporary Order pursuant to the "Protection tram
Abuse Act:"
1. Requiring the defendant to refrain tram abusing the
plaintiff or placing them in fear of abuse.
2. Requiring the defendant to refrain from having any
contact with the plaintift, including, but not limited to,
harassing or stalking the plaintiff, and from harassing the
plaintiff's relatives or minor children.
3. Ordering the defendant to stay away from the
residence located at 223 Plaza Drive, Boiling Springs,
Pennsylvania.
4. Ordering the defendant to stay away from any
residence the plaintiff may in the future establish for
hersell .
B. Schedule a hearing in accordance with the provisions of
the "Protection from Abuse Act," and, after such hearing, enter
an order to be in effect for a period of one year:
1. Requiring the defendant to refrain from abusing the
plaintiff or placing her in fear of abuse.
2. Requiring the defendant to refrain from having any
contact with the plaintiff, including, but not limited to,
harassing or stalking the plaintiff and from harassing the
plaintiff's relatives or minor children.
3. ordering the defendant to stay away from the
residence located at 223 Plaza Drive, Boiling springs,
Pennsylvania.
4. Ordering the defendant to stay away from any
residence the plaintiff may in the future establish for
herself.
5. Ordering the defendant to pay attorney fees to
Legal Services, Inc. purusant to the Protection Frem Abuse
Act.
The plaintiff further asks that this Petition be filed and
served without payment of costs, pending a further order at the
hearing, and that a copy of this Petition and Order be delivered
to the Pennsylvania state and Carlisle Police Departments as the
Police Departments with jurisdiction to enforce this Order.
The above-named Plaintiff, Ethel. O. Booker, verifies that
the statements made in the above Petition are true and correct.
Plaintiff understands that false statements herein are made
sUbject to the penalties of 18 Pa. c.s. 54904, relating to
unsworn falsification to authorities.

MOTION FOR CONTINUANCE
The plaintiff moves this Court for an Order continuing the
hearing of this case until further Order of Court, 011 the grounds
that:
1. A Temporary Protective Order was issued by this Court on
the 30th day of September, 1994, SCheduling a hearing for the 7th
day of october, 1994, at 11:30 a.m.
2. The Cumberland County Sheriff'S Department deputized the
Adams county Sheriff's Department to serve the defendant.
3. Service has not yet been effected.
4. The plaintiff requests that the Temporary protective
Order remain in effect pending further order of court.
4. A copy of the Order for Continuance will be delivered to
the Pennsylvania State and Carlisle police Departments by
attorneys for the plaintiff.
WHEREFORE, the plaintiff moves this Court to grant the
plaintirt's Motion, and to continue this matter until rurther
order or Court.

The plaintiff moves this Court for an Order continuing the
hearing of this case until further Order ot Court, on the grounds
that:
1. A Temporary Protective Order was issued by this Court on
the 30th day of September, 1994, scheduling a hearing tor the 7th
day ot October, 1994, at 11:30 a.m.
2. The Cumberland County Sheriff's Department deputized the
Adams County Sheriff's Department to serve the detendant,
3, Service has not yet been effected.
4. The plaintiff requests that the Temporary Protective
Order remain in effect pending further order of court.
4. A copy of the 04der for Continuance will be delivered to
the Pennsylvania State and carlisle police Departments by
attorneys for the plaintiff.

Protection From Abuse Act and has obtained a Temporary Protective Order. The
plaintiff Is prepared to have a hearing held In order to obtain a Final
Protective Order effective for one /11 year.

The Consent Agreement should be prepared before the time scheduled (or the
hearing so the Court will know ahead of tllle that the case will not be contested.
In most cases, regardless of whether a settlement by Consent Agreement has been
reached, the parties must appear in court at the time scheduled for hearlns. If
the case Is uncontested, the court appearance will be brief. The judse will uke
sure the parties understand the Consent Agreement and Final Protective Order.
If you do not agree to the entry of the Final Protective Order, a contellted
hearing will take place at the scheduled time. When a Final Protective Order Is

Petition, and upon
finding that the plaintiff, ETHEL D. BOOKER, now residing at 223
Plaza Drive, Roiling springs, Cumberland County, Pennsylvania, is
in immediate and present danger of abuse from the defendant,
MELVIN L. WILLIAMS, the following Temporary Order is entered.
The defendant, MELVIN L. WILLIAMS, now residing at 29 Middle
Street, Gettysburg, Adams County, Pennsylvania, is hereby
enjoined from physically abusing the plaintiff, ETHEL D. BOOKER,
or placing her in fear of abuse and is ordered to stay away from
the ~esidence located at 223 Plaza Drive, Boiling Springs,
Cumber~and county, Pennsylvania, a residence which is leased
solely by the plaintiff. The defendant is hereby notified that
if he goes to the plaintiff's domicile contrary to this Order, he
may be in indirect criminal contempt which is punishable by a
fine not to exceed $1,000.00 and/or by a sentence of up to six
months in jail and any other appropriate punishment. Resumption
of co-residence on the part of the plaintiff and defendant shall
not nullify the provisions of the Court Order directing the
defendant to refrain from abusing the plaintiff.
The defendant is ordered to refrain from having any contact
with the plaintiff including, but not limited to, harassing or
stalking the plaintiff and harassing the plaintiff's relatives or
minor children.
This Order shall remain in effect until a final order is

