THIS AGREEMENT,
1996, by and between MELANIE R. NEYER, hereinatter referred to as
WIFE and JOHN RICKARD NEYER, hereinafter referred to as HUSBAND.

WHIRBAS, the parties were lawfully married on June 19, 1976 in
New Cumberland, Pennsylvania; and
WHIREAS, two children have been born as a result of this
marriage, namely John R. Neyer, Jr., born 3/23/81 and Valerie
Neyer, born 2/15/87; and

diverse
unhappy
differences,
disputes
and
difficulties have arisen between tha parties and it is the
intention of WIFE and HUSBAND to live separate and apart for the
rest of their natural lives, and the parties desire to settle fully
and finally their respective financial and property rights and
obligations as between each other including, without limitation by
specification: (1) settling of all matters between them relating
~',o the ownership and equitable distribution of real and personal
property; (2) settling of all matters between them relating to the
past, present and future support, alimony and/or maintenance of
WIFE by HUSBAND or of HUSBAND by WIFE; (3) settling of all matters
between them relating to any and all claims and possible claims by
one against the other or against their respective estates; and (4)
settling of all matters between them relating to the custody and
support of the minor children.

WOW TBBRB~ORB, in consideration or the foregoing promises and
of the mutual promises, covenants and undertakings hereinafter set
forth and for other good and valuable consideration, receipt of
which is hereby acknowledged by each of the parties, WIFE and
HUSBAND, each intending to be legally bound hereby, covenant and
agree as follows:
1. DIVORCE
On or about October 4, 1994, WIFE filed a Complaint in Divorce
which is captioned as No. 94-5683 civil Term in the Court of Common
Pleas of Cumberland county, Pennsylvania. HUSBAND and WIFE hereby
agree that contemporaneous with the execution of this Marriage
settlement Agreement each of them will execute an Affidavit of
Consent to the entry of a no-fault divorce decree and a waiver of
their right to receive notice of intention to seeK the entry of a
divorce decree in this matter. Pending the entry of a divorce
decree HUSBAND and WIFE shall at all times hereafter have the right
to live separate and apart from each other and to reside from time
to time at such place or places as they shall respectively deem
fit, free from any control, restraint or interference whatsoever by
the other. Neither party shall molest the other or endeavor to
compel the other to cohabit or dwell with him or her by any legal
or other procedures. The foregoing provision shall not be taken to
be an admission on the part of either HUSBAND or WIFE of the
lawfulness or unlawfulness of the causes leading to their living
apart.

2 . DEBTS
Except lor certain medical expenses for the treatment of the
parties' son, John Richard Neyer, Jr. and some delinquent 'utility
payments due in connection with the marital residence the parties
do not have knowledge of any other outstanding marital debts. It
is agreed that HUSBAND will pay the outstanding medical expenses
for the treatment of John Richard Neyer, Jr. which are currently
outstanding. with regard to any delinquent utility payments in
connection with the marital residence HUSBAND moved out of the
r.esidence on or about September 30, 1995.. and HUSBAND agrees to be
responsible for all delinquent utilities that were either
delinquent or due and owing as of September 30, 1995. WIFE will be
responsible for all utilities since September 30, 1995 as well as
any delinquent payments due on utilities for the marital residence
since September 30, 1995. Each party will indemnify and hold the
other harmless for any of these obligations that they have agreed
to pay.
3. PERSOMAL PROPERTY
HUSBAND and WIFE hereby acknowledge that they have agreed upon
the division of all tangible personal property, including jewelry,
clothing, furniture, household equipment, appliances, motor
vehicles, recreational vehicles and tools. These items of tangible
personal property have already been divided and are in the
possession of the party to whom they will go und.r the terms of
this Agreement.

4. AFTER-ACQUIRED PERSONAL PROPERTY
Each at the parties shall hereatter own arId enjoy,
independently ot any claims or rights at the other, all items of
personal property, tangible or intangible, hereafter acquired by
him or her, with full power in him or her to dispose of the same as
fully and effectively, in all respects and for all purposes, as
though he or she were unmarried.
5. MARITAL RESIDENCE
HUSBAND and WIFE agree that the marital residence located at
121 Market street, New Cumberland, Cumberland County, Pennsylvania,
shall become the sole and exclusive property of WIFE. There was an
outstanding mortgage on the marital residence however, WIFE has
payment in full on the outstanding marital residence and HUSBAND
has been provided a copy of the Note which is indicated to be paid
in full by the Homestead savings Association. Therefore, HUSBAND
agrees to execute a quitclaim deed transferring all right title and
interest which he may have in the marital residence to WIFE. The
said quitclaim deed is being executed contemporaneously with
HUSB~ND's execution of this Marriage Settlement Agreement.
6. PAYMENTS
HUSBAND and WIFE have received a check from the Omaha Property
and Casualty Insurance Company in the amount of $2,173.83. This
amount is for damage caused to personal property which was the
contents of the first floor which experienced a flood within the
past year. It is agreed that HUSBAND will receive the entire

