Defendant, WANDA F. RILEY, t/d/b/a HEARING AID SERVICES, by
and through her attorney MICHAEL CHEREWKA, BSQ., petitions this
Court pursuant to Pa.R.C.P, No. 1037 for the entry of jud9lllent non
pros against Plaintiff, JACOB S. STONER, and in support avers the
following:
VB.
1. Plaintiff commenced this civil action by a District
Justice Complaint on August 17, 1994,
2. Judgment was entered against the defendant on September
IS, 1994.
3. Defendant filed a Notice of Appeal on the District
Justice decision and a ~raecipe to Enter Rule to File Complaint and
Rule to File on October 3, 1994. Proof of receipt of service of
the Praecipe and Rule is attached hereto as Exhibit "A".
4. By NOTICE OF INTENTION TO FILE PRAECIPE dated November 8,
1994, defendant instructed Plaintiff to act within ten (10) days of
the date of Notice or suffer the entry of jud9lllent against
plaintiff. A copy of the November 8, 1994 praecipe and proof of
receipt of service is attached hereto as Exhibit "B".
5. Plaintiff has failed to file a Complaint in accordance
with the November 8, 1994 praecipe.
WHEREFORE, defendant respectfully requests that this Court
enter jud9lllent of non pros against plaintiff and in favor of
defendant.
