Plaintiff., Heather and Paul Shamitko, by and throuqh their
attorney, Archie V. Diveqlia, of DIVEGLIA , KAYLOR, P.C., and
aver in .upport of their Complaint the following:
1. Plaintiffs, Heather Shamitko and Paul Shamitko, are
adult individuals who reside at 258 Collier Drive, Mechanic.burg,
CUmberland County, Pennsylvania 17055.
2. Defendant, James C. McCanna, is an adult individual who
re.ide. at 535 South Middlesex Road, Carlisle, Cumberland County,
penn.ylvania 17013.
3. That on July 11, 1994, at approximately 9:00 P.M.,
Plaintiff Heather Shamitko was operating her vehicle in an
ea.tward di~.ction on Park Drive.
4. That at the above said time and place, Defendant pulled
from Petersburg Road onto Park Drive and proceeded to follow the
plaintiff's vehicle at an unreasonably close and dangerous
manner.
5. plaintiff Heather Shamitko proceeded through some curve
and as she viewed the roadway ahead, she noticed further curve.
and slowed her motor vehicle in anticipation for those curves,
when she suddenly saw headlights through her rear approaching
quickly,
6. Plaintiff Heather Shamitko thereafter tapped her brakes
so as to advise the following vehicle that she was slowing down
when said vehicle collided into the rear of the vehicle she was
driving with said vehicle being driven by the Defendant.
7. As a result of the aforesaid collision, Plaintiffs'
vehicle was declared a total loss and Plaintiffs incurred a loss
of value to the sum of $5,020,82 (eee Exhibit A attached hereto).
8. That the Plaintiffs incurred $45.00 in towing said
vehicle from the scene (see Exhibit B).
VDUICAlfIO.
This Complaint is based upon information which has been
qathered by our counsel in the preparation of the lawsuit. The
lanquaqe of this Complaint is that of counsel and not our own.
We have read this Complaint and to the extent that the complaint
i. ba.ed upon information which we have qiven to our counsel, it
i. true and correct to the best of our knowledqe, information and
belief. To the extent that the content of the Complaint i. that
of counsel, we have relied upon counsel in makinq this
verification.
This statement and verification are made subject to the
penalties of Pa. C.S. SS 4904 relatinq to unsworn falsification
to authorities, which provides that it we knowinqly make false
averments we may be subject to criminal penalties.
