MARRIAGE SETTLEMENT AGREEMENT

THIS AGRBBIIIN'l' made this
1995, by and between Geraldine H. Handshew of P.O. Box 336, New
Kingston, Pennsylvania 17072-0336 (hereinafter referred to as
"wife") and Kenneth L. Handshew of 332 Ridge Hill Road, Carlisle,
Pennsylvania 17013 (hereinafter referred to as "Husband").
WI'l'tIISSB'l'II: WHIRBAS, HUSBAND and WIn were lawfully married
on November 5, 1960. Wife instituted an action in divorce to
number 94-6165 civil term in the Court of Common Pleas of
CUlllberland County, Pennsylvania on OCtober 27, 1994. The
pleadings in the case requested dissolution of the marriage
between the two parties and for such further relief that the
Court may deem equitable and just; and
~BAS, the parties have reached an agreement as to the
settling of all matters relating to the divorce and custody of
the child between them.

I' I NOW, TBIRIlORI, in consideration of the promises and the
imutual promises, covenants and undertakings hereinafter set forth
and for other good and valuable consideration, receipt of which

I is hereby acknowledged by each of the parties hereto, husband and
wife, each intending to be legally bound, hereby covenant and
agree as follows:
1. The parties intend to maintain separate and permanent
domiciles and to live apart from each other. It is the intent
and purpose of this Agreement to set forth the respective rights
and duties of the parties while they continue to live apart from
I each other.
2. The terms of this Agreement and their effect have been
I fully explained to the parties by their respective counsel, Jane
I M. Alexander, Esquire for wife and William A. Duncan, Esquire for
II husband. The parties aCknowledge that they have received
, independent. leqal advice from counsel of their choice and have
been fully informed as to their leqal riqhts and Obligations or
I have fully chosen not to do so. The parties understand the facts
I
I and acknowledge and accept this Agreement as fair and equitable.
I 3. The parties have attempted to divide their matrimonial
!
; property in a manner which conforms to a just and right standard,
with due regard to the rights of each party. It is the intent of
the parties that such division shall be final and shall forever
determine their respective rights. The division of existing
marital property is not intended by the parties to constitute in
any way a sale or exchange of assets, and the division i. being
effected without the introduction of outside funds or other

property not constituting a part of the marital estate.
4. Further, the parties agree to continue living separately
and apart from the other at any place or places that he or she
may select. Neither party shall molest, har.ss, annoy, injure,
threaten or interfere with the other party in any matter
whatsoever. Each party may carryon and engage in any
employment, profession, business or other activity as he or she
may deem advisable for his or her sole use and benefit. Neither
party shall interfere with the uses, ownership, enjoyment or
disposition of any property now owned and not specified herein or
property hereafter acquired by the other.
S. The consideration for this contract and agreement is the
mutual benefits to be obtained by both of the parties hereto and
the covenants and agreements of each of the parties to the other.
The adequacy of the consideration for all agreements herein
contained is stipulated, confessed, and admitted by the parties,
and the parties intend to be legally bound hereby.
6. Debts of the Parties:
It is further mutually agreed and understood by and
between the parties that all joint debts have been paid including
open accounts, credit cards, and bank liabilities except .s
hereinafter set forth:

6.1) The HUSBAND ahall aasume all liability for and
pay and indemnify the WIr. against all debts and bills in his
name alone, particularly those incurred since date of separation.
6.2) The WI,. shall assume all liability for and pay
and indemnify the HUSBAND against liability for all debts and
bills in her name alone, particularly those incurred since date
of separation.
6.3) The parties had no joint debts at .the time of
filing of the divorce except those relating to the real estate.
7. Residence and Personal Property.
7.1) Residence of the Part~: T.he marital residence
I of the parties located at 332 Ridge Hill Road, Carlisle, PA
I 17013 (Silver Spring Township) has been listed for sale by Jack
Gaughen Realtor. The listing price is $125,750. The parties
agree that the net proceeds of the sale after deducting the
realtor's commission and other costs relating to the settlement
shall be divided equally between the parties. At that time WI,.
shall reimburse HUSBAND from her net proceeds for one half the
'cost of the sewer ~nstallation for the property which was due at
the time of separation which has been paid by the HUSBAND which
would be $1,075.00.
The HUSBAND is presently residing in the residence
and will be responsible for taxes, insurance and utilities until

such time aa he vacatea the premises. From that date to date of
settl~ment such expenses ahall be divided equally between the
parties.
7.2) Additional Real Estate: The parties own four
I cemetary lots titled in both namea in the Lonqadorff Cemetery,
I New Kinqston valued at $100 each. The lots shall be divided
I equally betw~en the parties, each receivinq two lots.
7.3) Personal Property: The parties have aqreed and
have in fact sold all tho furniture, furnishinqs tools and
equipment located at the marital residence at a public sale which
was held Sep~ember 9, 1995.
At the time of listinq these items for sale, the
parties reserved and had appraised certain items of personal
property. The proceeds of the public sale are now to be divided
equally which an adjustment beinq made for those items retained
80 that the total of the personal properyty sold and the value of
property retained shall be divided between the parties.
As to all other items of personal property which
the parties have divided to their mutual satisfaction,
henceforth, each of the parties shall own, have and enjoy
independently of any claim or riqht of the other party, all items
,of personal proporty of every kind, nature and description and
wherever situated, which are now owned or held by or which may

