Dell, Sr., by and through his attorney Herschel Lock, files this Petition for Emergency Injunctive Relief to Prevent Relocation and avers as follows, 1. Plaintiff., Charles W. Dell, Sr., is the father of the subject minor children and currently resides at 320 W. Shady Lane, Apt. 2, Enola, Cumberland County, Pennsylvania 17025. 2. Defendants, Gerald Straining and Nancy Straining, the maternal grandparents of the subject minor children and currently reside at 725 Hogestown Road, Mechanicsburg, Cumberland County, Pennsylvania, 17055. 3. The parties are the father and maternal grandparents, respectively, of the minor children, Charles W. Dell, Jr. (age 10) and Tricia Y. Dell (age 12). 4. In 1990, after the death of Lena M. Dell, the mother of the subject minor children, the Perry County Court entered a Consent Custody Order granting Defendants primary physical custody of the subject minor children while granting Plaintiff reasonable periods of temporary custody with them, said Order being agreed to by Plaintiff with the understanding that the children would continue to live looally. A copy of said Petition is attached hereto.. Exhibit "A". 5. Plaintiff h.. been told by Defendant. that they intend to relocate with the children outside the jurisdiction of thie Court due to what Plaintiff believes to be a job traneter by Defendant Gerald Straining, and, mar, specifically, Defendants intend to move on or prior to November 15, 1994 with the eubject minor children to the Chicago, Illinoie area. 6. Such move would be contrary to the children's beet intereet inaemuch as it would effectively remove Plaintiff, their tather, from their lives and would be contrsry to his prima facia right of being the primary adult in their livee. 7. The move would seriously impair Plaintiff's ability to be an active parent of the children inasmuch as the geographical dietance between Cumberland County and Chicago i. euch that there would be minimal contact b~tween father and children. 8. Defendants intend to move the children despite this and without regard for Plaintiff's rights a. the father of the eubject minor children and the children'. need. to have a continuoue relationship with their one eurviving parent. 9. Defendants do not have valid baeis for the move. 10. Plaintiff has heretofore filed a Complaint for Cuetody .eeking custody of his children, this scheduled tor a Conciliation Conference on November 22, 1994. 11. Under Plowman v. Plowman, 409 Pa.
