~. The Plaintiff submitted two ~nvotceg to the
Defendant for payment. Exhibitffi *1 & 2. At roo time after
receipt of the invoices did the Defendant contact the
Plaintiff and question any of the charges. Legislative ACT.
1994-7 states that if a contractor withholds payment for any
deficiency, the contractor Must notify th~ sub-contractor pf
the deficiency item within seven (7) calendar days of the
date that the invoice was received. At no time did the
Defendant notify the Plaintiff in writing or otherwise within
7 days of receipt of the invoices of any defiCiency.
6. The Plaintiff attempted to contact the Defendant
various times to obtain payment. When calls were placed to
the Oefendantu business and also his home, the Plaintiff
would speak to the Defendants wife leaving messages for the
Oefendant to call the Plaintiff. This never happened.
Consequently, thE! Plaintiff hied a complaint with the
District Justice and a Notic~ of Appeal was filed in the
Prothonotary office at the Cumberland County Court House.
To date, the Oefendant has never paid the Plaintiff any
monies towards this Job, knowing that the Plaintiff has had
to pay for all materials, fuel, insurance. paving contractor
to lay blacktop materials to complete this Job. Without the