amount of this check which is $2,173.83. It is understood that the
parties have intended to etfect an equitable division of their
jointly owned property. The parties have determined that an
equitable division of such property conforms to a just and right
standard, with due regard to the rights of each party. The
division of existing marital property is not intended by the
parties to constitute in any way a sale or exchange or assets, and
the division is being effected without the introduction of outside
funds or other property not constituting a part of the marital
estate. It is the intention of the parties to treat all transfers
herein as not taxable.
7. PENSION AND EMPLOYMENT BENEFITS
HUSBAND is employed with the Rite Aid corporation and
currently has a pension and/or other employment benefits through
his employment. WIFE hereby gives up any right, claim, title or
interest in HUSBAND's pension or other employment benefits.
WIFE has no pension or employment benefits to which HUSBAND
maKes any claim.
8. ALIMONY
Both parties acknowledge and agree that the provisions of this
Agreement providing for equitable distribution of marital property
are fair, adequate and satisfactory to them and are accepted by
them in lieu of and in full and final settlement and satisfaction
of any claims or demands that either may now or hereafter have
against the other for support, maintenance or alimony. HUSBAND and

WIFE further, voluntarily and intelligently, vaive and relinquish
any right to seek from the other any payment for support or
alimony. Each party shall indemnify, defend and hold the other
harmless against any future action of either support or alimony
brought by or on behalf of the other, such indemnity to include the
4ctual counsel fees of the defendant in any such future action.
9. CUSTODY
HUSBAND and WIFE hereby agree that legal custody of the two
minor children shall be shared equally by the parties.
HUSBAND and WIFE hereby agree that WIFE shall have primary
physical custody of the two minor children, John Neyer, Jr. and
Valerie Neyer. WIFE agrees that HUSBAND shall be entitled to
partial custody rights regarding the children as follows:
(al Father shall have one full day of custody every
alternating weeKend at times and circumstances as can be arranged
between the parties and the children. This period of partial
custody may be expanded in the future as the parties agree.
(bl The parties acknowledge that it is their intention to
expand this period of partial custody in the future as they and the
children agree. Father acknowledges the need to have appropriate
supervision of the children in light of the past sexual misconduct
of the son, John, toward the daughter, valerie, and agrees to
follow the requirements of Children & Youth Services regarding
periods of time during which he exercises custody of the children.
(cl In the event that the parties are unable to agree upon an

expan.ion of period. of partial cuatody in the future each party
reserves the right to petition the Court for modification which
would be approved by Court Order.
10. RELEASE
Subject to the provisions of this Agreement, each party has
released and discharged, and by this Agreement does for himself or
herself, and his or h~r heirs, legal representatives, executors,
administrators and assigns, release, indemnify (including actual
legal fees) and discharge the other of and from all causes of
action, claims, rights, or demands, whatsoever in law or equity,
including equitable distribution, spousal support, alimony, counsel
fees, alimony pendente lite and expenses which of the parties
against the other ever had, now has, or may have in the future
under the Pennsylvania Divorce Code, as amended, or under any other
statutory or common law, except as set forth below in this
paragraph, all causes of actio~ for divorce, and all causes of
action for breach of any provisions of this Agreement, including
pro<::eedin<;is to enforce this Agreement pursuant to the provisions of
the Divorce Code. Each party also waives his or her right to
request marital counseling, pursuant to the Divorce Code.
11. WAIVERS OF CLAIMS AGAINST ESTATES
Except as herein otherwise provided, each party may dispose of
his or her own property in any way, and each party hereby waives
and relinquishes any and all rights he or she may now have or
hereafter acquire under the present or future laws of any

