southerly right-Of-way line of High Meadow Lane, said
point also being the northeasterly corner of property
of Lot No. 28 of the aforementioned subdivision plan;
thence along said southerly line of High Meadow Lane,
South 88 degre9s 25 minutes 00 seconds East, one
hundred thirty-two (132.00) feet to a point; thence
along the westerly line of property of Lot No. 26 of
the aforementioned subdivision plan, South 01 degrees
35 minutes 00 seconds West, two hundred eighty-eight
and thirty-seven hundredths (288.37) feet to a point,
said point being on a northerly line of property of
residual lands of said Richard P. and Joan M. Eldredge;

7. Plaintiff resided in the Premises alone from in or about
May of 1988 until in or about June ot 1989 when he gave Defendant
catherine Salvador permission to move into the Premises.
8. Plaintiff allowed Defendant catherine Salvador to move
into the Premises in or about June of 1989 because they were
romantic partners at that time.
9. Defendant Catherine Salvador no longer has Plaintiff's
permission to remain on the Premises.
10. Defendant John Winner, Jr. has never received
Plaintiff'S permission to reside on the Premises.
11. On or about June a, 1994 a Notice to Quit was posted on
the Premises.
12. The fair market rental value of the Premise. i. at
least $2,000.00 per month.
13. Plaintiff is entitled to immediate possession of tbe
Premises occupied by Defendants.
14. Defendants have no valid legal right to remain in
possession of the Premises.
15. Defendants have willfully remained in possession
Premises after notice to quit and have refused to quit the

10. Denied. Each and every averment of paragraph 10 is specifically denied and strict
proof thereof is demanded at the time of trial. To the contrary, the Defendants aver that the
Plaintiff, gave his pennission to Defendant John WiMer, Jr. to reside on the premises and has
condoned his presence thereon.

12. Denied. Each and every averment of paragraph 12 is specifically denied and strict
proof thereof is demanded at the time of trial. To the contrary, the Defendants aver that the fair
market rental value of the premises is approximately twelve hundred dollars ($ 1,200.00) per
month.
IJ. Denied. Each and every averment of paragraph IJ is specifically rlenied and strict
proof thereof is demanded at the time of trial. To the contrary, the Defendants aver that Plaintiff'
and Defendant, Catherine M. Salvador entered into an agreement whereby Defendant Salvador
would be allowed to purchase the subject premises from the Plaintiff. Additionally, the
Defendants aver that the premises have been provided to Defendant Salvador in partial
satisfaction of Plaintiffs child support obligation. Additionally, Defendants would further aver
that Defendant Salvador has an equitable interest in said premises as a result of her status as
Common law Wife.
NEW MATTER - DIVORCE
16. The averments contained in paragraphs I through 15 are incorporated herein by
reference as set forth at length.
17. A Complaint in Divorce was filed in the Court of Common Pleas of Cumberland
County, Pennsylvania by Catherine Salvador, the Defendant herein, on July 25, 1994. A copy of
said Complaint is allached hereto and incorporated herein by reference as ElIhibit "A".
18. The aforementioned Complaint for Divorce contains a Count for Equitable
Distribution.
19. The subject premises were acquired by Plaintiff during the period of time it is
alleged that the parties were married and therefore the premises are marital property subject to
equitable distribution under the Divorce Code.
WHEREFORE, Defendants respectfully requests your Honorable Court to stay the
Ejectment Maller pending equitable distribution of the subject property.
NEW MATTER - CHILD SUPPORT AND OPTION TO PURCHASE PROPERTY
20. The averments contained in paragraphs I through 19 are incorporated herein by

3. Plaintiff has been a bona tide resident of the Commonwealth of Pennsylvania for at
least six monlhs immediately prior to the tiling of this Complaint.
4. The PlainlitTand the Defendant entered into a common law marriage on or about
August of 1984.
5. The parties separated on or about August of 1991.
6. Neither party has instituted any prior action of divorce or annulment with regard to
this marriage in this or any other jurisdiction.
7. There is are two children by this marriage: Leah Salvador born February I, 1986 and
Gabrielle Salvador born July 25, 1989.

that in or about August of 1991 it was agreed that in li~u of
child 8upport, Plaintiff would allow Defendant Salvador and her
children to reside in the subject premises on a temporary basis
until such time as they located another residence, It is
admitted that Plaintiff agreed he would provido sixteen hundred
dollars ($1,600.00) per month on a temporary basis. To the
extent that the averments contained in Paragraph 22 imply that
Plaintiff would provide the subject premises to Defendant
Salvador on a permanent ongoing basis, same is specifically
denied and strict proof thereof is demanded. It is further
denied that any of the above occurred upon separation of
Plaintiff and Defendant Salvador. On the contrary, it is averred
that Plaintiff and Defendant Salvador have never been married and
therefore, could not have "separated".

Defendant Salvador an option to purchase the subject premises.
