Petitioner wu convicted of one count each of rockl... driving and fleeing
or attempting to elude police on July 15, 1994, before Franklin County Dlatrlct
JUltlce Gary L. Carter. (Com. Ex.. 8. 7.) On Auguat 4, 1994, petitioner wu
notified by mall that the Pennaylvanla Department of Transportation (DOT) had
Impoaed a t1x month llcen.. suspension for the reckle.. driving conviction and a
five year "habitual offender" license revocation for the fleeing conviction. (Com.
Ex.. 8, 7.) Next, on Auguat 12, 1994, petitioner was convicted of the eecond
count. of each of the above-stated offen..s before Franklin County Dlatrlct Juatlce
Larry K. Memlnger. (Com. EXI. 1, 3.) Another official notice wu mailed to
petitioner on September 14, 1994, advlllng him that two additional two-year
period. of license suspension had been Impoled for the lecond conviction. for
eac:h violation. (Com. Exs. 1. 3.)
Petitioner subsequently petitioned to let aside his llcen.. suspenllon and
a hearing wu held before this court on December 5. 1994. Petitioner arguel that
the five year revocation of his llcen.. al a "habitual offender" II well II the
Imposition of the two additional two-year license revocation periods were .rronee",

DISCUSSION

five year period, he Is subject to an additional two year revocation period under the

Pennsylvania Vehicle Code provide as follows:

(a) O.neral Aule.- The department shall revoke the
operating privilege of any person found to be a
habitual offender pursuant to the provisions of this
section. A 'habitual offender" shall be any person
who.e driving record. as maintained In the department,
shows that such perlon has accumulated the requlllte
number of convictions for the "perlte and distinct
offen.es described and enumerated In subsection (b)
committed after the effective date of this title and
within any period of five years thereafter.

The first Issue In the Instant case Is whether the Petitioner has been
convicted of three separate offenses within five years to give rl88 to hi. status 88
a habitual offender.
Petitioners certified driving record reveals that his first offense was a driving
under the Influence charge which occurred on June 16, 1993. (Com. Ex. 12.)
Petitioner agreed to be placed on the accelerated rehabilitative disposition program
(ARO), and notice of a one month llcen.e suspension was mailed to petitioner on
October 22, 1993. (Com. lEx.. 10, 11). Although ARO I. not a conviction, It Ie
t....ted .. .uc:h pursuant to Section 1542(c) of the Vehicle Code. ~

Pennsylvania courts have consistently held that a single factual epllOde can
re.uIt In multiple convictions, which can result In a motorist being adJudged a
habitual offender. 125
Pa. Commonwealth Ct. 256, 557 A.d 82. 63, ~. 571 A.2d 385
(1989). However, the Bgu court also noted: "although all thr.. Code vloIatlona
may be committed In combination In the course of one general factual epllode, the
driver muat allO have done three completely different Improper thlnge which led to
thole Code violation In order to be considered a habitual offender." UL at 258-59,
557 A.2d at 83. The Bgu court then held that driving without Ilghtl to avoid
~ectlon by pollee and fleeing or eluding police are separate actl. even though
they occurred durtng the aame tactual epl.ode of one night. ld.
The record In the Instant caee, like that In Bgu, reve"l that petitioner haI
commIt1ed two ..parat. act. .. reckle.. drMng and fleeing or attempting to elude
police. That petitioner committed the.. offenael within a narrow time frame on the
IMII day I. Irrelevant. M .udl, the.. chargel count II the lecond and third

M noted above, the Vehicle Code mandates that a perlon who hae
committed an additional offense within the five year period that gives rI.. to
habitual offender etatus will be subject to a two year revocation of operating
prlvlleg... 11542(e); See AIJg, pym8~ at 203,579 A.2d at 1382. Penneylvanla
law Ie clear that "a fourth offense committed at amtJI.ml within the same five year
period, whether or not preceded by prior convlctlone on the other vloIatlona,
lubJecte one to a supplemental two-year revocation of operating privileges." fool

However, Pennsylvania courts have consistently held that two conviction.

In the present C818, petitioner was cited for one count of each violation In
two separate municipalities. Consequently, the second counts of the fleeing or
attempting to elude police and reckless driving violations In the Instant cue are
viewed as entirely separate from the flrst counts. As Petitioner has been convicted
of a fourth and flfth offense beyond the three counted for habitual offender Itatu.,
two additional two-year revocation periods are warranted.
In sum, DOT has adequately satlsfled Its burden that It had correctly
Impoltd a flve year license revocation based on Its determination that Petitioner
was a habitual offender. The two additional two-year revocation periods were also
warranted because Petitioner's convictions for the events of June 25, 1994, aro.e
from separate acts. Consequently, Petitioner's license Is revoked until March 8,
2004. Although we realize this penalty Is harsh, we have no discretion In the matter
and are obliged to afflrm the actions of DOT.
