COMPLAINT IN MORTGAGE FORECLOSURE
AND NOW, comes the Plaintiff by its attorneys, Louis P. Vitti and Associates, P.c.
and Louis P. Vitti, Esquire, and pursuant to the Pennsylvania Rules of Civil Procedure
Numbers 1141 through 1150, for Its Complaint in Mortgage Foreclosure, sets forth the
following:
1. The Plaintiff is a corporation duly authorized to conduct business within
the laws of the Commonwealth of Pennsylvania, having a principal place of business located
at 1121 E. Wells, Milwaukee, W/53202.
2. The Defendants are individuals residing at 191 0 Fry Loop Avenue, Carlisle,
PA 17013.
3. On Ihe 29th day of September, 1989, in consideration of a loan of Seventy
Thousand Six Hundred Thirty Five and 00/100 ($70,635.00) Dollars made by
Commonwealth Mortgage Company of America, loP., a Delaware corporation, to
Defendants, the said Defendants executed and delivered to Commonwealth Mortgage
Company of America, loP., d Deldware corporation, a "Note" secured by a Mortgage with
the Defendants as mortgagors and Commonwealth Mortgage Company of America, as
mortgagee, which mortgage was recorded on Ihe 4th day of October, 1989, in the Office
of the Recorder of Deeds of Cumberland Counly, in Mortgdge Book Volume 954, page 733.
The said mortgage Is incorporated herein by reference.
4. The premises secured by the mortgage are:
ALL THAT CERTAIN lot of ground situate in the Township of
North Middleton, County of Cumberland and Commonwealth of
Pennsylvania, bounded and described as follows, to wit:
BEGINNING at a point on the Western side of Fry Avenue,
which point is the Northeastern corner of Lot No. 55, as shown on
plan No.4 of Schlusser Village, which plan is recorded in the
Office of the Recorder of Deeds in and for Cumberland County in
plan Book 7, Page 39; thence in awes ter ly direct ion along the
~orthern line of Lots Nos. 55 and 54 as shown on said Plan of
Sch1usser Village 110 feet to a point, the Northwestern corner of
aaid Lot No. 54; thence in a Northerly direction parallel with
Fry Avenue, as shown on said Plan No.4 of Schlusser Village 110
feet to a point; thence in an Easterly directi.on along lane now
or formerly of Mac T. Stambaugh et ux, 110 feet, more o~ less, to
a point in the Western line of said Fry Avenue; thence in a
southerly direction along the Western line of said Fry Avenue 110
feet to a point, the place of BEGINNING.
5. On the 6th day of October, 1989, Commonwealth Mortgage Company of
. America, L.P., a Delaware corporation, assigned to the Plaintiff. Fleet Mortgage Corp., the
said mortgage, that assignment being recorded in the Office of the Recorder of Deeds of
Cumberland County on the 28th d.1Y of february, 1990, in Mortgage Book Volume .376,
page 983. The said assignment is incorporated here;n by reference.

devisee of the mortgagor from liability for the debt secured by the mortgage.
WHEREFORE, pursuant to Pennsylvania Rule of Civil Procedure Number
1147(6), Plaintiff demands judgment for .he amount due of Eighty Seven Thousand Five
Hundred Twenty Four and 81/100 Dollars ($87,524.81) with interest and costs.
