AND NOW comes Handler and Wiener, attorneys for Sandra Ann
Barasch, Defendant, and aver as follows:
1. Attorney Leslie B. Handler and the law firm of Handler and
Wiener was retained by Defendant to defend her in the above-captioned
suit wherein plaintiff sought a mandatory injunction ordering
defendant to remove certain fences erected in violation of the Point
Ridge Farm covenants. The prayer of the suit also asked for monetary
award in favor of plaintiffs in excess of Twenty Thousand Dollars
($20,000.00) .
2. Petitioner filed an answer to the suit and also filed
answers to discovery requests of plaintiffs ae well as filing certain
discovery requests upon plaintiffs on behalf of defendant.
3. Under date of June 13, 1995, defendant sent said Leslie B.
Handler a letter which, on the first page, she said that she was
advising that she "no longer want or need your legal services" and
accused Leslie B. Handler of dragging out the case in which letter she
said clearly she had no intention of paying in full the bill
submitted. A copy of the June 13, 1995 letter, consisting of eleven
(11) pages, is not being attached because of the possibility that its
revelation to plaintiffs might prejudice defendant.
4. Under date of June 19, 1995, said Leslie B. Handler for the
firm of Handler and Wiener responded to the June 13, 1995 eleven (11)

page letter and pointed out to her Rule 1012(b) of the Pennsylvania
Rule. of Civil Procedure which provides that an attorney's appearance
may not be withdrawn without leave of court unless another attorney
enters his appearance and in said letter she was given three (3) week.
after the date of said letter to obtain another attorney to enter hi.
appearance in the matter. A copy of the said letter dated June 19,
1995 is attached hereto as Exhibit "1".
5. Petitioner Leslie B. Handler believes that defendant is
operating under the illusion that this case is over and that the law
firm of Handler and Wiener will not sue her for the monies owed which,
through June 19, 1995, amount to $1,970.20.
6. petitioners believe that there will be no delay in any stage
of the litigation by virtue of the change of attorneys because there
i8 no compulsion upon defendant to do anything until such time as
plaintiffs comply with the discovery requests that have been directed
to them.
WHEREFORE, the law firm of Handler and Wiener prays that a Rule
be entered, upon plaintiffs and upon defendant, to show cause if
either has any, why the appearance of Handler and Wiener as counsel
for defendant should not be withdrawn.
And petitioner shall ever pray.

11. Upon ob.ervinq in early September that Defendant intended
to erect a fence, Plaintiff. notified Defendant in writing that
they would object to the erection of any fence in exce.. of three

In the event you proceed notwithstanding this warning. In that connection, pleue note
the following:
1. I walked the "property line" this morning and noticed that there were no
visible "plna" from a survey. In fact, your fence contractor conftnned to me that he was
not aware whether a survey had been done. Instead, he indicated to me that you had told
him that the tree trunks are "on the property line". While I also have not had a survey
performed. I happen to believe that you are incomct in your supposition that the tree
trunks mark the boundary between the properties, and it is incredibly recldess for you to
proceed with such an important undertaking as this without fint obtaining a survey to
determine the boundary line. Understand that you do IKlI haft my pernIHlQ,\ to erect the
. f'mI:e wblch in any man...,. encroac:hes on my prot'"'&li. If you erect this fence and I
subsequently obtain a survey that shows that the fence is on my property, I :will seek a
court's order maldng you take the fence down iIIsl compensating me for damages done to
my property and pine trees.
2. Based upon the size of the holes I saw this morning, it appears that you
Intend to erect a fairly large, substantial fence. That suggests to me that you are not aware
of the covenant in the deed to the properties in Point Ridge which reads III follows:
"N. No fences extending more than three and one.half (3 1/2) feet
in height shall be erected or maintained on any lot, except that trees, hedges
and shrubs may be planted on any lot."
I brought this restrictive covenant to the attention of your contractor, who indicated that
you had not spoken to him about it. I would urge you to locate and read aU of the
restrictive covenants for younelf. They are located in the Cumberland County Recorder
01 Deeds OffIce at Deed Book No. 181. Page 1046, with restriction "N" being found on page
1050. Inasmuch as your property is on a hill that is several feet higher than my property
to begin with, I will vigorously enforce the 3 112 foot restriction since I believe that a six
foot fence, built on top of a four foot "natural" indine, would look somethin,like the
outlleld fence in Penway Park, an architectural style which I am sure would be unwelcome
In Point Ridge.
Having advised you of the foregoing, please be dear about one thinJ: I recopbe

