Dear Judge Guido
I have received your note in which you indicate concerns
whether original service complies with Pa.R.C.P. 1930.4. I agree
with your analysis that the green card signature does not comply
with the currently constituted rule. However, the current rule did
not come into effect until January 1, 1996.
I enclose the rules that did apply for the time of service in
October 1994. They distill down to the requirements 1) that no
restricted delivery was needed 2) and someone authorized to receive
service signed the green card. 80th these requirements were met by
the signature of Paula's mother, Ann Duchene, which was where the
Defendant was living in October 1994.
I enclose a letter dated October 26, 1994, which indicates
that the Defendant did actually receive the original process and
sent it on to an attorney, who later withdrew from the case. In
these three and one half years, the opposing party has not objected
to process. Thus, in conformity with civil action as provided by
the Domestic Relations Rules, their failure to object waives any
defect of service which might exist.
I respectfully request the entry of a divorce decree on behalf
of my client, Terry Wagner.

acquired pre-maritally and SOMe acquired during the
marriage. please provide me with a listing of these
bonds, indicating face value, date issued and maturity

(7) We understand that husband is a participant in
a 40lK plan. Please provide information on this plan
pertaining to the date the plan started and the value at
separation.
(8) Please provide any information you have on
other marital assets and debts available to you or your
client.
When you provide the above I would also be interested in
having your thoughts on settlement. I have been informed that your
client may want to retain the marital home. If my understanding of
the values is current I am not certain that this is feasible since
it would require him to carry a rather substantial mortgage to
finance the buyout and refinance the existing mortgage. We will
remain open minded, however. at this point until all of the
information is shared.
