STIPULATION AGAINST LIENS
THIS AGREEMENT made the -:If? day of September, 1994, by and between HOMES
BY KEYSTONE, INC., hereinafter referred to as Contractor, and STEVEN D. FEAL TMAN and
KIMBERLY S. FEAL TMAN, husband and wife, hereinafter referred to as Owner, whereby the former
undertakes and agreas to erect and construct a modular single family dwelling on:
ALL THAT CERTAIN tract of land with improvements thereon erected situate in Lower
Frankford Township, Cumberland County, Pennsylvania, bounded and described in accordance with
a survey prepared by Stephen G. Fisher, R.S., dated October 9, 1984, and recorded in the Office
of the Recorder of Deeds in and for Cumberland County, in Plan Book 47, Page 9, as follows:
BEGINNING at a point in the center line of T -460 at corner of lands now or formerly
of Ralph L. Mountz, et ux; thence along lands now or formerly of Ralph L. Mount, et ux; North 07
degrees 14 minutes 00 seconds West, 226.05 feet to an Iron pin; thence still along lands now or
formerly of Ralph L. Mountz, et ux; South 88 degrees 28 minutes 58 seconds East, 192.92 feet to
an iron pin; thence along lands now or formerly of Jack Swartz, South 20 degrees 15 minutes 00
seconds West, 127.21 feet to an iron pin set at post; thence still along lands now or formerly of Jack
Swartz, South 62 degrees 10 minutes 23 seconds East, 145.79 feet to a nail in the center line of
T -460; thence along T.460 by a curve to the right having a radius of 405.81 feet an arc length of
80.67 feet to a P.K. nail; thence still along the center line of T-460, South 84 degrees 33 minutes 58
seconds West, 171.03 feet to a point, the Place of BEGINNING.
CONTAINING 37,855.52 square feet and being Lot No.3 on the aforesaid Plan.
BEING the same property which Rodney J. Walters and Kimberly S. Walters, husband
and wife, by their Deed dated August 22, 1990, and recorded in the Office of the Recorder of Deeds
in and for Cumberland County, in Deed Book "S", Volume 34, Page 1047, granted and conveyed
lCnto Kimberly S. Walters.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said Contractor, for and In
consideratioll of the sum of One and 00/100 ($1.00) Dollar to him in hand paid by Owner, the
receipt whereof is hereby acknowledged, and the further consideration mentioned in the agresment
aforesaid, for themselves and their subcontractors, and all parties acting through or under them,
covenant and agree that no mechanic's liens or claims thereto for or on account of any work done
or materials furnished by them or any of them under said contract or otherwise, for, towards, in, or
about the erection and construction of the said buildings on the lot above described, and the said .
Contractor, for themselves, their subcontractors and others under them hereby expressly waive and
relinquish the right to have, file and maintain any mechanic's liens or claims against the said
buildings or any of them, and agree that this instrument, waiving the right of lien, shall be an
independent covenant.
