AND NOW comes the Petitioner, J. Eric Pitman, by and throuah his attorney, John F.
Lyons, Esquire, and respectfully represents as follows:
1. Petitioner is J. Eric Pitman, an adult individual, whose reaislCrcd license address
is 686 Valley View Drive, BoUina Sprinas, Cumberland County, Pennsylvania 17007.
2. Respondent is the Commonwealth of Pennsylvania, Department of Transportation,
Bureau of Driver L1censina, with an address of Room 103, Transportation and Safety Buildina,
Harrisbura, Pennsylvania.
3. Petitioner is a licensed driver in Pennsylvania with license bcarina operator
number 21966627.
4. On or about October~, 1994, Petitioner ~ived a document tntitled Additional
Notice that his operator's privileae was beina suspended (or a period of sill (6) months (or "his
conviction on March 22, 1994, for. violalion of Section 13(A)3O of the Vehicle Code",
Delivery of Controlled 5ubltance on December 30, 1992. (A copy of said Notice is attached
hereto u Exhibit A).
,. In addition, the Notice informed Petitioner that t!le effective date of suspension
was July 1', 1994, or two and one-half (2 1/2) months prior to the Notice of Suspension date.
6. The Notice of Suspension fails to accord Petitioner his statutorily mandated right
to appeal and right to a hearing u set forth in 7' Pa.C.S. . 1"0.
7. Respondent also mailed a Notice, dated October', 1994, to Petitioner advising
Petitioner that it was combining multiple driving records and that Petitioner would be notified
of any sanctions. (A copy of said Notice is attached hereto and marked as Exhibit "8").
8. Petitioner, to the best of his knowledge and belief, has no knowledge of any other
driving record or license being maintained by Respondent pertaining to him.
9. Petitioner has received no prior notification suspending his operator's privileges
as identified by number 21966627.
10. The actions of the Department are erroneous and the Petitioner has been
prejudiced by such actions in that:
a). His driving privileles have been suspended contrary to his constitutional rights
to due process In thai he has been liven inadequate notice and opportunity to he heard;

b). He hu not been ICCOrded thirty (30) days nod" u required by statute before the
IUspension efl'ec:tive dale from dale of nod":
e). He II unable to timely make alternate uranaements for transportation to and from
his place of employment:
d). Petitioner hu not been convicted of any Vehicle Code violation which would
result In the suspension of his license: and,
e). He hu becn lUeplly subjected to possible additional criminal collateral civil
consequences without adequate notice and contrary to his statutorily mandated rlahts.
WHEREFORE, Petitioner request your Honorable Court sustain his appeal of the
suspension of his operatina prlvileaes and enter an Order of Supersedeas of such suspension
pendina I dctenninatlon of his Appeal on its merits.
