STIPULATION AGAINST MECHANICS' LIENS

WHEREAS, George W. Gish, Jr. and Georgia R. Gish, of 171 Payne
Drive, Cheshire, Connecticut entered into a contract with Pfeiffer
Homas, Inc., Contractor, of 5718 Harford Road, Baltimore, Maryland,
to provide materials and perform labor necessary for the
construction of a residence, upon the following tract of land
looated in south Middleton Township, Cumberland county,
Pennsylvania, more specifically dftscribed as follows, to wit:
ALL THAT CERTAIN piece or parcel of land situate in South
Middleton Township, Cumberland county, pennsyl vania, more
particularly bounded and described in accordance with the rinal
Subdivision Plan for Forge Hills prepared by C.W. Junkins
Associates, Inc., Professional Land Surveyor, dated January 22,
1987, and revised April 6, 1987, a copy of which is recorded in the
Recorder's Office for Cumberland County in Plan Book 53, Page 13,
as follows, to wit:
BEGINNING at a point, said point being on the western right of
way line of Orion Road, a fifty-foot wide road, said point also
being the southeast corner of Lot No.9, as shown on the Final
Subdivision Plan of rorge Hills; thence along the dividing line of
said Lot No. 9 and Lot No. 10 on the same Subdivision Plan North 56
degrees 43 minutes 11 seconds West, a distance of 176.88 feet to a
point at lands now or formerly owned by Boiling Springs Plaza,
Inc.; thence along said lands North 9 degrees 24 minutes 16 seconds
West, a distance of 200.00 feet to a point on the dividing line of
Lot No. 9 and Lot No. 8 on the same Subdivision Plan; thence along
the dividing line of said Let No. 8 and Lot No. 9 South 86 degrees
39 minutes 16 seconds East, a distance of 143.45 feet to a point on
the northeastern most cornsr of Lot No.9, also on the western
right of way line or Orion Road, a fifty-foot wide road; thence
along said riqht of way line on a curve to the left, said curve
having a radius of 225 feet, an arc length of 100 feet, said arc
being subtended by a chord bearing of South 22 degrees 7 minutes 9
seconds East, a distance of 99.18 feet to the point and place of
BEGINNING.
CONTAINING twenty-two thousand two hundred thirty square feet
(22,230), more or less, and being Lot No.9 as shown on a rinal
Subdivision Plan for rorge Hills, recorded as aforesaid.
UNDER AND SUBJECT to all easements, restrictions and
declarations of record.
NOW, THEREFORE, it is hereby stipulated and agreed by and
~etween the said parties as part of the said contract and for the
consideration therein set forth, that neither the undersigned
contractor, any sub-contractor or mater ia 1 man, nor any other
person furnishing labor or materials to the said contractor under
this contract shall file a lien, commonly called a mechanics' lien
for work done or material. furni.hed to the said building or any
part. t.hereof.
This stipulation i. made and intended to be filed with t.he
county prot.honotary within ten days after date, in accordance with
t.he requirements of Act of A..embly of pennsylvania, in suoh case
provided.
IN WITNESS WHEREOF, the spid parties here~o have hereunto set
