AND NOW, this ,)t day of November, 1994, come the Plaintiff,
Christopher R. Bergmann, d/b/a, Bergmann Renovations and
Constructions, through his attorney, John C. Zepp, III, Esquire, and
files his complaint against Defendant, E. Vinton Longenecker, d/b/a
J & B Construction company.
1. Plaintiff, Christopher R. Bergmann, an adult individual,
d/b/a, Bergmann Renovations and Constructions, who has a business
and residence address of 59 Ridge Road, York Springs, Pennsylvania
17372 .
2. Defendant, E. Vinton Longenecker, an adult individual,
d/b/a J & B Construction Company, whose business address is 50 S.
Market Street, Elizabethtown, PA 17022.
3. Defendant, E. Vinton Longenecker of J & B Construction
Company served as the general contractor for the construction of a
new home on certain real property located at Lot 12 of Liberty Woods
located in the borough of Mt. Holly Springs, Pennsylvania, as
evidenced by a Stipulation Against Liens filed on or about August 4,

1993 (a copy of said stipulation is attached hereto and incorporated
herein as Exhibit A), said property owned by Robert M. Bowmen,.
4. On or about August 4, 1994, Defendant contracted with
Plaintiff, as a subcontractor, to perform construction work at the
above described property. Said contractual relationship evidenced
by a copy of a letter from Bergmann's Renovation and Construction
liability insurace carrier and request from J & B Construction to
produce a current policy, (a copies of both letters are attached
hereto and incorporated herein as Exhibits B and C).
5. Plaintiff contracted with the Defendant to perform
various constructions projects about the home. Some work was done
hourly, but most was on a per job basis for a preapproved amount.
The work to be performed and the amounts to be paid are as contained
on Plaintiff's job statement (a copy of said bill is attached hereto
and incorporated herein as Exhibit D).
6. After completion of the individual jobs payment was
received by Plaintiff, as evidenced by credit amounts on
Exhibit D.
7. Work ceased at the home site upon the death of the
homeowner, Robert Bowen in December, 1993.
8. Defendant has failed to pay the Plaintiff the balance of
$1399.91, which is currently owed tor the work done to date.
9. Approximately $895.00 worth of work remains undone
on the agreement between Plaintiff and Defendant.

BRIEF IN SUPPORT OF PREUMINARY OBJECTIONS
I. FACTS
By the filing of preliminary objections, the Defendant as the filer of those objections admits
such facts contained in the Plaintiff's Complaint or of public record for the purpose ofrewlving the
objections.
In a few sentences, that Complaint through its exhibits alleges that Roben Bowen Jr., who
died on Christmas Eve 1993, and the Defendant employed the Plaintiff as a subcontractor in late 1993
and early 1994 constructing Bowen's house in Mt Holly Springs. Some of this work was completed
and SOIlltl was not; some work was paid for and the ponion that was not forms the damages sought
to be recovered, $1399.91.
2. ISSUES
A. WHETHER THE PLAINTIFF SHOULD BE REQUIRED TO AMEND HIS
COMPLAINT AND PLEAD IN THE ESTATE OF ROBERT BOWEN AND ROBERT BOWEN
SR., ADMINISTRATOR
B. WHETHER THE Pl.AINTIFF SHOULD BE REQUIRED TO AMEND HIS