jurisdiction, to share in the property or estate of the other as a
result of the marital relationship, including without limitation,
dower, curtesy, statutory allowance, widow's allowance, right to
take against the will of the other, and right to act as
administrator or executor of the other's estate, and any right
existing now or in the future under the Pennsylvania Divorce Code,
as amended from time to time, and each will, at the request of the
other, execute, acknowledge and deliver any and all instruments
which may be necessary or advisable to carry into effect this
mutual waiver and relinquishment of all such interests, rights and
claims.
12. RIGHTS ON EXECUTION
Immediately upon the execution of this Agreement, the rights
of each party against the other, despite their continuing marital
status, shall terminate and be as if they were never married.
13. LEGAL FEES
If either party to this Agreement resorts to a lawsuit or
other legal action to enforce the provisions of this Agreement, the
successful party shall be entitled to recover his or her reasonable
counsel fees, actually incurred, from the other as a part of the
judgment entered in such legal action, whether in law, in equity or
pursuant to the provisions of the Divorce Code, as the same shall
be determined by the Court.
14. INCORPORATION IN FINAL DIVORCE
The terms of this Agreement shall be incorporated but shall

not merge in a final divorce decree between the partieD. This
Agreement shall survive in its entirety, reSOlving the spousal
support, alimony, equitable distribution and other intereets and
rights of the parties under and pursuant to the Divorce Code of the
Commonwealth of Pennsylvania, and no court asked to enforce or
interpret this Agreement shall in any way change the terms of this
Agreement. This Agreement may be enforced independently ot any
child support order, divorce decree or judgment and its termd shall
take precedence over same, remaining the primary obligation of each
party. Except as herein otherwise agreed, this Agreement shall
remain in full force and effect regardless of any change in the
marital status of the parties. It is warranted, covenanted and
represented by HUSBAND and WIFE, each to the other, that this
Agreement is lawful and enforceable, and this warranty, covenant
and representation is made for the specific purpose of inducing the
parties to execute the Agreement.
15. ADDITIONAL INSTRUMENTS
Each of the parties shall from time to time, at the request of
the other, execute, acknowledge and deliver to the other party, any
and all further instruments that may be reasonably required to give
full force and effect to the provisions of this Agreement.
16. EN1'IRE AGREEMENT
This written Agreement contains the entire agreement between.
the parties. There are no other written or oral agreements other
than what is contained within this writing.

17. MODIFICATION AND WAIVER
A modification or waiver of any of the provisions of this
Agreement shall be effective only if made in writing and executed
with the same formality as this Agreement. The failure of either
party to insist upon strict performance of ths provisions of this
Agreement shall not be construed as a waiver of any subsequent
default of the same or similar nature.
18. VOLUNTARV EXECUTION
Each party aCKnowledges that the Agreement is fair and
equitable, that it is being entered into voluntarily, with full
Knowledge of the assets of both parties, and that it is not the
result of any duress or undue influence. The parties aCKnowledge
that they have been furnished with all informatlon relating to the
financial affairs of the other which has been requested by each of
them.

19. DESCRIPTIVE HEADINCS
The descriptive headings used herein are for convenience only.
They shall have no effect whatsoever in determining the rights or
obligations ot the parties.
20. CONTROLLINC LAW
This Agreement shall be construed in accordance with the laws
of the Commonwealth of Pennsylvania.

1. The plaintiff in thia action is MELANIE R. NEYER, an adult
individual, who currently resides at 121 Market Street, New
Cumberland, Cumberland County, Pennsylvania 17070.
2. The defendant in this action is JOHN RICHARD NEYER, SR., an
adult individual, who currently resides at 121 Market Street, New
Cumberland, Cumberland County, Pennsylvania 17070.
3. Both the plaintiff and the defendant have been bona fide
residents of the Commonwealth of Pennsylvania for at lea at six (6)
months immediately previous to the filing of this complaint.
4. The plaintiff and defendant were lawfully joined in marriage
on June 19, 1976, in New Cumberland, Cumberland County, Pennsylvania.
5. There have been no prior actions of divorce or for annulment
between the parties hereto in this or any other jurisdiction.

Valorie Lynn Neyer. born February 15, 1987, this temporary order

1. Temporary physical custody at two children is
awarded to their mother, Melany R. Neyer.

have aupervised visitation with both children by a mental health
prot.s.ional. The mother shall fully cooperate in making
arrangements tor this supervised visitation so that the tather
may remain in steady contact with his children.
3. The parties shall have undertaken an
independent evaluation, hopefully conducted by a professional
tor whom all or part at the costs shall be born by the father'.
Blue Cross/Blue Shield medical coverage.
4. To the extent that there are unreimbursable
costs for this evaluation, the father shall pay the ditterence.
If the father feels that the mother should be required to
contribute to that difference, he may seek such an order in this
court.

