Dear Sir or Madam:
I am writing on behalf of Sergeant Kathleen T. Ollander, who
is the defendant in an action now pending in your court.
Sergeant Ollander recently consulted me about the action in my
capacity as a Legal Assistance Attorney.
Accordingly, I am furnishing her only preliminary legal
counseling and I am not representing her in this civil matter.
It is the function of this office to assist and advise service
members concerning the taking of necessary steps to protect
their interests initially, and to refer them to civilian
counsel, if and when necessary.
Sergeant Ollander is preseptly on active duty in the Armed
Forces of the United States and is assigned to Headquarters
Company, Third Infantry Division, Unit 26222, APO AE 09036. As
such, Sergeant Ollander is afforded certain rights under the
Soldiers' and Sailors' Civil Relief Act of 1940, as amended, 50
U.S.C. Appendix, Sections 501-548, 560-591 (1988). Section
520(1) of that Act requires the plaintiff to file an affidavit
stating that the defendant is not in the military service before
any default judgment may be taken. In this case defendant is in
the military service.
Section 520(1) further provides that, in the absence of such
an affidavit, the court shall, upon application, appoint an
attorney to represent the defendant prior to any default
judgment. Such court appointed attorney has the power to move
for a stay without making an appearance. Sergeant Ollander
desires that the court appoint such an attorney prior to entry
of any default judgment against her.

Section 521 of the Act requires the court to grant a stay of
the proceedings when the defendant's military service materially
affects her ability to conduct a defense. In this case,
Sergeant Ollander informs me that she will be unable to attend
any proceedings of the court in this matter as a direct result
of her military service. It would be difficult for he~ to
obtain leave, hirp. an attorney, and prepare an answer to the
complaint by December 14, 1994.
Sergeant Ollander will be unable to appear and protect her
interests in this case until July 15, 1995. Therefore, a stay
of all proceedings is requested until such time as Sergeant
Ollander's ability to present a defense is no longer materially
affected by her military service.
This request is not intended to work oppressively against
the prosecution of the plaintiff's case; rather, it stems from
my client's belief that there are contested issues to be
litigated and that her presence will be required to adequately
present her interests. Attached hereto is a Request for a Stay
under the Soldiers' and Sailors' Civil Relief Act. It is not to
be construed as a submission to jurisdiction which may otherwise
be lacking. It does not constitute an answer to the
plaintiff's complaint nor an appearance by myself on behalf of
Sergeant Ollander.

This letter is not to be construed as either a submission to
jurisdiction without lawful public service or an appearance by
or on behalf of Sergeant Ollander. Neither is it to serve as
any form of answer to any petition filed by the plaintiff. I
reiterate that my involvement in this case extends only to the

AT WUBRZBURG, GERMANY
1. I, KATHLEEN T. OLLANDER, being first duly sworn on oath,
depose and say:
a. That I am presently on active duty in the Armed Forces
of the united States, holding the rank of Sergeant, and assigned
to Headquarters Company, Third Infantry Division, Unit 26222,
APO AE 09036.
b. That I am the defendant in case number 1053-1994, in the
Domestic Relations Section of the Court of Common pleas of
Cumberland County, pennsylvania.
c. That I have made no appearance in the above-titled case,
now scheduled for hearing on the 14th day of December, 1994, and
do not, by the making of this affidavit, appear or submit to the
jurisdiction of the court.
d. That I am not presently represented by counsel.
e. That my ability to appear and protect my interests in
this action is materially affected by reason of my military
service. It would be difficult for me to obtain leave, hire an
attorney, and prepare an answer to the complaint. I will be
transferred from Germany to the United States in July of 1995.
I request a stay until July 15, 1995.
2. I therefore request, under the provisions of the Soldiers'
and sailors' Civil Relief Act of 1940, as amended, 50 U.S.C.

