The Father of the child is Brian D. Blodgett. He is married to Petitioner.
4. The Petitioner currently resides -.vith the following people: Jessica Nicole Blodgett,
daughter.
5. The Respondent currently resides with the following people: no one.
6. Petitioner has participated as a party or witness or in another capacity, in other
litigation concerning the custody of the child, to wit: A custody action in York County,
PelUlSylvania, captioned Brian D. Blodgett v. April L. Blodgett, docketed to number 93-SU-
04208-03, in which an Order was entered on October 12, 1993, a true and correct copy of which
is attached hereto, marked Exhibit "A" and made a part hereof. Prior to this action there was
a Protection From Abuse action in York County docketed to 93-SU-0283 1-08 in which an Order
granting Petitioner custody on a temporary basis was entered.
Petitioner has no infonnation of a custody proceeding concerning the child pending in
a court of this Commonwealth ellcept the York County and Cumberland County actions as noted
above.
Petitioner does not know of a person not a party to the proceedings who has physical

confirming custody in the Petitioner/Mother and modifying the Respondent/Father's partial
custody rights as set forth in the October Order attached as Exhibit" A" in the following manner:
(a) Alternating weekends from Friday at 6:00 p.m. until Sunday at 6:00 p.m.. to
commence hereafter each year with the fU"st full weekend after New Year's Day in January with
Mother.
(b) Alternating holidays from 9:00 a.m. until 1:00 p.m., including Easter Day,
Memorial Day, Independence Day, Labor Day, and Thanksgiving Day, commencing with Easter
Day 1995 with Mother. Provided, however, if any of the foregoing holidays are on Friday or
Monday they will be included with any immediately succeeding or preceding alternating weekend
a party may have.
(c) During the Christmas holiday~ from Christmas Day at 3:00 p.m. until New
Year's Day at 3:00 p.m. each year on odd-numbered years; and, in even numbered years from
Christmas Eve day from 9:00 a.m. until 8:00 p.m. and December 26th at noon through January
1st at 6:00 p.m.
(d) The full week commencing at 6:00 p.m. the Friday of Respondent/Father's last
alternating weekend of each of the monlhs of January, March, May, July and September and
ending one week (seven days) thereafter at 6:00 p.rn. on the Friday following that alfernating
weekend until the child commences school, at which point the foregoing rights shall terminate
and in lieu thereof Respondent/Father shall be entitled to half of the child's summer school
vacation, designated in non-consecutive weeks, each week to commence on his nonna!
alternating weekends upon thirty days' advance notice to Petitioner/Mother.
(e) Every Father's Day from 9:00 a.m. until 6:00 p.m. with Mother having every
Mother's Day from 9:00 a.m. until 6:00 p.m.

pertaining to the petition for change of venue filed
by April L. Blodgett and involving the case of Brian
D. Blodgett, father, and April L. Blodgett, mother.
Father and mother are the parents of a
minor child, more particularly Jessica Nicole
Blodgett, whose date of birth is May 22nd, 1993.

of the mother.
An Order of Court had been entered
October l2th, 199J pertaining to the legal and
physical custody of Jesslca. That order is now
reafBrmed.
However, the petition to transfer
venue is now granted baaed upon the fact that the
child has resided wlth the mother in Cumberland
County tor a period in excess of six months.
The Court notes and adopts the

stipulation of tacts that counsel admitted to on the
record and incorporates that portion into this Order.
Accordingly, it is now directed to the
mother through her counsel that she file this matter
in Cumberland County and give appropriate notice of
such to Attorney aeaverson as well as to the father.
Copies of this order to be Bent to
Attorney Beaverson on behalf of the father and to
Attorney Matson on behalf of the mother.
Furthermore, it is noted that when the

Esquire, and states the following:
1. On July 12, 1993 the above parties appeared before this Court on a Protection
From Abuse Petition filed by Wife. A hearing was held and an Order was entered resolving the
issues of ternporary spousal and child support, possession of the residence and visitation rights
of Father.
2. On August 5, 1993 the Order was modified to allow the parties contact regarding
marital issues and their child. Jessica.
3. On October 12. 1993 a Custody Conciliation Conference was held before James
A. Holtzer, Esq. An Order was entered by this Court on October IS, 1993. Majority physical
custody was confirmed in Mother and Father was granted partial rights of visitation.
4. In view of the Protection From Abuse Order which gave the house to Brian
Blodgett, and the parties' declining marriage, Mother moved to Cumberland County,
Pennsylvania in August of 1993. She has resided in Cumberland County for the past ten
months. The child, Jessica, has resided in Cumberland County, as well, and will continue to
do so as long as the Mother has majority custody.

