Associates Consumer Discount Company, the plaintiff, is a corporation doing business at the address indicated in the caption hereof. 2. Defendants, Samuel L. Hoover and Joseph Irvin, are adult individuals rssiding at the address set forth in the caption hereof. 3. On or about October 3, 1986, the Defendants signed an ~nstallment Loan Agreement/Note (the "Agreement") with the Public Consumer Discount Co., a lending institution. The subject Note is attached hereto as Exhibit A and incorporated by reference herein. Said Agreement has been assigned to Associates Consumer Discount Co., plaintiff herein along with all rights and liabilities. 4. The Agreement provides that the Defendants were to payoff the Note inclusive of principal and interest, in regular monthly payments, with said installments to begin approximatley 30 days from the date of the Agreement. 5. The above mentioned payments to be made each and every month until the Loan was paid in full including principal and any accrued interest and late charges. 6. Defendants became delinquent by failing to make the payment due as required by said agreement. Defendants continue to fail to keep their payments up- to-date. The defendants are in default of the Agreement. 7. The amount due and owing under the terms of the Note is $1,587.71 plus interest at the contract rate from June 8, 1994. 8. The agreement whereby Plaintiff and DefendantlB entered into the above-relationship also provides for the costs of suit and reasonable attorney's fees to be paid by the Defendants in the event of a default. 9. Reasonable attorney's fees under the circumstances are $317.54. 10. Despite repeated demands by the Plaintiff, the Defendants have refused and continue to fail and refuse to pay the amount due.
