AND NOW, this~ day of June, 1995, this Court certifies
that the attached complaint has been properly completed and
verified, and there is probable cause for the issuance of
process. In consideration of the attached Commonwealth's
petition, the defendant, GEORGE R. BROOKS, is directed to appear
for trial on the charge of Indirect Criminal Contempt before the
Court on the 5 (\.day of ~, 1995 at :/.:0,1 o'clock
~ .m. in Courtroom' ~~~~~rland County Courthouse,
Carlisle, Pennsylvania.
The defendant has a right to be represented by an attorney.
If the defendant cannot afford an attorney, upon request one will
be assigned to represent the defendant. If the defendant wishes
assignment of counsel, contact should be made prior to trial with
the Cumberland County Public Defender's Office at 717-240-6285.
Further, if the defendant fails to appear, an arrest warrant will
be issued.
The Sheriff of Cumberland County is directed to serve this
Order and petition upon the defendant. The assessment of costs
to be determined by the Trial Judge subsequent to trial.

COMMONWEALTH'S PETITION FOR A HEARING ON CHARGES
OF INDIRECT CRIMINAL CONTEMPT
Thomas A. Placey, Senior Assistant District Attorney of
Cumberland County, Pennsylvania brings the following Petition for
a hearing on charges of Indirect Criminal Contempt:
1. A Protection from Abuse Order was issued by the Court.
A true and correct copy of the Order is attached.
2. The defendant's violation of this Order is averred in
the attached private criminal complaint.
3. Th~ victim requests the filing of an Indirect Criminal
Contempt chat'ge upon information received.
4. The District Attorney's Office approves the filing of
this private criminal complaint.
5. The Commonwealth is requesting a trial on the charges
of Indirect Criminal Contempt pursuant to 23 Pa.C.S.A. 56113.
6. The plaintiff and the defendant may seek modification
of the Order based on the filing of this petition as the Court
deems appropriate following the trial in addition to any other
sentence. 23 Pa.C.S.A. 56117.
WHEREFORE, the Commonwealth requests the defendant be
commanded to appear before the Court on the charge of Indirect
Criminal Contempt.

consideration of the Consent Agreement of the parties, the
fOllowing Order is entered:
1. The defendant, aeorge R. Brooks, is enjoined from
physically abusing the plaintiff, Cindy A. Brooks, or from
placing her in fear of abuse.
2. The defendant is enjoined from stalking or harassing the
plllintiff.
3. The defendant, George R. Brooks, is hereby excluded from
the premises located at 215 W. North Street, Carlisle,
Pennsylvania, except to facilitate custody of their minor child.
The defendant is hereby notified that if he resides in the
plaintiff's domicile contrary to this Order, he may be in
indirect criminal contempt which is puniShable by a fine not to
exceed $1,000 and/or by a sentence of up to six months in jail
and any other appropriate punishment. Resumption of co-residence
on the part of the plaintiff and defendant shall not nullify the
provisions of the court order directing the defendant to refrain
from abusing the plaintiff. The defendant shall seek
modification (change) of this Order before resuming residence in
the plaintiff's domicile.
4. The defendant, George R. Brooks, is ordered to stay away
from any residence the plaintiff may establish for herself in the
future except to facilitata custody of their minor child.
5. The defendant is ordered to refrain from damaging or
destroying any property owned by the plaintiff or any property
owned jointly by the parties.
6. This Order shall remain in effect for a period of one
year.
7. The Carlisle Police Department will be provided with a
copy of this Order by attorneys for plaintiff. This Order $hall
be enforced by any law enforcement agency when a violation occurs
and an arrest for indirect criminal contempt. The arrest may be
without warrant upon probable cause that this Order has been
violated, whether or not the violation is committed in the
presence of the police officer. In the event that an arrest is
made under this section, the defendant shall not be taken to jail
but shall be taken without unnecessary delay before the Court
that issued the Order. When that Court is unavailable, the
defendant shall be arraigned before a district justice who shall
set bai 1 according to the provisions of Chapter 4000 of the
Pennsylvania Rules of Criminal Procedure (23 PS Section 6113) .

