notified Inviroclyne that a component of it. equip.ent had failed.
Inviroclyne advi.ed the plaintiff that the equip.ent wa. covered by
the warranty and it would fabricate the component and a.ked the
Plaintiff to in.tall replacement part. at .arket rate. for actual
ti.e expended plus out-Of-pocket expen.e.. The Plaintiff accepted

COMPLAINT
AND NOW, comes Plaintiff, The Milnes Co., Ino.
(hereinafter "Milnes") by and through its attorney and file. thh
Co.plaint
against
Envirodyne
systems,
Inc.
(hereinafter
"Envirodyne") as follows:
1. plaintiff is a Pennsylvania corporation with its
principal place of business located at 195 North BridgCll. Street,
Tunkhannock, Wyoming County, Pennsylvania.
2. Plaintiff is a Delaware corporation with its
principal place of business located at 50 Utley Drive, Camp Hill,
Cu.berland county, pennsylvania.
3. On or about June 1993, Envirodyne Systems, Inc.
issued a warranty to the Town of southeast, New York for its newly
installed aeration facility located in Brewster Heights, New York.
4. On or about March 28, 1994, Milnes entered into an
or.al contract with Envirodyne, whereby Milnes would repair or
replace the damaged brush aerator and perform any associated work
at the said facility (the "work").
5. Plaintiff completed the work at the said facility and
in accordance with the terms of the said contract on or about June
4, 1994.
6. The work hall been accepted by the .aid facility owner
and by Envirodyne.
7. The Plaintiff performed the work In the ordinary
oour.e of bu.ine.. and submitted its invoioe for payment, which has
been attached hereto as Exhibit A and incorporated herein by
reference.
8. The work was performed in a timely, good and
workmanlike fashion, and the amounts charged for the same were fair
and reasonable for the work and in conformity with the amounts
oharged by others for similar work in the area.
9. Despite demand, Defendant has failed and refused to
pay the out.tanding invoice.
10. The amount owed the Plaintiff as of the date ot this
complaint i. $4,629.35, which amount represents the amount shown on
the invoice les. New York Sales Tax of $122.00 previously charged
on the equipment, which is not required to be collected, and an
adjust.ent of $30.53 in profit and overhead due to the said
reduction.
WHEREFORE, Plaintiff requests this Honorable Court to
enter jUdCJlllent in its favor in the amount of $4,629.35 plus
interest, costs, attorney's fees and any further relief it dee.s
appropriate.
