COMPLAINT
AND NOW, comes the plaintiff Gail M. Sconing, and files the
following compla.Lnt against the defendant Triple Crown corporation
and in support thereof avers the fOllowing.
1. The plaintiff Gail M. Sconing is an adult individual
residing at 4164 Nantucket Drive, Mechanicsburg, Pennsylvania
l7055.
2. The defendant Triple Crown corporation, is a Pennsylvania
corporation with its principal place of business at 5J51 Jaycee
Avenue, Harrisburg, Pennsylvania 17ll2.
J. On or about March l7, 1993, the plaintiff contracted with
the defendant for the purchase and bui lding of a new home then
known as Lot 142, Beaumont Square, which is now the plaintiff's
residence. A copy of the Sales Agreement for this real estate is
attached hereto as Exhibit "A".
4. On or about August 16, 1993 plaintiff and defendant closed
on the sale of the above referenced property and a deed was
recorded in the plaintiff's name.
5. As part of the purchase of the property from the

d~fandant, the defendant provided plaintLff its $tandard limited
warranty, which among other things, warranted that the plumbing,
heating and electric wiring systems would be free of defects in
materials or workmanship. A copy of the Limited Warranty i$
attached hereto as Exhiblt "8".
6. In December 1993 and January 1994, the plaintiff
experienced extraordinary high electric bills to heat the premises.
7. In January, 1994, plaintiff called the defendant to rep<1rt
the problem of a cold house and asked that certain repairs be
performed.
8. In February, 1994, when the defendant came to repair the
plalntiff's home, she complained that the heat was running all of
the time. She was informed by the defendant's agent that this was
characteristic of heat pumps and was to be expected.
9. In February and March 1994, the plaintiff continued to
complaint to the defendant about h~~ extraordinary high heat bills
insisting that this could not be normal for the heat pump
operation.
10. In March 1994, the defendant finally agreed to check the
heat pump system and determined that it had to be recharged with
freon and that the lack of freon in the system was what was causing
the plaintiff's problem.
11. As a result of the heating system being defective and/or
not operating properly, the plaintiff was forced to expend
unnecessary and excessive amounts of money to heat her home from
November 1993 through February 1994 in the approximate amount of
$615.00.

12. The plaintiff has demanded that defendant reimburse her
for the additional expense incurred as a result of the defective
and/or inoperable heating system provided with the purchase of her
new home from defendant. To date, the defendant has r.f~.ed to
honor the plaintiff's request for reimbursement.
COUNT I. BREACH OF CONTRACT
13. The averments of paragraphs 1 through 12 are incorporated
herein by referenced as though the same were fully set forth herein
at length.
14. The defendant's provision of a defective and/or
inoperable heating system under its Agreement of Sale for the reai
estate to the plaintiff constitutes a breach of contract.
15. The plaintiff has suffered unnecessary and excessive
expenses as a result of the defendant's breach of its contract.
WHEREFORE, the plaintiff respectfully requests that judgment
be entered in her favor and against the defendant in the
approximate amount of $615.00, plus costs, fees and such other
relief as this Court deems just and proper.
COUNT II. BREACH OF WARRANTY
16. The averments of paragraphs 1 through 15 are incorporated
herein by ref,erence as though the same were fully set forth herein
at length.
17. The express terms of the Limited Warranty provided the
plaintiff under the purchase of the property warranted that the
heating system would be free of defects in materials and/or
workmanshIp.
18. The provision of a defective and/or inoperable heating
system to plaintiff constitutes a breach of the iimited warranty
provided by the defendant.
19. The plaintiff has suffered unnecessary and excessive
expenses as result of the defendant's breach of its limited
wa rranty.
WHEREFORE, the plaintiff respectfully requests that jUdgment
be entered in her favor and against the defendant in the
approximate amount of $615.00 plus costs, fees and such other and
further relief as this Court deems just and proper.
