On November 3, 1994, a Judgment was entered by plaintiff, Kenneth McCarthy,
against defendant, Michael Miller, in the amount of $1,988. On April 29, 1998, the
Sheriff uf Cumberland County served the writ of execution and seized an antique
1948 Mercury Coupe at the defendant's residence that was titled in the name of
defendant, Pursuant to Pa. Rule of Civil Proceduro 3202, defendant's father, Michael
W, Miller, who lives in the state of Delaware, filed a property claim to the Mercury
Coupe in which he maintains that he, not his son, Is the owner. The Sheriff made a
determination that Michael W. Miller is not the prima facie owner of the vehicle. Miller
sought a hearing In this court which was conducted on July 2, 1998.
Defendant, Michael Miller, age 33, obtained title to the Mercury Coupe on July
2,1987, It was a gift from his parents, The claimant, Michael W. Miller, tesllfied that
in April, 1997, his son was having financial problems, At that time, the Mercury
Coupe was about thr..fourths restored, He believed the vehicle, if completely

reltored, was worth approximately $12,000.' Miller further t_tltled that he bought the
Mercury Coupe from his son for $6,800 cash. He and his son signed a document on
April 7, 1997, titled a 'Bill of Sale,' The document sets forth:
I Michael S. Miller sold my 1948 Mercury Coupe t1fSKn68PA(IO#)
to my dad Michael W, Miller for cash money of $6,800.
Michael W. Miller testified that he had an oral agreement wtth his son that he
would not 8ell the vehicle, and would return the title to son when he was repaid the
$6,800. There was no time limit or terms of repayment. Michael Miller signed the title
to the Mercury under the designation "seller.' The purchaser was listed on the title u
Michael W. Miller. However, Michael Miller's name was not notarized as required on
the title. On the top of the title the date of April 7, 1997, was handwritten. Michael W.
Miller never processed the title with the Commonwealth to transfer ownership of the
vehicle to himself, The vehicle was not registered on April 7, 1997, and It has
remalned unregistered. Michael W, Miller never took the vehicle Into his possesalon
and It has remained at all times In the possession of Michael Miller at his residence in
Cumberland County. Michael Miller retained the keys to the vehicle and never gave
any keys to his lather.
Michael Miller teatlfied that he had financial difficulties In April, 1997, when he
received $6,800 In cash from his father, He testified that he and his father decided to

keep the antlqu. Mercury within the family when the transaction occurred on April 7,
1897, There was no agreement as to how he would repay the $8,800 to hi. father.
None of the money haa been repaid to date, Miller acknowledged that h. h8d filed
for bankruptcy on October 19, 1993, Although h. owned the Mercury when he filed
for bankruptcy, h. did not declare the vehlcl. .. an 8IIet .. required on the form of
his bankruptcy filing. The bankruptcy case was dlsmllled on February 16, 1994.
Th. Vehicle Code at 75 Pa.C.S. Section 1111, titled 'Tranafer of ownerahlp of
vehicle,' provides:
(a) Duty of tfln,"ror.-In the event of the sale or transfer of the
owneflhlp of a vehlcl. within this Commonwealth, the owner shall
execute an assignment and warranty of title to the tranaferee In the
space provided on the c.rtiflcate or as the department prescribes, lwom
to before a notary public or other officer empow.red to administer oath.,
and deliver the certificate to the tran.feree at the time of the delivery of
the vehicle,

(b) Duty of tr.n.f......-Except as otherwts. provided in section
1113 (relating to trans'er to or from manufacturer or deeler), the
tranlferee shall, within t.n daYI of the asslgnm.nt or r....lgnm.nt of
the certificate of title, apply for a new title by presenting to the
department the property completed certificate of titl., lwom to before a
notary public or other ofllcer empowered to administer oaths, and
accompanied by such forms as the department may requir..
The following requirements of Section 1111 were not met by the Mill.,. with
respect to the purported sale of the Mercury on April 7, 1997:

(2) The vehicle was not delivered to Michael W. Miller.
(3) Michael W. Miller did not within ten days of the ualgnment of the
certificate of title apply for a new title by presenting the Department of Transportation

In Wa.llko v. Home Mutua' Ca.ualty Company, 210 Pa. Super. 322 (1967),
the Superior Court of Pennsylvania stated that '[IJn Pennsylvania, a certificate of tiUe
Is merely evidence of ownership of a motor vehicle and Is not conclusive.' The
'elementa of ownership' are "the uae, benefit, possession, control, reaponsiblllty for,
and disposition of the automobile. . .." Id. In the case IlQ judice, not only Is
Michael Miller the title owner of the Mercury Coupe, he has the elements of ownership
of the use, benefit, possession, control and responsibility for the automobile. What
occurred here Is simply that for a loan of $6,800 by the father to his son, the son
allowed his father to hold the title to the Mercury In an attempt to avoid attachment by
creditors.a That Intent can be further gleaned from Michael Miller's conduct In 1993
when he did not declare the Mercury titled In his name as an asset as required on the
form of his bankruptcy filing.
For the foregoing reasons, we find that the claimant, Michael W. Miller, la not
