STIPULATION AGAINST LIENS
THIS AGREEMENT made the '-7th day of October, 1994 between
MURTORFF CONSTRUCTION COMPANY, INC., of Carlisle, Cumberland
County, pennsylvania, a corporation organi~ed and existing under
the laws of the Commonwealth of Pennsylvania, hereinafter
referred to as Contractor,

HARMONY HALL ASSOCIATES, hereinafter referred to as Owner.
WHEREAS, Contractcr has undertaken and agreed to erect and
construct a four uni.t condominium complex appearing as Building
'5 on the Final Subdivision Plan for Harmony Hall Court,
recorded, or about to be recorded, in Cumberland County Plan Book
63, page 103, and being located on a portion of the premises more
particularly described in the Deed of Ronald L. Simons, Don Neff
and Melvin O. Murtorff, Co-partners to Ronald L. Simons and
Sharon L. Simons, his wife, Don Neff and Sondra Neff, his wife,
and Melvin O. Murtorff and Marian M. Murtorff, his wife, co-
partners d/b/a Harmony Hall Associates dated August 6, 1991 and
recorded in Cumberland County Oeed Book "H", Volume 35, Page 59.
NOW THEREFORE THIS AGREEMENT WITNESSETH:

That the said contractor, for and in consideration of the
sum of One ($1.00) Dollar in hand paid to it by owners the
receipt whereof ia hereby acknowledged, and the further
consideration mentioned in the agreement aforesaid, for itself
and its subcontractors, and all parties acting through or under

it or them, covenant and agree that no mechanic's liens or claims
shall be filed or maintained by it or any of them against the
said buildings and the lot of ground appurtenant thereto for or
on account of any work done or materials furnishsd by it or any
of thsm under said contract or otherwise, for, towards, in or
about the erected and construction of the said buildings on the
lot above described, and the said contractor, for itself, its
subcontractors and others under it hereby expressly waives and
relinquishes the right to have, file, and maintain any mechanic'S
liens or claims against the said buildings or any of the
improvements, and agrees that this instrument, waiving the right
of lien, shall be an independent covenant.
IN WITNESS WHEREOF, the parties hereto intending to be
legally bound have hereunto set their hands and seals the day and
year first above written.