I believe It will provide me with greater privacy and it win muffle the sound of your air

understanding that she had not yet engaged counsel despite my urging her to do so. Of
course, notwithstanding my caution, you must realize that, as a party in interest, I have
every right to deal directly with another party even if that party is represented by counsel.
with respect to your allegations concerning "someone's" conversation with Chris
SeUers, your chuacterization is cute but inaccurate and legally without foundation. I did
speak with Chris Sellers at approximately 10:00 P.M. on Wednesday, September 21,1994.
Chris and I had spoken on September 2 and he had given me his business card and
volunteered that I should call him if 1 had any questions, I was prompted to call him (for
the first time) on September 21 because my wife had noticed that a new "string" had been
erected as a "guide" for putting in a fence, and 1 was curious whether Sandy was going to
proceed to erect a fence even though 1 had not yet heard from her or an attorney
concerning the height restriction. He confinned that she was going to do so.
In my call with Chris, which lasted about 15 minutes, 1 advised him that I would not
in any way hinder him or ev~n approach him if he began construction; 1 told him that I
had warned Sandy in one conversation and in three letters concerning the height
restriction, that she also was on notice about the restriction as a result of her conversations
with the President of the Point Ridge Farm Civic A1sociation, and that 1 no longer had time
to deal with "daily developments" in this matter. 1 told him that it was my intention to
brinJ . lawsuit as soon as t~e fence was erected for the purpose of having it removed.
That continues to be my position. I was clear with Chris that I did not have a "beef" with
him and that I understood that he was simply doing what he was told to do. However, I
did advise him that he could be dragged into a lawsuit if a court detennined that he was
an "indispensable party" because he had actually erected the fence; in any event. he
certainly would be a witness. I did not tell him that to scare him; to the contrary. we had
a very cordial conversation, and I advised him that he might want to get a letter of release
and Indemnification from Sandy before proceeding so that he would not be "out of pocket"
any money in the event he became embroiled in a subsequent dispute. 1 also urged him
to consult with his own attorney.
Under the circumstances I have outlined, 1 can see no problem with my conversation
with Mr. SeUers. I am very curious about the basis for your claim that such a call is
"unethical", and considering the outrageous actions your client has taken during the time
period in which I have been trying to work this out with her, I think that your lecture on
.common sense and decency" is misdirected. In any event, I have a considerable problem
with your tactic of making a vague charge of "unethical behavior" against me and then
pubJishin, II (by carboll copy) to Mr. Sellers.

Finally, I look forward to our conversation this afternoon. I would very much like
to hear the basis for your advice to Sandy (who, by the way, has been the sole owner of
the property in question since 1991) thllt she is allowed to erect a fence "usu IQ excee4 six
feet in height". If you are relying on the Township's zoning ordinance, then you should
be aware that the Township actually allows side-yard and back-yard fences in excess gf six
feet in height provided that certain olher conditions are met. (Fences which extend beyond
the front of one's house, however, which Sandy's proposed fence will, are restricted llx 1ha
ImmlbiR to three and one.half feet.) If you are relying on the very clear language in the
Point Ridge Farm deed restrictions, then I apparently have been missing something in my
RlIdlng and interpretation of that same language.
I am enclosing copies of all three letters which I have written to your client(s) since
this matter arose on the Friday before Labor Day. In addition to my offer to discuss this
matter contained in my last letter, you should know that I have been trying to get Sandy
to discuss this matter reasonably since the Friday before Labor Day. In our face-to.face
conversation on September 2, I went so far as to offer to share the cost of a fence if we
could jointly agree on the height and material composition of the fence. Her reaction was
simply "I don't need your permission to do what I want to do". Since that time, her actions
have shown her to be at best irrational. If you have not yet seen what she has done to
several 2S.year old, healthy, beautiful white pine trees, then I would invite you to visit the
property and judge her reasonableness for yourself. The very contractor who. at her
direction, actually cut down four of these trees lasl Monday said it made him "sick".
One last note, with respect to the postscript in your letter: be advised that neither
I nor my wife have any interest in spending any amount of time on, or in doing any
damage to, your client's property, conlrary to the reckless allegations your client made to
Officer Shaunessy (and perhaps others) last Friday evening. (I should add that your
publicadon of this unsubstantiated and untrue charge 10 Mr. Sellers was no less reckless.)
My wife and I spent an hour and a half at the Hampden Township Police Department
Friday night telling the pollee our side of the SIOry (after being alerted at by friendly
neighbor about the police visit). You should be aware of the following:
1. My wife (who also is an attorney) and I were both out of town
at hearings and arbitration~ on Thursday during the day and at separate
evening dinner meetings Thursday evening. We were not home until after
10:30 P.M. When I learned from the police on Friday night Ihat "holes had
been filled in", I mislakenly assumed that Ihe police officer was referring to
the holes which had been dug on September 1; neither my wife nor I even
knew that new holes had been dug the prior day! In fact, the police officer

