WHEREAS, Ronald and Susan Jones, of 24 Glenview Drive, Dillsburg, PA, is about to execute contemporaneously herewith, a contract with Pollard & Co., Inc., Contractor, of P.O. Box 66, Dillsburg, PA 17019, for the erection ora one story residential building upon a lot of land situate in Upper Allen Township, Cumberland County, more fully described in attached Exhibit "A". NOW, July 19, 2002, at the time and immediately before the execution of the principal contract, and before any authority has been given by the said Owner to the said Contractor to commence work on the said building, or purchase materials for the same in consideration of the making of the said comract with Owner and the further consideration of One Dollar to Contractor paid by Owner, it is agreed that no lien shall be filed against the building by the Contractor, or any mb-contractor, nor by any of the material men or workers or any other person for any labor, or materials purchased, or extra labor or materials purchased for the erection of said building, the right to file such liens being expressly waived. Contractor LEGAL DESCRIPTION ASHCOMBE FARMS, P.R.D., A PLANNED COMMUNITY PHASE 4 LOT No. 51 ALL THAT CERTAIN piece or parcel of land situated in Upper Allen Township, Cumberland County, Commonwealth of Pennsylvania, more particularly bounded and fully described as follows: BEGINNING at a point located on the western right-of-way line of Lobach Drive, Twenty~five Feet (25') from the centerline of the same and a front corner of lot No. 52. THENCE leaving said right-of-way and along the property line of said lot, South Seventy-one Degrees Twenty-four Minutes Twenty-one Seconds West a distance of One Hundred Thirty-nine and Zero Hundredths Feet (S 71"24'21" W - 139.00') to a point on the same, on the western edge line of a Twenty Feet (20') wide planting easement, on the eastern edge line of a Twenty Feet (20') wide stormwater easement, a rear corner of said lot and on the property tine of lands of Ashcombe Products Company. THENCE along said easements and the properly line of said lands, North Eighteen Degrees Thirty-five Minutes Thirty-nine Seconds West a distance of Eighty-two and Thirty-four Hundredths Feet {N 18°35'39'' W - 82.34') to a point on the same and a rear corner of lot No. 50. THENCE along said lot, North Seventy-one Degrees Twenty-four Minutes "twenty-one Seconds East a distance of One Hundred Thirty-nine and Zero Hundredths Feel (N 71 "24'21" E - 139.00') to a point on the same, a front corner of said lot and on the above noted right-of-way line. THENCE along said right-of-way, South Eighteen Degrees Thirty-five Minutes Thirty-nine Seconds East a distance of Eighty-two and Thirty-four Hundredths Feet (S 18°35'39" E - 82,34') to a point on the same, a front corner of lot No. 52 and the Point of Beginning. CONTAINING 11,445.54 Square Feet or 0.263 Acres.
