make. reference to the fact that the partie. would enter into a new
agre.ment each June for the lease of the .ubject premise., and,
paraqraph 7 of Plaintiffs' Complaint avers that Defendant prepared
all such lease aqreements or introduced the use of said lease form.
to be used as such agreements.
4. Paragraph 8 of Plaintiffs' Complaint states that,
"Accordinq to the terms of the lease, the Plaintiffs aqreed to pay
and Defendant aqreed to furnish the leasinq of the property."
5. Paraqraph 12 of Plaintiffs I Complaint stats that, "The
Plaintiff has fulfilled all the provisions of the agreement on her
part to be performed."
6. Paragraph 13 of Plaintiffs' Complaint states that, "In the
lea.e agreement, no responsibility to repair items of this nature
were allocated to the Plaintiff/tenant."
7. Paragraph 16 of Plaintiffs I Complaint avers that Defendant
wholly neglected to do and perform certain things expressly, or by
necessary implication required to be done pursuant to said lease
agreement.
8. Paragraph 17 of Plaintiffs' Complaint, again, makes
reference to Defendant's alleged violation of the lease agreement
referred to in Plaintiffs' Complaint.
9. Pennsylvania RUle of civil Procedure 1019(h) states:
"A pleading shall state specifically whether any claim
or defense set forth therein is based upon a writinq.
If .0, the pleader shall attach a copy of the writing or
the material part thereof, but if the writing or copy is
not accessible to him, it is sufficient so to state,
together with the reason and to set forth the substance

of the writing."
10. Plaintiffs have failed to attach a copy of the lea.e
agreelllent consistently referred to throughout the Complaint, a.
required by Pennsylvania Rule of Civil Procedure 1019(h).
11. Plaintiffs have failed to attach a copy of a material
part of the lease agreement con.ietently referred to throughout
Plaintiffs' Complaint, as required by Rule l019(h).
12. Plaintiffs have failed to .tate that the alleged writing
i. not accessible to them and why, no7;' have they set forth the
.ubstance of the writing within the Complaint as required by RUle
1019 (h) .
WHEREFORE, Defendant requests that this Honorable Court
raquire Plaintiffs to bring their Complaint into conformity with
Pennsylvania Rule of Civil Procedure 1019(h).

13. The averments set forth in Defendant's Motion to Conform
Pleading to Law or Rule of Court Pursuant to Pa.R.C.P. 1028(a)(2)
set forth hereinabove is incorporated herein by reference as fully
as though set forth at length.
14. Paragraph 17 c. of Plaintiffs' Complaint avers that the
alleged negligence, carelessness and recklessness of the Defendant
consisted of his "Otherwille violating the Pennsylvania Landlord
Tenant Act."
15. Paragraph 17 d. of Plaintiffs' Complaint avers that the
alleged negligence, carelessness and recklessness of the Defendant

16. Paragraph 17 e. of Plaintiffs' Complaint aver. that the
all.ged negligence, carelessne.. and reckle..ne.. of the Defendant

.tatute. and ordinances of the Commonwealth of Pennsylvania and the
rul.. and regulations pertaining thereto.
17. Pennsylvania Rule of Civil Procedure 1019(a) requires
that a Plaintiff plead specific facts in support of averment. made
in their Complaint.
18. Paragraphs 17 c., d. and e. of Plaintiffs' Complaint fail
to plead any facts in support of their allegations.
WHEREFORE, Defendant requests that this Honorable Court strike
paragraphs 17 c., d. and e. of Plaintiffs' complaint.