The Cumberland County Sheriff's office shall attempt to make

This Order shall be docketed in the office of the
Prothonotary and forwarded to the Sheriff for service. The
Prothonotary shall not send a copy of this order to defendant by
mail.
The Pennsylvania State and Carlisle Police Department will
be provided with a copy of this Order by attorneys for plaintiff.
This Order shall be enforced by any law enforcement agency where
a violation occurs by arrest for indirect criminal contempt
without warrant upon probable cause that this Order has been
violated, whether or not the violation is committed in the
presence of the police officer. In the event that an arrest is
made under this section, the defendant shall be taken without
unnecessary delay betore the court that issued the Order. When
that court is unavailable, the defendant shall be taken before
the appropriate district justice (23 Pa.C.S.A. Section 6113).

PETITION FOR PROTECTIVE ORDER
AND CUSTODY
RELIEF UNDER THE PROTECTION FROM ABUSE ACT
23 P.S. SECTION 6101
A. ABUSE
1. The plaintiff is an adult individual whose permanent
address is 223 Pl~za Drive, Boiling Spring~, CUmberland County,
Pennsylvania, 17007.
2. The defendant is ~n adult individual residing at 29
Middle street, Gettysburg, Cumberland County, Pennsylvania,
17325.
3. The defendant is the plaintiff'S former intimate
partner.
4. since approimately September 1994, the defendant haa
attempted to cause and has intentionally, knowingly, or
recklessly caused bodily injury to the plaintiff, and by physical
menace has placed the plaintiff in fear ot imminent serious
bodily injury. This has included but is not limited to the
following specific instances ot abuse:
a. On or about September 26, 1994, the defendant threatened
the plaintitf saying he would hit her or her son in the mouth.
When the plaintiff lay down on the aofa, the detendant hit the
plaintitf repeatedly in the face, breaata, arma, and lega with a
flyawatter. When the plaintiff aaked the defendant to leave her
alone, the defendant replied, "I don't care; tonight I'm going to
give you a reason to call the police and put my name in the
paper," causing the plaintitf to fear for her safety. The
defendant then held up a glass while counting and threatening to
throw it at the plaintiff forcing her to go into the bedroom.
When the plaintiff got to the bedroom, the defendant threatened,
"I'm going to kick off in your ass." The plaintiff, fearing for
her safety, hyperventilated. The plaintiff'S daughter telephoned
911. The plaintiff was transported to the hospital, and when the
defendant followed the plaintiff into the room, security had to
be called to remove the defendant. The defendant again
threatened the plaintiff saying, "I'm going to kick off in your
ass." Fearing to return to the home, the plaintiff was placed
into shelter for the night.
b. On or about September 22, 1994, the defendant threw a
cordless phone at the plaintiff with such force that it hit the
plaintiff in the chest, fell to the floor, and broke into pieces.
When the plaintiff went to leave the room, the defendant told her
to get back into the room because he was not finished with her
yet. The defendant punched the plaintiff in and about the
breast, grabbed her by the shirt, and shoved her backwards. The
plaintiff got her children, left the apartment, and called the
police. The defendant was cited for harassment. The plaintiff
suttered aoreneaa to her breast.
c. On or about September 20, 1994, while the partiea were
in bed, the defendant hit the plaintiff forcefully in the back
with hia elbow. The defendant tried to make the plaintiff leave
the houae where her children were, threatened to beat her up, and
then beat the plaintiff about her body with a aneaker and raised
his fist further threatening the plaintiff. This incident
continued for approximately one and one half hours. The
plaintiff auffered pain and soreness about her body.
d. On or about September 9, 1994, the defendant punched the
plaintiff in the head where she has a plastic plate, causing the
plaintiff to fall against the wall and suffer severe pain and
dizziness.
5. The plaintiff believes and therefore avers that she will
be in immediate and present danger of abuse from the defendant,
and that she is in need of protection frore such abuse.
6. The plaintiff desires that the defendant be restrained
from having any contact with her, harassing or stalking the
plaintiff, and from harassing the plaintiff'S relatives or minor
children.
B. EXCLUSIVE POSSESSIQH
7. The home from which the plaintiff is asking the Court to
exclude the defendant is rented in the name of ETHEL BOOKER and
her children.
C. LOSSES
8. The plaintiff asks for attorney fees to be paid to Legal
Services, Inc., pursuant to the Protection from Abuse Act.
D. STATUS TO PROCEED IN FORMA PAUPERIS
9. The defendant is employed at Ross Distribution and has
an hourly salary of approimately $5.50.
10. The plaintiff currently receives public assistance in
the amount of $312.00 per month and disability for her daughter
in the amount of $478.00 per month.
11. The plaintiff does not have funds available to pay the
fees for filing and service.
WHEREFORE, pursuant to the provisions of the "Protection
from Abuse Act" of October 7, 1976, 23 P.S. section 6101 n ug.,
as amended, the plaintiff prays this Honorable Court to grant the
following relief:
A. Grant a Temporary Order pursuant to the "Protection from
Abuse Act:"
1. Requiring the defendant to refrain from abusing the
plaintiff or placing them in fear of abuse.
2. Requiring the defendant to refrain from having any
contact with the plaintiff, including, but not limited to,
harassing or stalking the plaintiff, and from harassing the
plaintiff'S relatives or minor children.
3. Ordering the defendant to stay away from the
residence located at 223 Plaza Drive, Boiling Springs,
Pennsylvania.
4. Ordering the defendant to stay away from any
residence the plaintiff may in the future establish for
herself.
B. Schedule a he~ring in accordance with the provisions of
the "Protection from Abuse Act," and, after such hearing, enter
an order to be in effect for a period of one year:
l. Requiring the defendant to refrain from abusing the
plaintiff or placing her in fear of abuse.
2. Requiring the defendant to refrain from having any
contact with the plaintiff, including, but not limited to,
harassing or stalking the plaintiff and from harassing the
plaintiff'S relatives or minor children.
3. Ordering the defendant to stay away from the
residence located at 223 Plaza Drive, Boiling springs,
Pennsylvania.
4. Ordering the defendant to stay away from any
residence the plaintiff may in the future establish tor
herselt .
5. Ordering the defendant to pay attorney fees to
Legal Services, Inc. purusant to the Protection From Abuse
Act.
The plaintitf further asks that this Petition be filed and
served without payment of costs, pending a further order at the
hearing, and that a copy of this Petition and Order be delivered
to the Pennsylvania State and Carlisle Police Departments as the
Police Departments with jur1sdiction to enforce this Order.
The plaintiff prays for such other relief as may be just and
proper.

