WHEREAS, JACKSON FAMILY PARTNERSHIP, a Pennsylvania general
partnership, Owner of the approximate 2.38 tract of land situate
in the Borough of WormleYBburg, Cumberland County, Pennsylvania,
together with a one story office and warehouse building erected
thsreon known and numbered as 1027 Mumma Road (the "Property"),
has executed or is about to execute a Construction Contract with
NOVINGER'S, INC., the contractor, with its principal place of
business located at HarriSburg, Pennsylvania, for the renovation
and improvement 01 certain portions of the Property, which is
more particularly bounded and deHcribed on Exhibit "A", appended
hereto and made a part hereof. I
NOW, THERt:f'ORE, thiB ,~Yf day of September, 1994, before any
aut.hority hllB boen 'Jiven by JACKSON "AMILY PARTNERSHIP to
NOVINGER'S, INC., the contractor, t.o commence work on said
facilities, or purchase matorials for the same, in consideration
of making of the above-doscribed contract with NOVINGER'S, INC.,
the Contractor, and in further consideration of Ono Dollar ($1)
paid to the Contractor by Owner', the receipt whereof is hereby
acknowledged, it iu aqroed that no liens or claims shall be filed
or maintained aqainst tho Ownor's facilities and the land above-
described, tho Property, by tho Contractor, or any subcontractor,
or by any of tho materialmen or workmen or any other person
acting throuqh or undor' them, for or on account of any labor, or
materials purcha8ed, or extra labor or materials purchased tor,
tOWArds, in or about tho renovation, erection, construction and