19. The averments set forth in Defendant's Motion to Conform
Pleading to Law or Rule of Court Pursuant to Pa.R.C.P. 1028(a)(2)
and Motion to strike Pursuant to Pa.R.C.P. 1019(h) and 1028(a) (3)
.et forth hereinabove are incorporated herein by reference as fully
a. though set forth at length.
20. Paragraphs 17 c., d. and e. of Plaintiffs' Complaint are
vague in that they fail to set forth with specificity how Defendant
wa. allegedly negligent, careless and reckless.
21. Defendant's Motion is being made pursuant to pennsylvania
Rule of Civil Procedure Rule 1028(a) (3) and on the ground that

15. At the aforementioned time and place, the oil burner
in.talled in the Defendant's premises malfunctioned and cau.ed soot
to be distributed throughout the business of the Plaintiff causing
damage to the Plaintiff's property.
16. Defendant has wholly neglected to do and psrform certain
thing. which were expressly or by necessary implications required
to be done and performed by the agreement, as follows:
a. Failure to inspect the heating system;
b. Failure to and maintain the heating system in proper
working order;
c. Negligently failing to keep the premises in a safe
condition.
17. The negligence, carelessness and recklessnes. of the
Defendant consisted of the following:
a. Failing to inspect the heating system of the leased
premises;
b. Failure to maintain the heating system of the lea.ed
premises in proper working order;
o. Otherwise violating the Pennsylvania Landlord Tenant Aot;
d. otherwise violating the Pennsylvania Commercial Code,
e. Otherwise viOlating the lease agreement and other

AND NOW, comes the Plaintiff, Linda Kaye Markel, individual~y
and t/d/b/a Linda Kaye , Company, by hlilr attarneys ZEIGLER ,
ZIMMERMAN, and requests an Enlargement of Time in which to file a
response to Defendant's preliminary objections, and in support
thereof avers as follows:
1. Plaintiff instituted this action against Defendant by
Complaint filed on or about October 21, 1994.
2. Plaintiff's complaint sets forth a cause of action
against Defendant sounding primarily in negligence, baeed upon a
written Agreement and Lease to a property locllted llt 45 South
Baltimore street, Dill.burg, Pennsylvania as set forth in paragraph
4 of Plaintiffs' Complaint.
3. Paragraph 5 of Plaintiff's complaint llver. that the
parties entered into II written Agreement in June of 1987 to lellee
the premiee. located at 45 South Baltimore Street in Dilleburg,
York County, Pennsylvania; paragraph 6 of Plaintiff'e Complaint
Makee reference to the fact that the parties would enter into a new
Agreement each June for the leaee of the subject premi.e.; and,
paragraph 7 of Plaintiff's Complaint llvers thllt Defendant prepared
all such Lellee Agreements or introduced the u.e of eaid lease forms
to be use ae euch Agreements.
4. Pllragraph 8 of Plllintiff's Complaint states thllt,
"According to the terms of the lellse, the Plaintiffs agreed to pay
and Defendant agreed to furnieh the leasing of the property."
5. Pllrllgrllph 12 of Plllintiff's Complaint states that, "The
Plllintiff hilS fulfilled llll the provisions of the llgreement on her
part to be performed."
6. Pllragraph 13 of Plaintiff's Complaint states that, "In

without knowledge or informlltion sufficient to form a belief as to

circumstllnces and fully performed llnything expressly or by
necessary implication required to be done llnd performed by him
under the agreement.
17. Denied. It is specH ically denied that the alleged
negligence, carelessnees and recklessness of the Defendllnt

leased premises in proper working order.
On the contrary, at all times relevant hereto, Defendant acted in
a careful, lllWful and prudent manner with due care under the
circumstances and was not negligent, cllreless or reckless in any
manner.
l8. Denied. It is specifically denied that the alleged
carelees, negligent or reckless mllnner of the Defendllnt in
allegedly failing to mllintllin the oil burner in proper working
order was the direct llnd proximllte Clluse for the distribution and
subeequent damage to Plllintiff's property in the amount of
$7,666.76. On the contrary, at llll times relevllnt hereto,
Defendant llcted in a careful, lllWful ~nd prudent manner with due
care under the circumstllnces llnd WllS not cllreless, negligent or
reckless in any manner. The remaining alleglltions contained in
paragraph 18 of Plaintiff's Amended Complaint are denied beclluse,
after reasonable investiglltion, Defendant is without knowledge or
information sufficient to form II belief IlS to the truth or verllcity
of thoee allegations llnd same llre denied and strict proof thereof
demanded.
