ACTION OF MORTGAGE FORECLOSURE
COMPLAINT
AND NOW, comes the Plaintiff, Orrstown Bank, by its
attorney., Fowler, Addams, Shughart' Rundle, and make. the
following Complaint in Mortgage Foreclosure against Robert R.
Durff and Eunice E. Durff, husband and wife, Defendants:
1. Plaintiff is Orretown Bank, a Pennsylvania banking
corporation organized and existing under the laws of the
Commonwealth of Pennsylvania whose principal place of busine.. is
located at 77 East I<ing Street, Shippensburg, PA 17257 and whose
mailing address is P. O. Box 60, Orrstown, PA 17244-0060.
2. Defendants are Robert R. Durff and Eunice E. Ourff,
husband and wife, adult individuals whose last known re.idence is
229 Neil Road, Shippensburg, Cumberland County, PA 17257 and
whose mailing address is P. O. Box 637, Shippensburg, PA 17257.
3. At all relevant times, Defendants have been the real
owners of a tract of land with buildings and improvements thereon
erected and located at 228 Neil Road, Shippensburg (Southampton
Township), Cumberland County, Pennsylvania (the "Premises") which
Premi.e. i. more fully described in Exhibit "A", attach.d her.to
and made a part hereof,
4. On or about November 23, 1988, in consideration of a
loan of Twenty-four Thousand ($24,000.00) DOllars, made by
Plaintiff to Defendants, which funds were received by Defendant.,
Oefendants, as Borrowers, executed and delivered to Plaintiff, ..
Lender, a Note dated November 23, 1998 (the "Note") in the
principal sum of Twenty-four Thousand ($24,000.00) Oollars (the
"Principal"), and requiring a payment of interest on the
principal interest rate of eleven and three-quarters (11.75')
percent, commencing on December 23, 1988 and continuing each
consecutive month thereafter for two hundred forth (240)
coneecutive monthly installments, a true and correct copy of
which Note is attached hereto, made a part hereof and marked
Exhibit "B".
5. The Note obligatea the Defendants to pay to Plaintiff
the sum of Two Hundred Sixty and 09/100 ($269.09) DOllars, the
principal and interest on the 23rd day of each month, together
with a monthly escrow payment for life insurance in the Bum of
Twelve and 24/100 ($12.24) Dollars, a total monthly payment of
Two Hundred Seventy-two and 33/100 ($272.33) DOllars, commsncing
December 23, 1988 and each month thereafter until November 23,
2009.
6. The indebtedness evidenced by the Note is secured by a
Mortgage on the Premises dated November 23, 1988 (the "Mortgage")
executsd, conveyed and delivered by Defendants, as Borrowers, to

Plaintiff, as Lender, a true and correct copy of which Mortgage
is attached hereto, made a part hereof and marked Exhibit "C".
7. The Mortgage was duly recor.ded in the Office of the
Recorder of Deeds in and for Cumberland County, pennsylvania on
November 23, 1989 in Mortgage Book 924, Page 51.
8. The failure of the Defendants to pay the principal,
interest and escrow on or before its monthly due date constitutes
a "default" illS set forth in the Note and incorporated in the
Mortgage by reference.
9. Defendants have been in default under the terms of the

Mortgage by failing or refusing to pay the required amount. of
Principal, Interest and escrow due plaintiff since March 23,
1994.
10. The terms of the Mortgage and the Note provide that
upon the occurrence of a default and upon failure to pay the
amount due within the date specified therein, which shall be not
less than thirty (30) days, the Plaintiff may institute an action
of mortgage foreclosure and may accelerate the immediate payment
of the entire unpaid amount due Plaintiff and secured by the
Mortgage. The required written notices were mailed to Defendants
on June 24, 1994, copies of which are attached hereto,
incorporated herein by reference and marlted Exhibits "0" and "E".
11. The sums presently due and payable to Plaintiff by
Defendants and secured by the Mortgage are itemized as followR:

