You have been sued in Court. If you wish to defend against the claims set forth

COMPLAINT
1. The First National Bank of Chicago, as Trustee for U.S. Home Equity Loan Asset
Backed Certificate Series 1990-2, as assignee to the rights of Chrysler First Consumer
Discount Company, is a lending institution with offices located in Chicago, Il 60670 and
is hereinafter referl.'ed to as "Plaintiff".
2. Defendants, GARRY L. DELANCY and DELORES C. DELANCY, his wife individuals who
reside at 580 Walnut Bottom Road Shippensburg, PA 17257.
3. On or about the 28th day of November, 1989 Defendants obtained a loan f,;om
Plaintiff's Assignor and agreed to repay to Plaintiff's Assignor the sum of $58,888.80
plus interest in monthly installments of $791.00 beginning January 4, 1990. This loan
is secured by a mortgage on Defendants' real property located at 580 Walnut Bottom Road,
Shippensburg. Pennsyl'lania , duly recorded in the Office of the CUMBERLAND County
Recorder of Deeds in Mortgage Book Volume 9~05, Page 433. True and correct copies of
the Note, Mortgage and Truth-in-Lending Disclosure Statement are attached hereto, marked
Exhibits "1",112" and "3", respectively, and made a part hereof.
4. The aformention0d Mortgage and Note were assigned to the Plaintiff herein by
Assignment of Mortgage which was recorded in the OfUce of the Cumberland County
Recorder of Deeds on February 22, 1991 in Book Volume 394, Page 143

corner of land now or formerly of C. Roy Funk; thence by land now or formerly
of Funk South. forty-seven (47) degrees forty-five (45) minutes East one hundred
ninety and one hundredth (190.01) feet to an iron pin; thence by other land of
the Grantor herein South forty-two (42) degrees fifteen (15) minutes West o~e

at corner of land now or formerly of C. Roy Funk; thence by land now or
formerly of Funk South forty-seven (47) degrees forty-five (45) minutes East
one hundred ninety and one hundredth (190.01) feet to an iron pin; thence
by othec land of the Grantor herein South forty-two (42) degrees fifteen
(15) minutes West one hundred fifty (150) feet to an iron pin; thence
continu.ng by same North forty-seven (47) degrees forty-five (45) minutes
Wast two hundred eighty and eighty-seven hundredths (280.87) feet to a

complaint and Notice to Defend, you may have the right to have the judgment
opened if you promptly file a Petition with the Court alleging a val~d defense
and a rsasonable excuse for failing to file the defense on time. If the judgment
is opened, the Sheriff's Sale would ordinarily be delayed pending a trial of the
issue of whether the Plaintiff has a valid claim to foreclose the mortgage or
judgment.
You may also have the right to have the judgment stricken if the Sheriff has
not made a valid return of service of the Complaint and Notice to Defend, or if
the judgment was entered before twenty (20) days after service or in certain
other events. To exercise this right you would have to file a Petition to Strike
the Judgment.
You may also have the right to petition the Court to stay or delay the
execution and the Sheriff Sale if you can show a defect in the Writ of Execution
or service or demonstrate any other legal of equitable right.
