Under the terms of the lease between the Plaintiff and the Defendant. those obligllions are
assigned solely to the Defendant.

1. The Court lacks jurisdiclion over the Plainliffs Complainl, due to Plainliffs failure
to join lI/I indispensable party,
2. The Plalnliffs claim is barred by the provisions of the Comparllive Nealiaenc:e Act
of die Commonwealth of PeMsylvanla, insofar as the Plainliffs nealiaence, exc:eeded fifty one
percent (51 "), thereby barrina her recovery. or was of such a maner to reduce the nealiaence of
the Defendants in the aforesaid matter.
3. The Plaintiffs claim Is barred by the applicable Statute of Limitations,
4. The premises in question was leased by the Defendanl Amoco OU Company from
The Estate of Mable Rleale, pursuant to an Aareemenl, dated May 7, 1967. A copy ofthll
Aareement is attached hereto, made a part hereof, and labelled Exhibil "A." Pursuanlto the terms
ofthll Aareemenl, The Estate of Mable Rieale, is relieved of any responsibility for the maintenance
of die subject premises, excepl so far as enumerated in the aforesaid document.
4. By lease aareemenl. dated May 29, 1992. Amoco Oil Company, a Maryland
Corporlllon, leased the premises al 32nd and Markel Streelto an individual named John Gordy. A
copy of the lease is attached hereto. made a part hercof. and labellcd Exhibit "B." Pursuanlto the
terms and condilions of thaI lease. the Icssec, John Gordy. is solely liable for the maintenance and
repair of said premises as sel forth therein; Pursuant 10 the terms of that lease the items of
maintenance which are enumerated by the Plaintiff in his Complaint as beina nealiaenlly performed,
or omilled are responsibilities assianed exclusively to the operator and lessee. John Gordy,

be fully resolved withoul his participation Md presence in the case. John Gordy is an indispensable

6. Without the joinder of an Indispensable pany the Court lacks jurisdiction to hear the

AND NOW, comes the Plaintiff, Patrice Crowley, by and through her attorneys, Tucker
Annsberl. P.C. and John 0, Dileonardo, Esq., with this Complaint against the above
captioned Defendants averrilli in support thereof as follows:
I. The Plaintiff, Patrice Crowley, is an adult individual residil18 at 3012 Yale
Avenue, Camp Hill, Cumberland County, PeMSylvania.
2. The Defendant, Amoco Oil Company, is a corporation believed to be incorporated
under the laws of a forciln jurisdiction and which is authorized to and docs business in the
Commonwealth of PcMSylvania with a place of business located at 513.5 Simpson Ferry Road,
M~hanlcsburl, Cumberland County, PeMSylvania.
3. The Defendant, Mable Reigle is an adult individual and owner of property located
on the northwest corner (facinl north) of U.S. Routes 11-1.5 and Market Street in Camp Hill
PeMlylvanla with a business address of c/o Trust Real Estate Division, Mellon Bank, 10 South

Market Street, Harrisburg, Dauphin County, Pennsylvania.
4. The Defendant, Robert Newcomer, is an adult individual with a business address
of Front Street and Linalestown Road, Harrisburg, Dauphin County, Pennsylvania.
S. On or about November 3, 1992, the Plaintiff was a business invitee at the Amoco
service/fuel station located on the northwest comer (facina north) of the intersection of U.S.
Routes 11-1S and Market Street in Camp Hill, Cumberland County, Pennsylvania,
6. At the aforesaid time and place, Plaintiff was fuelina her vehicle at the self-service
fuel pumps. Upon completion of the fueling operation, Plaintiff was procccdina to the service
station office/cashier when she slipped and fell on an accumulation of slippery fluids located on
the pavement area adjacent to the fueling pumps and in the area wherein business invitees would
ordinarily traverse in order to pay for their fuel purchase.
7. As a direct and proximate result of the fall described in '6 above, Plaintiff
suffered various iqjuries, including, but not limited to, a micro-fracture of the lower right leg,
sprain of the right knee, torn lateral ligaments in the right leg, bone chipping in the right knee,
accumulation of blood on the right knee, and othcr injuries to the nerves and soft tissue
structures of the right leg.

9. The Defendant, Amoco, was, at all times material and relevant to the alle,atlons
of this Complaint, the lessee of the premises upon which Plaintiffs Injuries were incurred and

10. The Injuries suffered by the Plaintiff were the direct and proximate result of the

a) It allowed a dangerous condition, the accumulation of slippery fluids or
substances, to lay or remain located in an area where the Defendant knew business
Invltees such as the plaintiff would walk;
b) It failed to remove or otherwise abate the dangerous condition;
c) It failed to warn the Plaintiff of the existence of the dangerous condition;
d) It failed to take precautionary measures to protect business
Invltees/customers such as the Plaintiff from slipping and falling on the dangerous
condition created by the accumulation of slippery subslanceslfluids in an area where it
knew or should have known such invitees/customers would walk;
e) It allowed a dangerous condition to exist on the premises possessed.

or throuah the action of her agents, servants, employees or lessee(s).
15. The injuries suffered by the Plaintiff were the direct and proximate result of the
negligence, recklessness and carelessness of the Defendant, Reigle, as follows:
a) She allowed a dangerous condition, the accumulation of slippery fluids or
substances, to lay or remain ll)Cated in an area where the Defendant knew business
invitees such as the plaintiff would walk;
b) She failed to remove or otherwise abate the danaerous condition;
c) She failed to warn the Plaintiff of the existence of the danaerous condition;
d) She failed to take precautionary measures to protect business
inviteeslcustomers such as the Plaintiff from slippina and fallina on the danaerous
condition created by the accumulation of slippery substances/fluids In an area where she
