5. Pllinliff incorporates herein by reference paragraphs 1.4 of its complaint as though the
same were set forth at lenglh.
6. On or about October 16, 1989, plaintiff and defendant Milano's Inc, entered into a written
Igreemenl whereby plaintiff was to sell and deliver various food products to the defendanl
Milano's Inc. A true and correct copy of this credit agreement is auached herelo and
incorporatell as Exhibit A.
7. From July 9, 1992 until November 19, 1992, plaintiff made deliveries to detimdant
Milano's Inc. pursuant to the agreement and an open account. Copies of the book account are
attached herelo and incorporated as Exhibit 8.
8. Pursuanl 10 Ihe credit agreement, payments were to be made within thirty (30) days of a
delivery, and pursuant to the a8reement of the parties, a monlhly charge of one and one-half
percent (I 1/2%) would be added to all sums unpaid for forty (40) days and defendants would
be required to pay all collection costs including a reasonable attomey's fee,
9. Pursuanllo the trade and custom of the industry, this monthly charge is fair and
reasonable.
10. Milano's Inc. accepted each delivery when its officers, employees or agents affixed a
signature to the delivery slips.
II. Milano's Inc., at the time of a delivery would 'llake a paymenl as indicated by a notation
at the boUom of each invoice, however the amount of the payment would be applied to the
oldest outstandinll prior balance. The application of these payments is indicated on the
aforementioned copies of book account, marked Exhibit B and incorporated herein, The
outstanding balance after credit for payments that had been made is forty nine thousand one
hundred sixty seven dollars and six cents ($49, 167.06).
12. Although plaintiff has requested that defendant Milano's Inc. pay Ihe sum represenled by
the accounts on numerous occasions, defendant has failed to pay that sum or any part of that
sum, all to plaintiffs damage.
13. Plaintiff has performed all conditions precedent and all obligations pursuant to the
agreement of the parties.
14. Defendant, Milano's Inc. is in breach of the agreement belween the parties by failing 10
make payments when due and owin!!.

to wit: Milano'. Inc. t/. Milano'. Pi.Ba , SubB, but was unable to locate
them in his bailiwick. He therefore returns the within Complaint in Civil
Action Law and Notice to Deftmd as "NOI' FOUND," as to the within named
defendant Milano's Inc., tla Milano's Pizza & Subs. Milano's is out of
business and left no forwarding address with the Post Office.

TO THE HONORABLE, THE JUDGES OF SAID COURT:
AND NOW, comes petitioner, Richard JehU (hereinafter
"Petitioner"), by and through his attorney., cunningham ,
Chernicoff, P.C., and files his petition to strike or, In the
Alternative, open Judgment, and in support thereof, avers the
following:
1. PETI~ION TO STRIKE JUDGMENT
1. On May 8, 1996, plaintiff filed a Praecipe for Entry
of Default Judgment against Defendants Milano'., Inc., t/a
Milano'S pizza and Subs, Richard Jehu and Gerald W. Lesher.
A copy of said Praecipe ill attached hereto and lIIarked ..
Exhibit "A".
"Respondent"). A. a result of the filing of such 1\JIIendment,
any claim of Respondent against Petitioner is properly
.cheduled in the Petitioner's Chapter 7 bankruptcy proceeding.
7. Rule l009(a) of the Bankruptcy Rule. provides for a
general right to amend on the part of the Debtor with respect
to schedules or the Petition, and the Schedules may be amended
by the Debtor as a matter of course at any time before the
case is closed.
8. Respondent's counsel was made fully aware of the
pendency of Petitioner'S bankruptcy case when the Amendment
was filed on April 17, 1996 by virtue of the fact that
Respondent'. counsel was served with a copy of the Amendment
on April 17, 1996.
9. Respondent's counsel was fu:t'ther advi.ed of
Petitioner'S bankruptcy status by letter dated May 1, 1996
which was sent by telefax to Respondent'. counsel from
Petitioner's counsel which once again put Respondent on notice
of Petitioner's pending bankruptcy and the fact that any
attempt to enter a judgment would violate the Discharge Order
entered by the Bankruptcy Court. A copy of Petitioner'S

Milano'. to Respondent which were incurred durinq
the p.riod of time between s.ptember, 1992 and
November, 1992, a period of time after Petitioner
withdrew from the corporation.
d. Respondent was fully aware of Petitioner'.
withdrawal from the corporation, Milano '.. As
further evidence of Respondent's awareness of
petitioner's withdrawal from Milano's, it should be
noted that a purported and proposed Agreement for
Accord and Satisfaction with r.spect to the claims
of Respondent against Milano's provides for
execution only in the name of Milano's and Co-
Defendant Gerald W. Lesher, Jr. ("Lesher"). Mr.
Lesher was the remaining shareholder of Milano'..
A true and correct copy of the Agr..ment i.
attached hereto as Exhibit "C" and made a part
hereof.
e. Further, correspondence from R.spondent
dated December 30, 1992, which has been alleged by
.
the coun.el for Re.pondent to be notice to
petitioner that p.titioner had pot.ntial liability
to R.spond.nt is, in fact, only addr....d to Co-
Defendant Lesher. A true and correct copy of the

letter of December 30, 1992 i. attached hereto a.
Exhibit liD" and made a part hereof.
f. Additional evidence that Respondent i. not
liable to Respondent and Respondent'. awarene.. of
.uch fact is the fact that the .tAtement attached
a. an exhibit to Respondent's Complaint lists only
Milano's and Lesher's name and does not li.t
Petitioner'. name. Such .tatement is dated January
26, 1993. A true and correct copy of such
statement is attached hereto as Exhibit "E" and
made a part hereot.
g. FOllowing the service upon Petitioner of
the Complaint set forth above, Petitioner took
steps through his bankruptcy coun.el to cause an
Amendment to be filed with respect to Respondent.
As set forth above, such Amendment was filed on
April 17, 1996.
h. On May 1, 1996, Petitioner, by and through
hi. counsel, again notified Respondent's counsel of
his pending bankruptcy which was sent by telefax.
Petitioner's counsel's letter notified Respondent's
counRel of Petiti~ner's pending bankruptcy and the
fact that any attempt to enter a judgment would
