Plaintiff extended credit to the defendant and made payment. and ca.h advance. for the benefit of defendant under the attached term. and condition., marked as Exhibit A (hereinafter referred to as "contract"). 5. By accepting cash advances and using the credit card, pursuant to the contract, defendant agreed to make principal and interest payments to the plaintiff. 6. The agreement further provided that defendant repay plaintiff a certain amount each month, depending on the outstanding balance. 7. Defendant charged goods and services, obtained cash advances, and incurred interest chargee under the contract totalling $3245.71. 8. Defendant is in default of his/her obligation under the agreement, having failed to make the payment due on or about June 22, 1994. 9. On June 22, 1994, plaintiff made demand on defendant to repay the sums then due and owing to plaintiff, but defendant has refused and continues to refuse to repay plaintiff. 111(. lO. Pursuant to the Agreement, plaintiff is entitled to its costs of suit incurred in collecting debt owed it by the defendant.
