In consideration of the eurn of one ($1.00) Dollar, in hand paid,
the receipt of which le hereby acknowledged, the undersigned, intend-
ing to be leqally bound hereby, does hereby state under oath that no
labor and IMterial. have been furnished by the undersigned under the
aforeeaid contract to the above described premises to date, and that
the undersign"d, for itselt or himself, his or its subcontractors and
materialmen, and all other persons acting for, through, or under it-
.elf or himself, does waive, relinquish and release all right to file
or have filed or malntain any mechanic's lien or liens or claims
against the sald bullding(s) and appurtenant facilities and structures
and real estate, both as to the aforesaid work performed or materials
furniahed to date, as well as work remaining to be performed or
materials to be furnlshed under said contract.

This Release and walver is executed and given in favor of and for
the bensUt of each and every party legally or equitably, now or
hereafter, owning an interest in the subject property and to any party
Who hall made or Who ln the future makes a loan or loans secured on
aaid real property and improvements and his, its or their successors
and assigns and/or the title company or companies examining and/or in-
suring the title to said real estate; and the undersigned does further
warrant that he has the full right to execute this Release and Waiver
and to blnd the parties on whose behalf he has affixed his signature
hereinbelow. 'mis Release and Waiver of Liens shall be an independent
covenant and shall operate and be effective as well with respect to
work and labor done and materials furnished under any supplemental
contract or contracts, whether oral or written, for extra or addi-
tional work, and for any other and further work done or materials fur-
ni8hed at any ellllB with respect to the subject property subsequent to
the execution of this Release and Waiver.

follows, to wit:
BEGINNING on the Western dedicated right-of-way line of
S.-rfield Drive, said point being pn the dividing line between
Lot Nos. 68 and 67 on the hereinafter mentioned Plan of Lots;
thence along said dividing line, South 41 degrees 56 minutes 01
second West, one hundred twenty-five and zero one-hundredths
(125.00) feet to a point; thence North 48 degrees 03 minutes 59
seconds West, one hundred twenty and zero one-hundredths (120.00)
feet to a point on the dividing line between lot Nos. 68 and 69
on the hereinafter mentioned Plan of Lots; thence continuing
along said dividing line, North 41 degrees 56 minutes 01 eecond
East, one hundred twenty-five and zero one-hundredths (125.00)
feet to a point on the Western dedicated right-Of-way line of
SUmmerfield Drive; thElIlce along same, South 48 degrees 03 minutes
59 seconds East:, one hundred twenty and zero one-hundredths

and 67 on the hereinafter mentioned Plan of Lots, the place of
beginning .
BEING Lot No. 68 on Phase IV - Final Subdivision Plan of
Meadowview Estates, said Plan being recorded in the CUmberland
C;:ounty Recorder of Deeds Office in Plan Book 62, Page 77.
BEING the same premises which John M. Knaub and Janet D. Knaub,
his wife, by deed dated August 3, 1994 conveyed to Elouise M.
statler.

Restrictive Covenants dated April 18, 1991 and recorded in the