12. Plaintiff has duly complied with the provisions of the
Emergency Mortgage Assistance Act of 1983 ("Act 91") in that the
prescribed Notice of Eligibility was sent to Defendant, Robert R.
Durff, by Certified Mail and First Class mail, postage prepaid on
June 24, 1994. The Defendant did not file an application tor
mortgage assistance. The sixty (60) days for action by the Agency
nas expired. A true and correct copy of the prescribed Notice is
attached hereto, made a part hereof and marked Exhibit "F".
13. Plaintiff has duly complied with the provisions of the
Emergency Mortgage Assistance Act of 1983 ("Act 91") in that the
prescribed Notice of Eligibility was sent to Defendant, Eunice E.
Durff, by certified Mail and First Class mail, postage prepaid on
June 24, 1994. The Defendant did not tile an application for
mortgage assistance. The sixty (60) days for action by the Agency
has expired. A true and correct copy of the prescr ibed Notice 18
attached hereto, made a part hereof and marked Exhibit "G".
14. Written Notice of Intention to Foreclose was sent to
each Defendant by certified mail on June 24, 1994, pursuant to
Section 403 (a) of the Act of January 30, 1974, P.L. 13, No. 6, a.
amended, 41 P.G. Section 403(a), true and correct copies of which
Notices are attached hereto, made a part hereof and marked
Exhibits "0" and "E".

15. True and correct copies of ths certified mail receipts
for each Dofendant as averred under Paraqraphs 10, 12, 13 and 14
are attached hereto, made a part hereof and marked Exhibit "H".
16. The Defendants have nevertheless failed to cur~ the
default..
17. There have been no assiqnments of either the Mortgaqe
or the Note.
WHEREFORE, plaintiff demands judqment aqainst the Defendants
in the sum of Twenty-six Thousand Four Hundred Fifty-three and
41/100 ($26,453.41) Dollars, toqether with costs and interest on
the unpaid principal balance accruinq at the current rate of
interest eleven and three-quarter (11.75') percent from
November 1, 1994, and demands foreclosure and judicial sale of
the interest of the Defendants in the mortqaged Premise..

interest on the unpaid principal balance from the date of this Note, until

Principal and intareet shall be payable at Orrstown Bank, or such othar place
as the Note holdar may designate, in Two Hundred Forty (240) consecutive
monthly installments oJ, ~ Hundred Sixty and Nine Hundr~ths Dollars

If any monthly installment under this Note is not paid when due and
remains unpaid after a datl't specified by a notice to Borrower, the entire

due and payable at the option of the Note holder. The date sp.r.lfied shall
not be less than thirty days from the date such notice is mailed. The Note
holder may exerciSe this option to accelerate during any default by Borrowe~
regardless of any prior forbearance. If suit is brought to collect this Note,
the Note holder shall be entitied to collect all reasonable costs and expenses
of suit, including, but not limited to, reasonable attorney's fees.
Borrower may prepay the principal amount outstanding in whole or in part.
The Note holder may require that any partial prepayments (i) be made on the
date monthly installments are due and (il) be in the amount of that part of
one or more monthly installments which would be applicable to principal. Any
partial prepayment shall be applied against the principal amount outstanding
and shall not postpone the due date of any subsequent monthly installments or
change the amount of such installments, unless the Note holder shall otherwise
agree in writing.
Presentment, notice of. dishonor, and protest are hereby waiv~>d by all
makers, sureties, guarantors and endorsers hereof. This Note shall be the
joint and several obligation of all makers, sureties, guarantors and
endorsers, and shall be binding upon them and their successors and assigns.
Any notice to Borrower provided for in this Note shall be given by
mailing such notice by certified mail addressed to Borrower at the Property
Address stated below, or to such other address as Borrower may designate by
notice to the Note holder. Any notice to the Note holder shall be given by
mailing such notice by certitied mail, return receipt requested, to the Note
holder at the address stated in the f.irst paragraph of this Note, or at such
other address as may have been designated by notice to Borrower.
The indebtedneas evidenced by this Note is secured by a Mortgage, dated