observed to us that his visual inspection led him to conclude that Thursday's
torrential rains likely were the cause of the holes seeming to be "refilled".
2. Your client's allegations are extremely troubling in a very
different way. A number of this finn's clients live in Point Ridge Farms. I
have been advised by several friends who live in the neighborhood, as well
u by the llresident of the Point Ridge Fanns Civic Association and by Officer
Shaunessy, that Sandy has been talking to DWlY people in the neighborhood
in her attempts to enlist support for her cause and to "turn the neighborhood
against us". In most of her conversations, I have been told that Sandy has
told people that my wife and I are being SOBs because "we are both
attorneys and think we can intimidate her. She then goes on to tell these
people that we have been writing "horrible," "vile," and "nasty" threatening
letters to her. The people who have told me this have been surprised when
I have shown them copies of the actual letters; to a person (including the
pollce officer), they have said that the letters are nothing like what Sandy
sald they were. I am sure that you are aware that disparaging remarks made
about someone, and involving their livelihood, are defamatory W K. and II
Sandy does not cease talking to neighbors, my friends among them, about
this matter in any but a truthful way, I will have no choice but to clear my
name in the neighborhood by bringing an action against her for defamation.
If this letter sounds angry, it is because I am absolutely outraged by this mess. I
have tried unsuccessfully to reason with your client and to be a good neighbor. My wife
and I get along with all of the other families in the neighborhood who know us, and this
problem with your clients is particularly sU11'rising inasmuch as before September 2 I had
never even met Ethel Barasch in the over three years that [ have lived in the house.
Neither my wife nor I are even at home 80% of every week! I am not a litigious person,
I don't make a habit of telling people in out.of.work sellings that I am an attorney. and I
have never sued anyone or been sued, but Sandy has pushed me to the absolute brink.
I would be happy to try to work out an amicable resolution with you, but I am
through wuting my breath and energy talking to her, and I will take my cue to the
Cumberland County Court if she proceeds in erecting a fence in excess of three and one.

the dispute I have been havinq with your client; if nothing el.e,

I understand your position that your client "sometimee li.tens

hope that you will at least try to convince her that this is a
matter that would be best resolved throuqh dialOCJUe and
neqotiation. In partiCUlar, my understanding is that your advice
to h.r and Mr. Sell.rs concerning the heiqht r.striction was based
upon h.r representation to you that (a) the deed re.triction had
been a.ended and (b) others in the neighborhood have erected fence.

which they pleaded in paragraph 12. Although the pleaded covenant
indicates that no fences extending more than three and one-half (3
1/2) feet be erected or maintained on any lot, in the general area
in which plaintiffs and Defendant reside, there are fences in
excess of said three and one-half (3 1/2) feet and, in fact, the
restriction is virtually unenforceable. Also, as set forth in
Defendant's Exhibit "1", t.here is an exception generally considered
applicable to the whole area, even in the absence of any building
committge.
14. paragraph 14 is neither admitted or denied, and to the
extent relevant proof thereof is demanded. Further, Defendant
denies that she has erected on her property anything that
interferes with the natural beauty of the properties or reduces the
value of investments made by purchasers of building sites therein.
15. Paragraph 15 is denied as stated. Although there is a
reference in Defendant's peed to "restrictions, easements and
conditions of prior record," same is not spelled out in her Deed.
Further, the fence that Defendant has constructed measures only
three and one-half (3 1/2) feet from the roadway to a point
opposite the house of plaintiffs and the house of Defendant at
which time it does rise to rea~h six (6) feet in height. The said
fence is erected entirely on land of Defendant and parallels the
boundary line between properties of plaintiff and Defendant.
16. Denied. The subject fence does not encroach upon the
land of Plaintiffs, but is entirely within the property line of

