A. Section PM. 100. I of.lid code is amended and shall read as follows:
PM. IOU Tld.: These relulalions shall be known as the "Propeny Maintenmce Code of
Upper Allen Township," also referred to herein as "this code."
B. Section PM. 102.2 of said code i. amended and shall read as follows:
PM.I02.2 Other flIIUIadODl: When the provisions herein specified are more restrictive
than .peciflcations or requirements of other resulalions or ordinU1ces, this code shall
control; but in my case, the strictest requirements of either this code or other resulalions or
ordinance. .hall apply whenever a difference exists. Violalion of such other reaulalion or
ordinance shaU be considered a violation of this code and, at the option of the lOwnship,
the enforce_nt provisions (includin. penalties and fines) of this code applied in lieu of
enforcement provisions, if my, provided for in such other reau1ation or ordinance.
NotWithstandinl the above, this code shall not control if this code is identified by name
and its applicatiOll is expressly restricted by such other ordinance or relulalion, by
provisions referenced in such other ordinmce or reaulation or by provision of this code or

Every IIc_ hereunder shall constantly maintain the licensed premises in the manner
hereinafter prescribed:
A. Such premises .hall aI all times be maintained so as nol to conslitute a nuisance or a
meDllCe 10 the health and welfare of the community or to residents nearby or a place for the
brciedinl of rodents and vermin.
B. No .arbqe or other orlanlc wute shall be stored on such premise..
C. The manner of storllSe and amnlement of junk and the drainqe facilities of the premises
shall be such u 10 prevent the accumulation of .tqnant water upon the licensed land and
10 facilitate access for inspection purpoaes and fire Il.htinl.
D. No junk shaU be slOred or accunwlated nor shall any structure be erected within twenty-
five (:1") feet of the side and rear lines of the licensed premises nor within seventy-five (75)
feet of any ellistinl dwellin, house erected upon premises adjacenl 10 the licensed
premises. nor shall any junk be slOred or accunwlated or any StruC1Ure be erected thai is
used in cOllllCCtion with said junkyard within fony (40) feet of that line of the licensed
premises abuninl a public street or hi.hway within the Township of Upper Allen, provided
thai In cases where two (2) or more lines of the licensed premises abut public streetS or
hiahways within the IOwnship. one (1) line only of such premise. shall be lovemed by the
above-provided setback of fony (40) feet, provided that nothinl contained in this
subsection shall apply 10 e:liistinl structures penainin, 10 and beinl used in connection
with junkyards presently established and operatinl'
E. Every structure crcc:ted upon the licensed premises and used in connection therewith shall
be of fireproof CORllNction.
P. The premises shall be enc10eed by .. metal chain link fence constructed of load heavy-duty
steel and supported upon steel posts or, in lieu thereof, a solid masonry or metal wall of a
unifonn desisn, tellture and structure. The erection of such fence or wall shall be
~ontrolled by \he setback provisions of Subsection D hereof. Such fence or wall shall nol
be leu than Sill (6) feel in heilht, nor shall two (2) or more vehicles or major parts thereof
be stacked on lOp of one another or otherwise as 10 protrude above it. The erection of said
fence shall be completed within twelve (12) months after the effective date of this chapter.
If, in the sole and ellcluaive opinion of a majority of the Township Board of
Commissioners. it shOllld appear thai the owner and/or operalOr of a junkyard situate
within the IOwnship have clearly demonstrated thai they are makinl a continuin. bona fide
effon 10 comply with the fencinl provisions of this subsection, lhen and in such event the
Board may, in its sole discretion. ,rant an elltension of time 10 such owner or operator of a
junltyard for lhe completion of the erection of said fence, upon receipt of a written teller
from said jullkyard owner or operator requestin, such m elltension of time. It is funher
provided thai the fon.oin. fencin. provisions shall be applicable only 10 that portion 01
