AND CONTEMPT The petitioner, Jo Ann Sheehan, avers the following by and through her attorney, Joan Carey of Legal services, Inc.: 1. The petitioner i. Jo Ann Sheehan ("the mother"), residing at R.R. 5, Honesdale, Pennsylvania. :I. The respondent is Harry Samuel Garula, II ("the father"), reaiding at 107 April Drive, Camp Hill, Pennsylvania. 3. The parties are the parents of Tabbitha Marie Garula ("the child"), born July 1, 1978. 4. As part of a divorce agreement, the child livad with the mother until on or about September 4, 1987. 5. On or about September 4, 1987, after a hearing in the Wayne county Court of Common Pleas, Judge Robert J. Conway entered an order granting both parente 8hared legal cU8tody, the father primary physical custody, and the mother partial phyeical custody including at least one (1) weekend per month from Friday evening until Sunday evening, alternate holidays and eix weeke in the eummer. See attached Exhibit A incorporated by reference. 6. On or about April 1993, the mother agreed to temporarily suspend her period8 of partial phY8ical custody becauee of allegation. that the mother'. husband sexually abueed the child. 7. On or about october 1993, the mother .eparated from her hu.band and attempted to re.ume her period. of partial phy.ical custody. (On or about May 19, 1994, the husband wa. .entenced to a minimum of five years in pri.on, which he i. currently serving.) 8. since on or about October 1993, the father ha. willfully di.obeyed the Order by denying the mother her period. of partial phy.ical cu.tody in ways including the following: a. Over the past year, the mother hae attempted to exerci.e her p~riods of partial physical cuetody, but the father consi.tently refuses to allow the visit. with the child including weekends, holidays and her extended summer period of custody. b. On or about July 2, 1994, the child ran away from the father's home to the mother's home, and in spite of the Order giving the mother six weeks of custody during the .ummer, the father refused to let the child stay with her mother. 9. On or about October 5, 1994, the child ran away from the father'. home and as of thi. date haG not returned. 10. On or about October 18, 1994, the child telephoned the mother and told her that she is unwilling to return to th~ father'. home, but would be willing to come to the mother'. home. The mother convinced the child to contact Legal Services, Inc. to verify thi. de.ire. 11. On or about October 20, 1994, the child telophoned Legal Service., Inc., indicated that .ha would not return to her father'. hom., and a.ked Legal s.rvices, Inc. to facilitate her return to her mother. 12. The mother f.els that the child'_ best int.re.t. would be .erv.d by an award of temporary cu.tody to her pending conciliation of thi. matter. 13. The mother request. the court to confirm custody of the child in her after the conciliation conference for rea.on. including: a. The child, who is sixteen years old, prefers to live with her mother. b. The mother has learned from the child that the father doe. not provide for the child's emotional needs. c. The mother is able to provide for the child's need. including a stable environment. d. Since the child began treatment at the HarriSburg Institute of psychiatry, the mother has been in contact with the child'. doctors, and would continue to work with them to facilitate the treatment which the child requires. e. On or about July 31, 1994, the mother met with Jo.e Delerme, the child'. psychiatri.t at the HarriSburg In.titute of p.ychiatry, who .pecifically recommended that it would be in the child'S best interests to have a relationship with her mother. f. The child has repeatedly run away from the father'. hoae to the mother'. home, and the father haG demanded the chilcS'. return to hi. cu.tod.y. In October 1994, the chilcl ran away ancS not wanting to return to the father, refu.e. to tell the ..other where _he i., cau.ing the mother concern for her well- being. g.