Pursuant to representations made to the Conciliator at
the pre-hearing conference that an agreement had been
essen tially reached between the parties, it is ORDERED AND
DIRECTED that the parties shall share legal custody of their
daughter, Jessica Nicole Blodgett, born May 22, 1993.

Majority physical custody is hereby confirmed in
Mother, the Defendant herein.
Plaintiff Father shall have rights of minority custody
48 follows:
1. On alternate weekends from Friday at 6:00
p.m. until Sunday at 6:00 p.m., commencing Friday,
October 15, 1993.
2. On alternate holidays from 9:00 a.m.
until 7:00 p.m., commencing Thanksgiving Day,
1993, and also including Good Friday, Memorial
Day, Fourth of July and Labor Day. Provided,
however, that if any of the foregoing holidays are
on Friday or Monday, they will be included with
any weekend visitation Father may have.
3. During the Christmas holidays from
Christmas Day at 2:00 p.m. until New Year's Day at
6:00 p.m., each year.
4. For the full week ending on
Sunday of each January, March, May,
September.
S. At any other time as the parties may

adjust this schedule, if necessary, to allow Father to have

B. The fallowing alternating holidays. from 9:00 a.m. until 7:00 p...:
Easter Day. Memorial Day. Independence Day. Labor Day. and Thanksgiving Day.
The father's holidays shall commence with Easter Day in 1995. On those
occasions when the father's scheduled holiday falls adjacent to one of hiB
alternating weekends. the alternating weekend shall expand into the holiday
so the father has the child for three full days and one hour.

C. During the Christ.as holiday every year frO! 3:00 p... on Christ.as
Day until 3:00 p... on New Year's Day. Notwithstanding any other provision
of this order, the mother shall have the child for the period frO! 8:00 a.m.
on December 33 until 3:00 p.m. on Christmas Day each year.
D. One full week (defined as a 7-day period) during the months of
January, March, May, July, and September commencing at 6:00 p.m. on the
Priday of the father's last alternating weekend during each of those months,
and ending at 6:00 p... on the Friday immediately following. This scheduie
shall continue until the child co.mences school (which term shall include
kindergarden) at which time the foregoing schedule shall ter.iaate and
instead the father shall have one-half of the child's summer school vacation,
exercised in alternating non-consecutive weeks, each week to commence on his
normal alternating weekends at 6:00 p.m. on Friday and to conclude at 6:00
p... seven days later, except that each parent, on at least thirty (30) days'
written notice to the other parent, shall have two consecutive weeks with the
child, for purposes of vacation, uninterrupted by any time with the other
parent, after which the parties shall resume the alternating SChedule so that
the party not having the child for two weeks shall have the child for the
first week after the two week period. The parties shall organize the
schedule of custody of the child during the summer so that neither of the.
has the child for more than two consecutive weeks without the consent of the
other parent.
4. Notwithstanding the schedule of custody set out above. the father shall have
the child every Father's Day from 9:00 a.m. untii 6:00 p.m. and the mother shall bavs
the child every Mother's Day from 9:00 a.m. until 6:00 p.m.

3. A Conciliation Conference was held on 6 December 1994 and the following
individuals were present: the Plaintiff and his attorney, Scott A. Beaveraon. Bsquire;
the Defendant and her attorney, Jennifer H. Matson. Esquire.
3. The parties had an order entered in April of 1993 and wIshed to .ake several
modifications to make it more precise and to remove some conflicts in it. With the
able guidance of their attorneys, they were able to reach an agreement at the
conference. The attached order was dictated in their presence and approved by both of
them and, with the entry of that order, no further action is necessary.
