AND NOW comes the Defendant, Ronald Guyer, by his attorney,
James M. Bach, and files the with PRELIMINARY OBJECTION.
PRELIMINARY OBJECTION
SET I -
DEMURRER
t. This Demurrer should be sustained because the Complaint
alleges a cause of Action (ex-contractu). Upon pleading an
Action ex-contractu, the existence of a contract (including
its essential terms)l a breach of duty imposed by said contract
results in damages, all of which must be well pled into the
Complaint.
2. In the ifistant case, none of the elements of a contract,
or an Action ex-contractu have been pleaded, nor does the
Complaint attach, as required by the Pennsylvania Rule of Civil
Procedure, the Contract itself. Absent these items in a cause
of Action ex-contractu, the Complaint must be dismissed.
See the General state Authority, Commonwealth of Pennsylvania,
vs. Coleman Cable and Wire Company. 365 Pa.2d. 1347, 1349 (1976).
WHEREFORE, the Complaint should be dismissed.