The Court should require the PlaintilTto join the Estate of Robert Bowen Jr, who acquired
any liability which Robert Bowen had by operation of law. 42 PCSA ~8302. Under Pennsylvania
Law, the Plaintiff must join all indispensable parties as parties of record. 3 Standard Pennsylvania
Practice 2nd ~ 14.175. (The Estate of Robert Bowen Jr. is administered by the decedent's father,
Robert Bowen Sr, through the Orphan's Court ofCumbcrland County No.lJ~.
The Estate is a necessary party to this action because as the PlaintilT notes in his response to
the Preliminary Objections at paragraph 3, "some payments [for the work] came directly from Robert
Bowen, Jr. Paragraph 5 admits that the PlainlilT is unaware "whether the estate owes anything." It
should be noted that on the bills allached as Exhibits to the Complaint specify "Bob Bowen-J &; B
Construction". Without ruling on the merits, the Bob Bowen on the January 25, 1994 bill could mean
Robert Bowen Jr. or Robert Bowen Sr, acting on behalf of the Estate of Robert Bowen. Without
the Estate of Robert Bowen, the correct determination of responsibility, ifany, for payment of the
PlaintilT cannot be resolved.
B. THE PLAINTIFF SHOULD BE REQUIRED TO AMEND HIS COMPLAINT AND
REPLEAD IN J &; B PARTNERS CORPORATION AND DISMISS J &; B CONSTRUCTION
COMPANY.
In order for a partnership to be sued, it must legally exist at the time of suit At this present
time, J &; B Construction and Development, does not exist and has not existed since September 20,
1993. (For the record, the Defendant notes the name upon the pleading "J &; B Construction
Company" is incorrect, as the official notice from the Corporation Bureau allests in the Preliminary

I. This matter involves the construction of a house by and for Roben Bowen Jr. in 1993 in
which both the PlaintilT and Defendant were involved.
2. At issue is the responsibility for payment of money to the PlaintilT for services performed.
3. At all times relevant hereto, the PlaintilT dealt with Roben Bowen Jr. including payments
received and he, Roben Bowen, has a substantial, possibly sole liability to the Plaintiff. See Exhibit
A.
4. Raben Bowen died on December 24, 1993 and as such, his estate should be joined as an
indispensible pany.
S. The PlaintilTis aware oflhese facts and did not join the Estate of Robert Bowen Jr. to this
action.
6. Prior to the commencement of work which concerns us in this case, J &: B Construction
Company, a PeMsylvania pannership, was dissolved on September 20, 1993. See Exhibit B.
7. The obligations of the pannership were assumed by J &: B Pannerslnc., a Pennsylvania
Corporation, which makes them, not J &: B Construction, the proper pany to this action.
WHEREFORE, Defendants, J & B Construction Company, Ind E. Vinton Longenecker,
move to have the Court enter an order directing the Plaintiff amend his complaint to direct that the
two additional defendants be joined.

PLAINTIFF'S RESPONSE TO DEFENDANT'S PRELIMINARY OBJECTIONS
AND NOW, comes the Plaintiff, Christopher K. Bergmann, d/b/a
Bergmann Renovations and Construction, by his attorney John C.
Zepp, III and files the following Response to Plaintiff's
Preliminary Objections and in support thereof avers as follows:
1. Admitted.
2. Admitted.
3. Denied as stated. All negotiations as to the work to be
performed at the job cite and the contract price were between
Christopher K. Bergmann and the Defendant, E. Vinton Longenepker,
d/b/a, J & B. Construction, even though some payments came
directly from Robert Bowen, Jr..
4. Admitted in part.. Robert Bowen died December 24, 1993.
Plaintiff is without knowledge whether Vinton Longenecker,
d/b/a J & B Construction Company, as the general contractor was paid
by the estate for work preformed by the PlaIntiff.
5. Admitted. Plaintiff was aware that Robert Bowen Jr.
died, but is unaware whether the estate owes anything.

6. Denied. Plaintiff was hired by E. Vinton Longenecker,
d/b/a as J , B Construction company and the partnership was dissolved
prior to the commencement of work by Plaintiff on August 30, 1993,
as evidenced by the September 20, 1993 certificate of cancellation,
Defendant's Exhibit "B".
7. Denied as stated. Plaintiff, Christopher Bergmann
contracted with E. Vinton Longenecker, d/b/a J & B Construction
Company. If in fact J & B Partners, Inc. assumed the obligations of
the partnership, the Defendant could join the corporation
as an additional defendant.
WHEREFORE, Plaintiff, Christopher Bergmann, respectfully
believes the correct party has been named in the above action.
If the Defendant wishes that additional defendants be joined
he should do so pursuant to Rule 2252 of the Rules of Civil Procedure.
Plaintiff would not object to the Defendant so joining the additional
two defendants. Plaintiff respectfully request that the court deny
the relief requested in Defendant's preliminary Objections.
