The Plaintiff, Whiteco Metrocom, by Its attorneys, KNUPP. KODAK, P.C., brings
this action of Assumpsit against the Defendants to recover the sum of THREE
THOUSAND SIX HUNDRED SEVENTY-TWO DOLLARS AND THIRTY-FIVE CENTS
($3,672.35) along with interest thereon at the legal rate from June 1, 1994, upon a cause
of action of which the following is a statement:
1. The Plaintiff, Whiteco Metrocom, is a corporation organized and existing
under the laws of the State of Indiana, having its principal office and place of business
at 1000 East 80th Place, Merrillville, Indiana 46410.
2. The Defendant, 314 Market Street, Inc. tla Bridgeside Square is a
corporation organized and existing under the laws of the Commonwealth of Pennsylvania,
having its principal office and place of business at 312-318 Market Street, Harrisburg,
Dauphin County, Pennsylvania 17101.

3. The Defendant, Donald L Brown, Jr. is an adult individual with an address
of 312-318 Market Street, Harrisburg, Dauphin County, Pennsylvania 17101.
COUNT 1
4. Persuant \0 the Credit Application attached hereto, made a part hereof and
marked Exhibit 'A", the Defendant, 314 Market Street, Inc. Va Brldgeside Square wbS
afforded credit privlledges with the Plaintiff.
5, On the dates, in the amounts, and for the prices set forth in a true and
correct copy of the Plaintiffs Invoice attached hereto, made a part hereof and marked
Exhibit "B", Plaintiff, at the special instance and oral request of the Defendant, 314 Market
Street, Inc. Va Bridgeside Square sold and delivered goods, wares and merchandise of
the kind and description set forth on said Exhibit "B" to the total amount of lWO
THOUSAND NINE HUNDRED DOLLARS ($2,900,00).
6. The prices charged for said goods. wares and merchandise were just and
reasonable, were the legal and market prices therefor and were the prices which the
Defendant orally promised and agreed to pay Plaintiff therefor,

10. Plaintiff has frequently demanded payment from Defendant, 314 Markel
Street, Inc. tla Bridgeslde Square, of said amount due and owing as aforesaid, but
Defendant has refused and neglected and still refuses and neglects to pay said amount
or any part thereof,
WHEREFORE, Plaintiff brings this suit to recover from Defendant the sum of
THREE THOUSAND SIX HUNDRED SEVENTY-TWO DOLLARS AND THIRTY-FIVE
CENTS ($3,672.35), together with interest thereon at the legal rate from June 1, 1994.

11. On or about September 17, 1993, Defendant. Donald L Brown, Jr. execute
a Personal Guarantee as to the obligation of 314 Market Street, Inc. tla Bridges/de
Square as shown on the Credit Application attached hereto, made a part hereof and
marked Exhibit "A",
12, Per Count I of this Complaint, 314 Market Street, Inc. lIa Bridgeside Square
is in default on its terms and conditions with Plaintiff, and Donald L Brown, Jr.. is
personally liable therefore, to the total amount of THREE THOUSAND SIX HUNDRED
SEVENTY-TWO DOLLARS AND THIRTY-FIVE CENTS ($3,672.35),