AND 1Ol, this 25(dayof (J,c.OJh 1995, upon consideration of
the attached Custody Conciliation Report, it is hereby ordered and directed
as follows:
1. A Hearing is scheduled in Cour.t Room # 2, of the CUmberland County
Court House o~ the 14th day of September, 1995, at 8:45 a.m. at which time
testimony will be taken in this case. At this Hearing, the Mother shall be
deemed to be the moving party and shall proceed initially with testimony.
2. Pending further Order of this Court or agreement of the parties,
this Court's prior Order of June 8, 1995, shall remain in effect with the
following modifications:
A. The weekend visitation provided in paragraph 3C of the Order
shall be suspended pending further Order of this Court and the
Father's periods of partial physical custody shall be limited
to every Tuesday evening from 4:30 p.m. until 7:30 p.m.
B. The provision of paragraph 3E of the Order prohibiting the
Father from taking the Children to their paternal grandmother's
house during the Father's periods of partial custody in June
and July shall be extended until further Order of this Court
and shall be expanded to prohibit the Father from transporting
the Children in his car.
C. Paragraph 4B of the Order shall be modified to provide that the
Mother shall

1. The pertinent information pertaining to the Children who are the
subjects of this litigatio~ is as follows:

2. A second Conciliation Conference was held on August 22, 1995, with
the following individuals in attendance:
The Mother, Melanie R. Neyer, appeared without legal counsel, and
the Father, John Richard Neyer, Sr., with his counsel, R. Mark Thomas,
Esquire.
3. The custody dispute involved in this matter began in Septeri:ler 1994
when the Mother filed a petition for Special Relief on an allegation of
abuse under the Protection from Abuse Act. The Mother alleged at that time
that the Father had exposed himself to his daughter in the families'
residence. A Hearing was held before Judge Sheely and consequently an Order
was entered on March 20, 1995 restoring the Father's right to remain and
live in the marital residence. A copy of Judge Sheely's Memorandum Opinion
and Court Order are attached hereto for the Court's convenient reference.
In April 1995, the Father filed a Petition seeking partial physical custody
of the Children and a Conciliation Conference was held on May 18, 1995 with
both parties and their counsel.
4. At the initial Conciliation Conference on May 18, 1995, the Mother
expressed concern that the daughter had been the victim of an incident of
incest involving her brother in 1994. The Mother also stated that the
daughter had been traumatized by the Father's exposure which was the subject
of the Hearing before Judge Sheely. As the result of the Mother's concerns
and the reservations and concerns expressed by the Children, the parties
agree to an Order under which the Mother would have primary physical custody
and the Father would have phased in overnight partial physical custody. A
restriction was also placed on the Father's ability to take the Children to
visit their paternal grandparents and relatives by agreement of the pdrties
in deference to the Children's concerns which were not discussed at the
Conference.
5. The overnight periods of partial custody with the Father were to
have begun in August, 1995. The Mother filed a Petition for Special Relief
alleging that overnight visitation was still not in the Children's best
interest and it was the opinion of the Children's counselors that overnight
visitation with the Father was inadvisable. The two concerns raised by the
Mother at the most recent Conference on August 22, 1995, was that the
daughter was too fearful and certainly not ready to begin overnight
visitation with her Father. The Mother also expressed concern that the
Father would not adequately protect the daughter from reoccurrence of an
sexual assualt by the brother. The Mother stated that on August 5, 1995,
the most recent period of partial physical custody, the Children refused to
get in the car with the Father and instead left the Father I s residence
without his permission and returned to their grandmother's house. The
Mother stated that the Children refused to drive with the Father because,
the Mother believes the Children are afraid they will not be returned. No
allegation was made that the Father ever threatened not to return the
Children to the Mother.'s custody.
The Father acknowledged the Children left his custody on August 5,
1995. The Father contends that he is able to provide appropriate
supervision for the Children while they are in his custody and continues to
deny any allegations of sexual wrong doing on his part toward the Daughter.
The Father does not understand why the Children are unwilling to drive with
him or to visit his family in Tower City. The Father believes that given a
short period of additional time, the daughter would be receptive to going to
visit her paternal gr3ndparents and other relatives. The Father seeks to
have the partial custody arrangements outlined in the current Order
continued in effect.
6. A Hearing will be necessary on the issues of whether it is in the
best interest of the Children to stay overnight with their Father as
provided in the current Order and to be transported by their Father to their
paternal grandparents and other relatives in Tower City during the Father's
periods of partial custody. The Children I s counselors seem to be very
involved in this case and it is expected that they will testify on the
Mother1s behalf at the Hearing. The Conciliator highly recommended to the
Mother that she obtain legal counsel to represent her at the Hearing,
although the Mother did not seem receptive to this suggestion.
7. The Conciliator recommends that the existing Order remain in effect
with certain modifications temporarily deleting overnight custody with the
Father and adding a restriction that the Father not transport the Children
in the car pending Hearing in this matter. The parties agreed to these
arrangements pending an expedited hearing to resolve the custody issues on
an ongoing basis. It is anticipated that the Hearing will take at least two
to three hours.