PROTECTIVE ORDER
AND NOW, this z/~ day of October, 1994, upon consideration
of the Consent Agreement of the parties, the following Order is
entered:
1. The defendant, MELVIN L. WILLIAMS, is enjoined from
physically abusing the plaintiff, ETHEL D. BOOKER, or from
placing her in fear of abuse.
2. The defendant, MELVIN L. WILLIAMS, is enjoined from
having any contact with the plaintiff, including but not limited
to, harassing or stalking the plaintiff, and harassing the
plaintiff's relatives or minor children.
3. The defendant, MELVIN L. WILLIAMS, is hereby excluded
from the premises located at 223 Plaza Drive, Boiling Springs,
Pennsylvania. The defendant is hereby notified that if he
resides in the plaintiff's domicile contrary to this Order, he
may be in indirect criminal contempt which is punishable by a
fine not to exceed $1,000 and/or by a sentence of up to six
months in jail and any other appropriate punishment. Resumption
of co-residence on the part of the plaintiff and defendant shall
not nullify the prOVisions of the court order directing the

defendant to refrain from abusing the plaintiff.
4. The defendent, MELVIN L. WILLIAMS, is ordered to stay
away from any residence the plaintiff may est~blish for herself
in ths future.
5. This Order shall remain in effect for a period of one
year.
6. The Pennsylvania State and Carlisle Police Departments
will be provided with a copy of this Order by attorneys for
plaintiff and may enforce this Order by arrest for indirect
criminal contempt without warrant upon probable cause that this
Order has been violated, whether or not the violation is
committed in the presence of the police officer. In the event
that an arrest is made under this section, the defendant shall
taken without unnecessary delay before the Court that issued the
Order. When that Court is unavailable, the defendant shall be
taken before the appropriate district justice (23 PS Section
6113 ).

CONSENT AGREEMENT
This Agreement is entered on this ~ day of october,
1994, by the Plaintiff, ETHEL D. BOOKER, and the defendant,
MELVIN L. WILLIAMS. The plaintiff is represented by Joan Carey,
of Legal Services, Inc.; the defendant is unrepresented but is
aware of his right to have an attorney. The parties agree that
the following may be entered as an Order of Court.
1. The defendant, MELVIN L. WILLIAMS, agrees to refrain
from abusing the plaintiff. ETHEL D. BOOKER. or from placing her
in fear of abuse.
2. The defendant agrees not to have any contact with the
plaintiff.
3. The defendant agrees not to harass or stalk the
plaintiff. harass the plaintiff's relatives or the minor
children.
4. The defendant agrees to stay away from the residence
located at 223 Plaza Drive, Boiling Springs. Pennsylvania.
5. The defendant agrees to stay away from any residence the
Plaintiff may establish for herself in the future.
6. The defendant. although entering into this Agreement,

does not admit the allegations made in this Petition.
7. The defendant understands that the Protective Order
entered in this matter shall be in effect for a period of one
year.
8. The defendant understands that this Order will be
enforceuble in the same manner as the Court's prior Temporary
Protective Order entered in this case.
WHEREFORE, the partios request that an Order of Court be
entered to reflect the above terms.
