AGREEMENT
THIS AGREEMENT mAde this 9 day of ~, 1995, by
And between JEFFREY J. BAKER, hereinafter referred to as "HUSBAND"
and CHRISTINA L. BAKER, hereinafter referred to as "WIFE".
WITNESSE'rH:
WHEREAS, the parties hereto are husband and wlfe; and
WHEREAS, certain differences have arisen between them, AS a
consequence of which the sAid parties are living separate and apart
and therefore desire to enter into an agreement for the final
settlement of their property and affairs; and
WHEREAS, the parties, being fully advised as to their
respective righti\l, duties and obligations growing out.. of ~eir

WIFE.
hereinafter mutually to be kept and performed by each party, as
well as for other good and valuable consideration, it is agreed as
follows:
1. SEPARATION: It shall be lawful for HUSBAND and WIFE to
live separate and apart from each other and to reside from time to
time at such place or places as they shall respectivelY deem fit.
2. INTERFERENCE: Each pArty shall be free from interference,
authority and contact by the other, except as may be necessary to
carry out the provisions of this Agreement. Neither party shall
mole.t the other nor attempt to endeavor to molest the other nor in
any way harass or malign the other, nor in any way interfere with
the peaceful existence, separate and apart from the other.
3. NAMES: It is understood that the terms HUSBAND and WIFE
are used throughout this Agreement solely as the method of
identifylng the parties and such words shall not be construed to
have any special meaning or purpose for their use, and are not
dependent on their marital status with each other.
4. llVORCE: HUSBAND has filed an action for divorce in
Cumberland County, Pennsylvania. The parties agree that, upon
passage of the ninety day waiting period after the filing of the
divorce complaint, they will execute affidavits of consent so that
the divorce action can be completed. This Agreement shall remain
in full force and effect regardless of any change in marital status
of the parties.
5. WIFE'S DEBTS: WIFE represents and warrants to HUSBAND
that she will not contract or incur any debt or liability for which
HUSBAND or his estate might be responsible other than those debts
assumed by the HUSBAND as a consequence of the Agreement herein.
6. HUSBAND'S DEBTS: HUSBAND represents and warrants to WIFE
that he will not contract or incur any debt or liability for which
WIFE or her estate might be responsible other than those debts
assumed by the WIFE as a consequence of the Agreement herein.
7. MUTUAL RELEASES: SUbject to the provisions of this
Agreement, each party has released and discharged, and by this
Agreement does for himself or herself, and his or her heirs, legal
representatives, executors, administrators, and assigns, release

and discharge the other ot and trom all causes ot action, claims,
rights or dell\4nds whatsoever, in law or equity, which either ot the
parties ever had or now has against the other except any or all
causes ot action tor divorce and except any or all causes ot act.ton
tor the breach ot any provisions ot this Agreement or property
rights created and ll\4intained in this Agreement.
S. WAIVER OF CLAIMS AGAINST ESTATE: HUSBAND relinquishes his
inchoate intestate right in the estate ot WIFE, and WIFE
relinquishes her inchoate intestate right in the estate ot HUSBAND,
and each ot the parties hereto by these presents tor himselt or
herselt, his or her heirs, executors, administrators, or assigns,
does remise, release, quit-claim, and forever discharge the other
party hereto, his or her heirs, executors, administrators or
assigns, or any of them, of any and all claims, demands, damages,
actions, causes of action, or suits at law, or in equity, ot
whatsoever kind or nature, tor or because of any manner ot thing
done, omitted, or suftered to be done by $aid other party prior to
and including the date hereot.
9. MOBILE HOME: The parties are the owners of a 19S1 Homette
mobile home which is located at 210 Ponderosa Road, Carlisle,
Pennsylvania. WIFE agrees to convey all of her right, title and
interest in the mobile home tor the sum ot $1.00 to HUSBAND. In
return tor WIFE's conveyance ot her interest in the mobile home to
him, HUSBAND agrees to be responsible for payment ot the loan with
which the mobile home was purchased. This obligation is owed to
Raymond Diehl. HUSBAND agrees that he will secure WIFE's rolease
from this obligation to Mr. Diehl.