Defendant. Plaintiffs are correct that the portion of the fence
that is only three and one-half (3 1/2) feet in height, was
constructed to conform to the requirements of the Hampden Township
zoning Ordinance.
17. Denied. While it is true that Plaintiffs' yard bordering
the property of Defendant is lower t.han Defendant's side yard,
placement of the fence, which is located entirely on the land of
Defendant, does not cause the actual height of the barrier between
the houses to exceed eight (8) feet in height and alternately, if
it does, this is not a problem created by Defendant but by nature.
18. Admitted. However, Plaintiffs are guilty of latches in
allowing Defendant proceed to erect the fence completely, instead
of taking legal action until after the fence was completely
erected.
19. Denied. Part of the fence is only three and one-half (3
1/2) feet and the part, back from the roadway, that exceeds that
does not violate the PRF Covenants, which simply are not
enforceable any more by virtue of other fences going to six (~)
feet. In one case in the general area, it is even nine (9) feet.
20. Denied. The fence erected by Defendant is not an
improper use of Defendant's property. A fence does not depreciate
the value of the property of Plaintiffs. Further, it is denied
that the structure was built of poor materials, denied that there
are no adequate free spaces between Plaintiffs' and Defendant' s

premiseB, and it is denied that the fence is of a type or quality
objectionable to the PRF Covenants.
21. Denied. Prior to the erection of the fence, a
restriction between Plaintiffs and Defendant, the properties were
not naturally divided by approximately ten (10) white pine trees.
Instead, as a result of a survey that Defendant had because of the
aggravation caused by Plaintiffs, Defendant discovered that three
(3) of the trees were wholly on her land, and a fourth (1/4) was
partly on her land and partly on the land of Plaintiffs. Acting
pursuant to her lawful rights, Defendant cut down the three (3)
pine trees that were within her property line, and to the extent of
a fourth (4th) tree hung over her property, Defendant exex'cised her
rights under the Pennsylvania self -help do<::trine to trim the fourth
(4th) tree.
22. Denied as stated. The prior owner of Defendant,' s
premises was her mother who is still living there and she did
refrain from ex'ecting any fence. It i9 denied,. to the extent
implied, that the fence detracts from the natural beauty of the
premises, or otherwise depreciates the value of the premises of
Plaintiffs. Also, Defendant was provoked into erecting the fence
in an effort to k.eep off her land the animals kept by Plaintiff,
which animals Plaintiffs allowed to roam over to the property of
Defendant.

23. It is admitted that the owners of the houses immediately
to the west have not erected any fence. If there is any further
relevancy to that fact, proof thereof is demanded.
24. Denied as stated. It is agreed that Plaintiffs have a
right to prevent haphazard and inharmonious improvement of building
sites, and it is admitted that they have a right to retain the
natural beauty of their property. It is denied that Defendant has
interfered with the rights of Plaintiffs. It is denied that
Defendant has interfered with any "free spaces" of Plaintiffs. It
is denied that the solid board fence which Defendant has caused to
be erected is inharmonious with the properties. It is denied that
same has destroyed the natural beauty of the, property of
Plaintiffs. It is denied that same has caused the property of
Plaintiffs to be greatly depreciated in market value.
25. Denied. The fence was erected by Defendant in part to
keep out the dog and the cat of Plaintiffs, not for any malicious
motives. Additionally, it is averred that the cat has been able to
surmount the three and one-half (3 1/2) foot fence and come onto
the property of Defendant as is well known to Plaintiffs. It is
admitted that Defendant's main residence is in Manhattan, but in
fact, Defendant has lived the last year on the subject property and
her mother is not in an infirm condition, though she may spend
little time in the yard. Defendant is not aware of the
significance of the allegat.ions pertaining to her living or not
living in Pennsylvania, to the visibility of the fence from inside

the house, and to the visibility of the fence when entering the
driveway of plaintiffs and denies that the fence looms ominously
over the patio and screened-in porch of Plaintiffs.
26. Denied. It is denied that the fence has prevented
Plaintiffs from the enjoyment of their property by excluding light,
air and the view to adj oining properties. It is denied that
Plaintiffs are entitled to any legal enjoinment by virtue of the
common law and the PRF Covenants for the reason that the covenant
restrictions of three and one-half (3 1/2) feet has not been
observed in this area.
27. Denied.' It is denied that Defendant, to the detriment
and injury of Plaintiffs, has breached the PRF Covenants. Instead,
Defendant has exercised her legal rights, including the building of
the fence wholly within her property line. Further, it is averred
that Plaintiff has been informed, believes and therefore avers that
the covenant of three an1 one-half (3 1/2) feet only is not
observed and is not enforced in the neighborhood.
28. Denied. It is denied that Plaintiffs have suffered
injury and damage as a result of Defendant's actions. Further, it
is averred that Plaintiff has been informed, believes and therefore
avers that the covenant of three and one-half (3 1/2) feet only is

31. Denied. On the contrary, Plaintiffs never made any threats regll1'Cling the

prior to the erection of the fence, Plaintiffs warned Defendant that they would seek to
