PRELIMINARY OBJECTIONS
The Preliminary Objections of Defendant Cumberland Loft Apartrnents are as follows:
MOTION TO STRIKE
I. Plaintiff's Complaint lists .Curnberland Loft Apartrnents. as the defendant.
2. The Complaint alleges, however. that Defendant is "an apartrnent cornplex. and does
not identify Defendant as an individual, corporation. partnership or any other organization or
entity against which an action in personam can be brought.
3. The Cornplaint also contains impertinent mailer in Paragraphs 13 through 16 in that
these paragraphs contain allegations of proceedings before a district justice and have no
rele"ance here,
WHEREFORE. Defendant respectfully requests that this Court sustain Defendant's
Preliminary Objection by way of a Motion to Strike and dismiss Plaintiff's Complaint.
DEMURRER
4. Plaintiff's Complaint. particularly Paragraphs 4 through ! I. alleges that Plaintiff
"drafted and rnailed" invoices to Defendant but fails to contain allegations that Defendant
requested or agreed that Plaintiff should do work for Defendant. that Defendant agreed to pay
for work to be done by Plaintiff nor that work was actually done.
~. Plaintiff's Complaint also is based on a written agreement attached to the cornplaintthat
was not signed by eilher party.

6. Plaintiff falls to slate a cause of action against Defendant and, therefore, the Complaint
should be dismissed.
7. Plaintiff falls to slate whether Plaintiff has done all that Is required of Plaintiff under
any qreement between the panies.
WHEREFORE, Defendant respectfully requests that this Court sustain Defendant's
Preliminary Objection by way of Dernurrer and dismiss Plalntlfrs Complaint.

Building Group is not the name of a limited partnership or any other legal entity.
Cumberland Loft Apartments is only the name of a building and is not the name of an
individual, partnership or any other legal entity nor has it ever been used as such by the
owner of the building, No person or other legal entity "is located at 1200 North Third
Street" other than tenants who have no ownership or other business interest in that building.
