1. Said premises are leased for a term of one (1) year,
beginning the first of Kay 1992 and ending the last day of April
1993 upon the covenants and conditions hereinafter set forth.
Successive one-year terms are provided for hereinafter.

leased premises during the initial one-year term of this lease
the total sum of Six Thousand and no/100 ($6.000,00) Dollars.
payable in monthly installments of Five Hundred and no/100
($500.00) Dollars per month, with the first payment due on the

term of this lease. A security deposit in the amount of Five

time. If lessee does not make the rental payment by the 15th of

3. At the expiration of the initial term specified in this
lease, said lease shall automatically renew for periods of one
(1) year thereafter, for the succeeding five (5) years, upon the
same terms and conditions as herein contained, except that the
monthly rental shall increase by five percent (5S) during each
year of renewal, unless within thirty (30) days prior to the
expiration of such original or any give one-yedr succeeding tarm.
Lessee shall serve upon the lessor a notice in writing stating
its intention not to renew this lease for the next year. By way
of example. the yearly rent for the second year would be Six
Thousand Three Hundred and no/lOa ($6,300.00) Dollarsj by way of
further example, the yearly rent for the third year would be Six
Thousand Six Hundred Fifteen and no/l00 ($6.615.00) Dollars.
4. In the event Lessor or lessor's heir(s) or devisee(s)
Shall decide to transfer the demised premises during the original
or succeeding terms of this lease, and provided lessee is not 1n
default hereunder. lessee shall have a right of first refusal to
obtain the premises upon the same terms and conditions offered

plainliffs to remove said truh, debris, junked automobile parts and abandoned automobiles, all at
an expense which would have been unnecessary had defendant simply complied with the tenn5 of
the lease asreement.

A landlord desirous of repossessinll real property from a tenant
may notify. In writing, the lenant to remove from the same at the
expiration of the time specified In the notice under the following
circumstances, namely, (I) Upon the termination of a term of the
tenant, (2) or upon forfeiture of the lease for breach of its conditions,
(3) or upon the failure of the tenant. upon demand, to satisfy any rent
reserved and due.
In case of the expiration of a term or of a forfeiture for breach of
the conditions of the lease where the lease Is for any term of less than
one year or for an Indeterminate time, the notice shall specify that
the tenant shall remove WIthin thirty days from the date of service
thereof, and when the lease is for one year or more. then within three
months from the date of service thereof, In case of failure of the
tenant, upon demand, to satisfy any rent reserved and due, the
notice. If given on or after April first and before September first. shall
specify that the tenant shall remove within fifteen days from the date
of the service thereof. and if given on or after September first and
before April first, then within thirty days from thr. date of the service
thereof,
In case of termination due to the provisions of section 50S-A, I the
r<lliee shall specify that the tenant shall remove within fifteen days
from the date 01 service Ihereof,
The notice above provided for may be for a lesser time or may be
waived by the tenant if the lease so provides.
The notice provided for in this section may be served personally on
the tenant, or by leaving the same at the principal building upon the
premises. or by posting the same conspicuously on the leased premis-
es.

4. Having received no reply to the complaint by November 30, 1994, plaintiffs'
counsel mailed to defendanls and defendants' lIttomey an additional ten day notice to respond to
the complaint
S. Finally, on December 8, 1994, defendant's counsel filed preliminary objections to
lhe complaint in a further effort to extend the time in which defendants may continue to occupy
the premises without the payment of rent and in continuing violation of the various provisions of
the panies' lease.
6. Since OctobClr 19, 1994, defendants have paid no additional slims into Cau" for
the paymenl of rent for the months of September, October, November or December. In addition,
plaintiffs have received no rental payments for the premises since prior to the district justice
hearing.
7. Defendants have continued in possession of the premise., are continuing to caus,
