COMPLAINT IN MORTGAGE FORECLOSURE
AND NOW, comes the Plaintiff by Its attorneys, Louis P. Vitti and Associates, P.c.
and Louis P. Vitti, Esquire, and pursuant to the Pennsylvania Rules of Civil Procedure
Numbers 1141 through 1150, for its Complaint in Mortgage Foreclosure, sets forth the
following:
1. The Plaintiff is a corporation duly authorized to conduct business within
the laws of the Commonwealth of Pennsylvania, having a principal place of business located
at 11200 W. Parkland Avenue, Milwaukee, WI 5324.
2. The Defendants are individuals residing at 337 Pitt Street, Enola, PA
17025.
3. On the 9th day of March, 1990, in consideration of a loan of Forty One
Thousand Six Hundred Twenty Three and 00/100 ($41,623.00) Dollars made by
Commonwealth Mortgage Co. of America, a Delaware corporation, to Defendants, the said
Defendants executed and delivered to Commonwealth Mortgage Co. of America, a
Delaware corporation, a "Note" secured by a Mortgage with the Defendants as mortgagors
and Commonwealth of Mortgage Co. of America, as mortgagee, which mortgage was
recorded on the 14th day of March, 1990, in the Office of the Recorder of Deeds of
Cumberland County, in Mortllalle Book Volume 969, page 235. The said mortllalle is
incorporated herein by reference.
4. The premises secured by the mortgage are:

said mortgage, that assignment being recorded in the Office of the Recorder of Deeds of
Cumberland County on the 21st day of May, 1990, in Mortgage Book Volume 380, page
981. The said assignment Is incorporated herein by reference.
6. Said mortgage provides, inter alia:
"AND PROVIDED ALSO, that when as soon as the principal
debt or sum hereby secured shall become due and payable as aforesaid, or
in case default shall be made in the payment of any Installment of principal
and interest, or any monthly pJyment herein above provided for, or in the
keeping and performance by the mortgagor of any of the terms, conditions or
covenants of the mortgage or note secured hereby, It shall and may be lawful
for said mortgagee forthwith to bring an Action of Mortgage Foreclosure, to
sue out a Writ of Scire Facias, or to institute other foreclosure proceedings
upon the mortgage, and to proceed to judgment and execution for recovery
of said principal debt, all interest thereon, all sums advanced for payment of
any ground rent, taxes, water rents, charges, claims or insurance premiums as
aforesaid, and all other recoverable sums, together with an attorney's
commission for collection, without further stay of execution or other process
any law, usage or custom to the contrary notwithstanding. The mortgagor
hereby waives and relinquishes unto and in favor of the mortgagee, all
benefits under the laws now in effect or hereafter passed to relieve the
mortgagor in any manner, or to reduce the amount of the note to any greater
extent than the amount actually paid for the premises hereby mortgaged at the
sale thereof in any judicial proceedings upon the said note or upon this
mortgage."
7. Since February 1, 1994. the mortgage has been in default by reason, inter
alia, of the failure of the mortgagor to make payments provided for in the said mortgage
(including principal and interest) and, under the terms of the mortgage, the entire principal
sum is due and payable.
8. In accordance with the appropriate Pennsylvania Acts of Assembly and the
Pennsylvania Rules of Civil Procedure, the mortgagor has been advised in writing of the
mortgagees intention to foreclose. The appropriate time period has elapsed since the Notice