Defendant has no information of a custody proceeding

other than the above-referred to action.

have custody or visitation rights with respect to the children.
13. The best interest and permanent welfare of the children
will be served by granting the relief requested because:
a. The Defendant is the father of the children and has
continuously resided with the children from their dates of birth

b. Although the mother made alle9ations under the
Protection From Abuse Act, following a hearing the alle9ations made
by the wite were not substantiated by evidence;
c. The allegations made by the mother are not true and
should not be used as a means to deprive the father of visits with
his children.
14. Each parent whose parental rights to the children have
not been terminated and the person who has physical custody of the
children have been named as parties to this action. All other
persons, named below, who are known to have or claim a right to
custody or visitation of the child will be 9iven notice of the
pendency of this action and the right to intervene.

custody of the children to Defendant.

the attached CUstody Conciliation Report, it is hereby ordered and directed as
follows:
1. The Mother, MelanJ e R. Neyer, and the Father, John Richard Neyer,
Sr., shall have joint legal custody of .John Richard Neyer, Jr., born March 23,
1981 and valerie Lynn Neyer, born February 15, 1987.
2. The Mother shall have primary physical custody of the Children.
3. The Father shall have partial physical custody of the Children
as follows:
A. Begiming the weekend after MamOrial Day, 1995, from 2:00 p.m.
until 4:00 p.m. on either Saturday or Sunday during every weekend
in June 1995. During the Father's periods of partial custody in
June, an adult in addition to the Father, who shall be selected
by mutual agreement of the parties, shall be present at all
times.
B. Begiming with the first weekend in July, 1995, from 2:00 p.m.
until 4:00 p.m. on either Saturday or Sunday during every Ii88kend
through the end of July. During the Father's periods of partial
physical custody during July 1995, it is not necessary that
another adult be present.
C. Begiming on the first weekend in August, 1995, on alternating
Ii88kends from Saturday at 8:30 a.m. until Sunday at 7:00 p.m. and
every Tuesday evening from 4:30 p.m. until 7:30 p.m.
D. Begiming in 1996, the Father shall enjoy extended periods of
partial custody of the Children during the sumner vacation by
mutual agreement of the parties.
E. The Father shall not take the Children to their paternal
grandnother's house during the Father's periods of partial
custody in June and July 1995.
4. The Mother and the Father shall have physical custody of the Children
on holidays as follows:
A. CUstody on the Christmas holiday shall be alternated from
DecentJer 24 at 12:00 noon until December 25 at 12:00 noon
(Segment A) and December 25 at 12:00 noon until Decerrber 26 at
12:00 noon (Segment BJ. The Mother shall have custody of the
Children in 1995 during Segment A and the Father shall have
custody of the Children in 1995 during Segment B. Thill schedule
shall be alternated from year to year with the Father enjoying
custody of the Children in 1996 during Segment A and the /'\other
enjoying custody of the Children in 1996 dul"ing Segment B.
B. CUstody of the Children shall be alternated between the partiu
during the following holidays from 10:00 a.m. until 7:00 p.m.:
Easter, Memorial Day, Independence Day, Labor Day, and
Thanksgiving. This alternating schedule shall begin with the
Mother having custody of the Children on Independence Day in
1995.
C. The Mother shall enjoy custody of the Children on every Mother's
Day from 10:00 a.m. until 7:00 p.m. and the Father shall enjoy
custody of the Children on every Father's Day, begiMing in 1996,
from 10:00 a.m. until 7:00 p.m.
5. If either party wishes to modify the custody arrangements set forth
in this order, that party may Petition the Court to have this case again
scheduled with the Custody Conciliator for a Conference.