The parties agree that the
following may be entered as an Order of Court,
1. The defendant. George R. Brooks, agrees to refrain from
abusing the plaintiff, Cindy A, Brooks, or from placing her in
fear of abuse.
2. The defendant agrees not to stalk or harass the
plaintiff.
3. The defendant agrees to stay away from the residence
located at 215 W. North Street, Carlisle, Pennsylvania, except to
facilitate custody of their minor child.
4. The defendant agrees to stay away from any residence the
plaintiff may establish for herself in the future except to
facilitate custody of their minor child.
5. The defendant agrees not to damage or destroy any

does not admit the allegations made in this Petition.
7. The defendant understands that the Protective Order
entered in this matter shall be in effect for a period of one
year.
8. The defendant understands that this Order will be
enforceable in ths same reanner as the Court's prior TempOrary
Protective Order entered in this case.
g. The defendant and the plaintiff agree to the entry of
a Custody Order regarding their child, Paris J-Rome Ray Brooks,
providing the following:

a hearing on charges of Indirect Criminal contempt:
1. A protection from Abuse Order was issued by the Court.
A true and correct copy of the Order is attached.
2. The defendant's violation of this Order is averred in
the attached private criminal complaint.
3. The victim requests the filing of an Indirect Criminal
Contempt charge upon information received.
4. The District Attorney's Office approves the filing of
this private criminal complaint.
S. The Commonwealth is requesting a trial on the charges
of Indirect Criminal Contempt pursuant to 23 Pa.C.S.A. 16113.
6. The plaintiff and the defendant may seek modification
of the Order based on the filing of this petition as the Court
deems appropriate following the trial in addition to any other
sentence. 23 P~.C.S.A. 56117.
WHEREFORE, the Commonwealth requests the defendant be

I. The plaintiff, Cindy Ann Rrooks. is an IIdult individual residing at
215 West North Street, Carlisle, Cumberland County, Pennsylvania 17013.
2. The defendant, George Ray Brook:'l, Jr., (SSN: 173-56-3362)(DOB:
2/5/63), Is an adult individual whose current whereabouts are unknown to the
plaint iff.
3. The defendant is the former husband of the plaint iff.
4. Since approximately November 1995, the defendant has atte.pted to
cause and hilS intentionally, knowingly, or reckle,~sly caused bodi Iy injury to the
plaint iff, has placed the plaint Iff in reasonable fear of illlllllnent serious bodi Iy
injury, and has knowingly engaged in a course of conduct or repeatedly cOII.itted
acts toward the plaintiff under circumstances which have placed the plaintiff in
r\lasonable fellr of bodi Iy injury. This has includecl, but is not Ii.ited to, the
following "peciflc in,'ltllnces of abuse:
a) On or about June 6, 19<)6, the defendant CIIIIe to the
plaintiff's home. followed her ab<lut the hou"e and yelled at her,
refu",ed to leave when she told him to, and threatened to ki II her.
b) In or about late Apr i I, I <)96, the defendant entered the
plaint i rr' II homt, whi Ie she s I.,pt. woke her up and delll\nded lIOfIey
from her. The defendant grabbed the plaint iff by her hal rand
choked,her IlR she IllY in bed. The defendant left when the plaintiff
moved toward the telephone to call the pol ice.
c) In or about early Apri I, 1<)96, the defendllnt pulled the
plaintiff's hair Ilnll choked her.
d) On or about January I, 1<)96, the defendant pulled the
pllllntiff by her ha i r 111111 threw her to t he floor.
e) In or ahout November, 1<)95, the defendant threatened to break
all the windows out of the plaintiff's Cllr, then proceeded to do so
with a hllseball bat. The plaintiff telephoned the Carlisle Police
Depar tment .
5. The plaintiff bel ieves and therefore avers that she is in immediate
and present danger of abuse from the defendant lind that she is In need of
protection from such abuse.
