PRELIMINARY OBJECTIONS AND NON this 28th day of April, 1995, comes the Defendant, Judith Krebs, by and through her attorney Jack Hardy, Esquire, and hereby makes the following Preliminary Objections to the Complaint of Plaintiff. PreliminarY Obiections for Failure to Serve Complaint in a Timelv Manner Pursuant to Pa. R.C.P. 1028 la' 11'. 1). The Plaintiff filed her Complaint as an appeal to the District Justice hearing which resulted in a judgment in har favor within the 20 day required period. 2). The Plaintiff's Complaint was filed on October 31, 1994. 3) . The Complllint was not served on the Defendant until April 14, 1995, a period of 165 days had elapsed from October 31, 1994, the date the Complaint was filed. 4). Pa. R.C.P. District Justice Rule 1005 D, provides, as follows, "The party filing the Complaint, under Rule 1004 shall forthwith serve it upon the opposite party in the appeal...". 5). The Plaintiff did not serve the Complaint in a forthwith manner, as clearly required by Rule 1005, even though all pertinent information, as to the method and location of the service was clearly stated in the record. 6). In the alternative, pursuant to Pa. R.C.P. Rule 401, "Original process shall be served within the Commonwealth within thirty days after...the filing of the Complaint. 7). Plaintiff is required to carry out promptly her responsibility with respect to arranging service of the Complaint. 8). The Plaintiff failed to serve the Complaint for a period of 165 days. NHZRlrORl, Defendant requests that an Order sustaining her Preliminary Objections be granted, dismissing Plaintiff's Complaint with prejudice. 2 preli.lnarv Ob1ection for Failure to Conform with Rule of Court Pursuant to Pa. R.C.P. 1028 (a) (2). 9). Pa. R.C.P. Rule 1019 (h) requires that if any claim is based on a writing, that the pleader attach a copy of the writing. 10). Paragraph 3 of Plaintiff's Complaint, sets forth the legal description of the property in question, but does not attach a copy of the deed, or more importantly a survey to substantiate her allegation of ownership or trespass. 11). In Paragraph 5 of the Plaintiff's Complaint, the Plaintiff alleges damages without attaching any bill or estimate to substantiate the amount of the alleged damages. NHZREFORE, the Defendant requests that an order sustaining her Preliminary Objections be granted, dismissing the Plaintiff's Complaint with prejudice. preliminarv Obiection For Legal Insufficiencv Pursuant to Pa. R.C.P. 1028 la' (4). 12). Paragraph 6 of Plaintiff's Complaint alleges that the Defendant caused Plaintiff to suffer loss of privacy and Plaintiff's prayer for relief claims for punitive damages. 3 13). Plaintiff's pleading alleges no tortious conduct fairly characterized, as, "malicious, wanton, reckless, willful or oppressive" that would support the granting of punitive damages. WHEREFORE, Defendant requests that an Order sustaining her preliminary Objection be granted, dismissing Plaintiff's Complaint with prejudice. (,' 4 While Plaintiff recognizes now that Pennsylvania Rule of Civil Procedure 401 requires original process to be served within 30 days. Plaintiff was unaware of this Rule at the time of filin~ her Complaint. since she was relying on the District Justice Rules. However, Pa. R.C.P. Rule 401 does provide that -If service...is not made within the time prescribed.... the prothonotary upon praecipe and upon presentation of the original process. shall continue its validity by ... reinstating the complaint.... The Plaintiff did comply with this rule. Additionally, a review of case law indicated no cases in which a Complaint was stricken because of lack of service when the notice of appeal was properly served. Plaintiff therefore requests leave of the Court to serve her Complaint out of time, and submits that good cause has been shown and that no prejudice has occurred. Alternatively, Plaintiff would request leave to file an Amended Complaint and to serve that Amended Complaint in accordance with the Rules of Civil Procedure. 2. Defendant also files a Preliminary Objection challenging the Plaintiff's failure to attach a copy of the deed or a survey to substantiate her allegation of ownership of the progerty on which the trespass occurred. Further, Defendant claims that it was necessary to attach a copy of a bill or estimate to substantiate the amount of damages. Plaintiff would point out that the Deed which gives plaintiff ownership of that property is on record in the CUmberland County Courthouse office of the Recorder of Deeds and, therefore, pursuant to Pa. R.C.P. 1019 (g), it is not 2 necessary for the Plaintiff to have provided a copy of the Deed pursuant to Rule 1019 (h) of the Rules of civil Procedure. Pa. R.C.P Rule 1019(h). Moreover, surveys and bills or estimates are not the type of documents which generally need to be attached to a complaint; generally, such documents are submitted at trial if there is any question of the ownership of the property or of the value of the claim. Pla~ntiff is prepared to submit such documentation at the tin~ of trial. Moreover such documents were submitted at the underlying District Justice hearing in this matter. 3. Defendant also claims that the Plaintiff's pleading alleges no tortious conduct characterized as "malicious, wanton, reckless, willful or oppressive" as to justify Plaintiff's claim for punitive damages. Pursuant to Pa. R.C.P. Rule 1019 (b), "Malice, intent, knowledge and other conditions of mind may be averred generally.' The Plaintiff's pleading does state that the " Defendant... withouc plaintiff's permission, intentionally trespassed onto the Plaintiff's lot and injured the plantings.... The Plaintiff believes that this statement does aver generally the malicious, wanton, reckless, willful and oppressive actions of the Defendant. The question of whether Defendant's actions were of such a character as to warrant punitive damages is a matter of fact for the determination of the trier of fact. Plainti f f sincerely believes that Defendant intentionally trespassed on and defaced 3 Plaintiff's property, and that punitive damages are necessary to deter such action in the future.
