BARBOUR, DEFENDANT OPINION AND ORDER OF COURT BAYLEY, J., September 15.1995:- Plaintiff, Pennsylvania Power & Light Co., obtained a $2,346.41 judgment against defendant, Kimberly D. Barbour, before a District Justice. Pursuant to a writ of execution Issued in this court, the Sheriff attached some personal property of defendant and money in her bank account at Commerce Bank. Pursuant to Pa. Rule of Civil Procedure 3123.1, defendant filed a claim for a $300 statutory exemption, and a claim that the money levied against In her Commerce Bank account is Immune from attachment because it constitutes wages. A hearing was held on September 11, 1995. Of the money levied against in defendant's Commerce 8an~ account, the sum of $584.45 came from a direct deposit of wages from her employer, Keystone Health Plan, on September 1, 1995. With certain exceptions not applicable here, the Judicial Code at 42 Pa.C.S. Section 8127, provides: The wages, salaries and commissions of individuals shall while In the hands of the employer be exempt from any attachment, execution or other process. . . (emphasis added). . 94-5822 CIVIL TERM Defendant's wages were not garnisheed. The money In her bank account which came from those wages was attached by levy. That the source of the money was wages does not exempt It from levy once the money was placed In defendant's account because, at that point, it was no longer In the hands of her employer. See, Continental Bank v. Abrams et al., 37 Cumberland L.J. 554 (198?). The JIJdlcial Code at 42 Pa.C.S. Section 8123, titled aeneral monetary exemption, provides: (a) General rule.-In addition to any other property specifically exempted by this subchapter, property of the judgment debtor (Including bank notes, money, securities, real property, judgments or other indebtedness due the judgment debtor) to the value of $300 shall be exempt from attachment or execution on a judgment. Within such time as may be prescribed by general rules the judgment debtor may claim the exemption in kind and may designate the specific items of property to which the exemption provided by thi!l section shall be applicable unless the designated property is not capable of appropriate division, or the judgment debtor may claim the exemption In cash out of the proceeds of the sale. Defendant is entitled to a $300 statutory exemption. In her claim for that exemption she did not designate the specific property to which the exemption shall be applicable. Within seven days she shall file with the Sheriff a written amendment setting forth the property to be exempted.