hereafter belong to the BUSBAKD or WIPE, with full power to the
HUSBAND or the WI,. to dispose of same as fully and effectually,
in all respects and for all purposes as if he or she were not
married. Specific disposition of major items or personal
property is as follows:
a) HUSBAND shall retain ownership of the Dodge
Dakota truck which is titled in his name and shall be solely
responsible for the debt due thereon and hold WIFB harmless from
said obligation.
b) WIFB shall retain ownership of the 1990

I' Plymouth van which is titled in her name and shall be soley
responsible for the debt due thereon at Fulton Bank and will hold
'HUSBAND harmless from said obligation.
c) HUSBAND shall retain ownership of older DOdge
truck and WIFB shall receive $1,000 from HUSBAND's half of the
account no. 3-011054 at Farmers Trust.
d) HUSBAND is making no claim of any interest in
WIll'. ceramic business.
7.4) Bank Accounts:
a) SaVings account 01-008004 at Commerce Bank
(Sa1ance as of 12/31/94 $4,832.84) shall become the sole property
of the Will.
b) Account No. 3-011054 at Farmers Trust shall be

divided equally between the parties and WI,. should receive
$1,000.00 from HUSBAND half which represents her truck payment
under 7.3 C.
c) HUSBAND shall retain full ownership of his IRA
account no 1-0039594 maintained at Farmer's trust which had a
balance as of August 8, 1995 of $5,057.83.
7.5) Both parties aqree to release any interest they
may have in the pension plan of the other and aqree to execute
any documents that may be required to confirm said releas..
8. Spousal Support/Alimony: Neither party will make a
claim for spousal support and/or alimony. HUSBAND has been
making spousal support payments in the amount of $221 per month

in accordance with a support order entered March 14, 1995. The
order was terminated effective May 12, 1995.
9.
The property settlement as provided herein between the
parties shall be considered an equitable distribution of marital
property and both parties waive any and all riqhts or claims
'which they may have been entitled to ~aise with respect to the
issue of equitable distribution under the Provisions of the
Pennsylvania Divorce Act.
10. The parties agree that simultaneously with the signing
of this Agreement they will sign the necessary affidavits of
consent and affidavits aCknowledging notice of marriage

COMPLAINT UNDER SECTION 3301 lc) OF THE DIVORCE CODE
AND NOW, this 25th day of August, 1994, comes the Plaintiff,
Geraldine M. Handshew, by her attorney, Jane M. Alexander,
Esquire and files this Complaint in Divorce upon a cause of
action of which the following is a statement.
1. Plaintiff is Geraldine M. Handshew, 63 years of age, who
currently resides at 10 Sunset Drive, Mechanicsburg 17055, County
of Cumberland, Commonwealth of Pennsylvania.
2. Defendant is Kenneth L. Handshew, 59 years of age, who
currently resideft at 332 Ridge Hill Road, Carlisle 17013, County
of Cumberland and Commonwealth of Pennsylvania.
3. Plaintiff and Defendant have both resided in the
Commonwealth of Pennsylvania for at least six (6) months prior to
the filing of the Complaint in Divorce.
4. The Plaintiff and Defendant were married November 5,
1960, in Camp Hill, Pennsylvania by a minister.
5. There were no children born to this marriage.
6. There were no prior actions in divorce or annulment
commenced by the parties.
7. The parties have not entered into a written agreement as
to alimony, counsel fees, costs and property division.
8. The Plaintiff has been advised of the availability of
counseling and that the Plaintiff may have the right to request
that the Court require the parties to participate in counseling.
9. While the parties were domiciled within the Commonwealth
of Pennsylvania, and through no fault of Plaintiff, the innocent
and injured spouse, the Defendant, in violation of the marriage
vows and the laws of the Commonwealth, has offered such indigni-
ties to the person of the Plaintiff as to render her condition
intolerable and life burdensome.
WHIRBPORI, the Plaintiff prays your Honorable Court to enter
a Decree of Divorce from the bonds of matrimony.

appeared Jane M. Alexander, Esquire, who swears according to law,
that a true and correct copy of the Complaint in Divorce under
Section 53301(c) of the Divorce Code was caused to be served by
certified mail with return receipt requested upon the said,
~enneth L. Hand.hew, Defendant, at 332 Ridge Hill Road, Carlisle,
Pennsylvania 17013 on November 2. 1994 by leaving the same at
the Dillsburg Post Office with postage pre-paid thereon as