10. AUTOMOBILE: HUSBAND is the owner ot a 1992 Chevrolet
Corsica automobile. This vehicle is subject to an obligation owed
to Members First Credit Union with a current balance ot
approximately $9,000.00. This obligation was previously in the
name ot both of the parties but the parties have secured WIFE's
release from this obligation. HUSBAND agrees that WIFE may use the
vehicle provided that she pays all expenses associated with the
vehicle including, but not limited to maintenance, registration,
inspection and insurance. The parties understand that WIFE will
begin making the insurance payments when she receives her 1994
income tax re!und check. The insurance coverage which is to be
maintained by WIFE shall include full collision and comprehensive
coverage in amounts not less than those on the current coverage.
The Coverage must be for both HUSBAND and WIFE. HUSBAND shall be
responsible tor the payment ot the loan with Members First Credit
Union.
11. TRUCK: HUSBAND shall retain as his sole and separate
property his 1980 Chevrolet pickup truck and WIFE waives any claim
which she may have thereto.
12. DAHK ACCOUNTS: The parties have previously divided to
their mutual satisfaction all bank accounts.
13. SATELLITE DISH: HUSBAND shall retain as his sole and
separate property the satellite dish located at the location ot the
mobile home cited above, and WIFE waives any claim which she may
have thereto.
14. RETIREMENT p~ HUSBAND has a retirement plan through
his employer ABF Freight System. WIFE is aware that this asset
constitutes marital property and that she has the right to have it
appraised. WIFB has determined that she does not want to have this
asset appraised and she is hereby waiving any interest or claim
which she may have to HUSBAND's retirement plan with ABF Freight
System.
15. DIVISION OF PERSONAL PROPERTY: The parties acknowledge
that they have heretofore divided up between them all of their
personal property to their mutual satisfaction. All the personal
property currently under the custody and control of the WIFE shall
belong to the WIFE and all the personal property currently under
the custody and control of the HUSBAND shall belong to the HUSBAND.
Henceforth each of them shall own, have and enj oy, independently of
any claim or right of the other, all items ot personal property ot
every kind, now or hereatter owned or held by him or her, with tull
power to dispose ot the same as tully and eUectually, in all
respects and tor all purposes, as it he or she were unmarried.
16. OBLIGATIONS: HUSBAND shall be responsible tor and shall
hold WIFE harmless in regard to the PSL Loan with Members First
Credit Union with a current balance ot approximately $3,500.00, the
personal loan with Members First Credit Union with an approximate
balance ot $6,000.00, and the loan trom Village Consumer Discount
for the purchase ot the satellite dish with a current balance ot
approximately $3,700.00. HUSBAND shall also be responsible tor and
shall hold WIFE harmless in regard to his VISA account with a
current balance ot apprOXimately $6,000.00. WIFE shall be
responsible for payment ot her credit cards with Victoria's Secret,
JC Penney, and Spiegel and shall hold HUSBAND harmless in regard
thereto.
17. SUPPORT: Each party hereby aqrees not to claim or demand
any support tor himself or herseIt, alimony Pendente Lite,
permanent alimony, counsel tees or expenses trom the other party,
except as specitically provided for in this Aqreement.
18. WAIVER OF APPRAISEMENT AND INVENTORY: The parties
acknowledqe and agree that they have had an opportunity to value or
have appraised any and all marital property, and they do hereby
waive a tormal appraisal and inventory of same, and no statement or
representation by either party as to value shall be deemed a
misstatement or misrepresentation to the other or be deemed
fraudulent.
19. EXECUTION OF DOCUMENTS: The parties hereto agree to
execute any and all documents necessary to ettect the terms ot this
Agreement.
20. INCORPORATION: This Agreement may be incorporated into,
but shall not be merged with, a Oecree in Oivorce between the
parties.
21. LAW OF AGREEMENT: This Agreement shall be construed
under the laws of the Commonwealth of Pennsylvania.
22. ENTIRE AGREEMENT: This Agreement contains the entire
understanding between the parties. There are no representations,
warranties, covenants or understandings other than as expressly set
forth herein.
23. LEGAL ADVICE: WIFE understands that the within agreement
has been prepared by HUSBAND's attorney, Joel O. Sechrist, Esquire.
WIr. has been advised that she should have this agreement reviewed
by her own attorney. The parties to this AOreement hereby
Acknowledge that they have carefully examined its contents and that
they are satisfied that they understand the Agreement and further
that the Agreement is, under the circumstances, fair and equitable
And that it is being entered into freely and voluntarily and that
it is not Antered into as a result of any collusion or improper or
illegal agreement or agreements.
IN WITNESS WHEREOF, the parties have hereunto .et their hands
and seals the date first above written.