PRE-TRIAL MEMORANDUM
I. Background of CaBe
The background of the case presented by Defendant is,
generally correct with the following exceptions I
1. Although the parties agreed in July 1993, when Mother
left for her assignment in Germany that Father and the children
were to join her, Mother did not contact Father or the children
for approximately three months.
Mother then called in October
1993 to state that she had obtained housing; however, she
indicated that she would prefer that Father and the children not
join her so that her tour of duty in Germany could be shortened
due to her being unaccompanied by her dependants. This was a
"career choice" by the Mother, which Father concurred with. He
further did not wish to join Mother, due to the fact she had been
unfaithful. to him, and he desired a divorce.
Although the choice not to live together
I
in Germany was
agreed to by both Father and Mother, it was Mother's wishes that
governed that decision.
2. Father has completed a course of training as an
electronics technician and intends to practice his new skill in
the Phoenix, Arizona area. He had notified Mother by letter of
his intent to take tha children to Arizona while ho sought work
in that area and gave her an address and phone number to contact
him. Evidently, Mother did not, for lome unknown reason, receive
the letter which was mailed to her APO address.
3. Mother will be stationed in the D.C. area; however, her
enlistment expires in one year.
There is no indication as to
where she will be stationed in the future, assuming she
reenlists.
II. Witnesses
1. Becxy Detwiler - Carlisle Barrack Daycare Center - she
will testify to care provided to the children by Father during
the period the children were living with him at Carlisle
Barracks.

parenting of the children during the period he had primary
custody.

testimony concerning an alleqed videotape of Father enqaged in

AND NOW, comes Kathleen T. Ollander, Defendant above, by and through her counsel,
Flower, Morgenthal, Flower & Undsay and petitions This Honorable court as follows:
1. The parties hereto are husband and wife and the parents of two children, Mltgeret
C. Ollander, born December 22, 1990, and Monica L. Ollander, born September 24, 1992.
2. Mother Is a member of the United States Army who recently returned from her
posting In Germany.
3. By Order of Court of Mitch 9,1995, a copy of which Is attached hereto II Exhibit
"A", pending the heerlng, Father had primary physical custody of the children which was to revert
to Mother upon her return from Germany for a permanent change of station and prior to the court
hearing set for August 14, 1995 at 9:30 a.m.
4. Mother's return to the United States took plaef) on July 28, 1995. Father had notice
01 the date of her return not only through Mother's oral communication but also through a court
order of March 24, 1995 which referenced the return date. A copy of said court order II attached
hereto a. Exhibit "S."

5. On or about July 21, 1995, the attorney for Father, Arthur T. McDermott, Esquire,
advised counsel that Father had left the sate for Arizona searching for work and that he would not
be providing the children to Mother prior to the hearing date. A copy of the July 21, 1995 letter
Is attached hereto as exhibit 'C.'
6. Prior to her return to the United States, Mother contacted her counsel advising that
she hed been unablfl to reach the children by telephone nor to locate them at their Oaycere Center
at Carlisle Barracks. In fact, Mother had been told that the children had ceased coming to
Oaycare on July 10, 1995 and that the Daycare Center had been provided with no notice that the
children were no longer attending or that they were on vecatlon. In fact, Father left the Oaycere
Cerrter with a month's fees unpaid.
7. Upon her return to Cumberland County on July 28, 1995, Mother went to the former
marital home and found the apartment in disarray. Remaining were the items Mother had ptlor
to her marriage. Removed from the marital home was all marital property Including a vacuum
cleaner, video player, television, computer, video camera. bicycles, beds, and bookshelves.
Missing too were also the financial files and the vital records Including the children's birth
certificates.
e. Because of the nature of the items removed from the marital home, the lack of notice
to the Oaycare Center, and the failure of Father to leave an address or telephone number where
he can be reached, Mother cannot credit his representation that he has simply gone job .earchlng.

AND NOW, August 14, 1995, the parties having appeared for hearing with
their respective counsel, testimony having been taken, primary physical custody of
the parties' two children, Margaret C. Ollander, bom December 22, 1990, and
Monica L. Ollander, bom September 24, 1992, shall be In the mother, Kathleen T.
Ollander, with partial custody In the father, John E. Ollander, according to the
following schedule:
1. On altematlng Christmas vacations from school commencing In
December 1996. The children shall be retumed to their mother on the day before
school resumes.
2. Alternating Easter vacation, commmenclng with father In 1996.
3. Six weeks In the summer, except that If father 13 unable to exercise
custody of the children during the Easter vacation, he may have partial custody of
the children for seven weeks In the summer.
4. At such other times as the parties ehall agree.

The parties shall share legal custody of their children.
The colSts of transportation for periods of partial custody shill be equally
shared by the parties.
The parties shall have free and unfettered telephone contact with their
children during reasonable hours.
Father shall pay to mother by January 1, 1996, $550 as his share of the
