Plaintiff herein is A-1 LINCOLN RENT-ALL, INC., a
corporation duly organized and existing under the laws of the
Commonwealth of Pennsylvania, having an office and place of
business at 5231 Simpson Ferry Road, Mechanicsburg (Hampden
Township), Cumberland County, Pennsylvania.

Defendant herein is RICKY LEE WEAVER, an adult individual
who lives and resides at 67 Linda Drive, Mechanicsburg (Silver
Spring Township), Cumberland County, Pennsylvania.

At all times relevant and material to this cause of
action, Plaintiff has been engaged in the retail sale and
rental of various goods, tools and equipment at the place of
business described in Paragraph 1, above.

On or about July 30, 1994, Defendant agreed to rent from
Plaintiff a 1991 Ford piCk-Up truck in accordance with the
term. and conditions as set forth in the Opening Contract of
that date, a true copy of which is attachsd hereto and made a
part hereof, marked Exhibit "A".

Defendant picked up the truok at plaintiff's plaoe of
bu. in... on saturday morning, July 30, 1994, and promi.ed to
return the vehicle to plaintiff on Monday morning, August 1,
1994.

The vehicle was not returned to plaintiff until August 30,
1994, and it was returned in a badly damaged condition, to witl
the windshield was cracked, the side window was broken and
there were body dents and scrapes along the front, rear and
both sides of the body of the truck.
7.
As the result of the damages described in Paragraph 6,
above, plaintiff has incurred the following expenses to repair
the damage I
A. Major'S Body Shop, Inc.,
body work and repainting (see Exhibit "B") I
B. Diamond Auto Glass, replace windshield
and side window (uee Exhibit "C"):
$2,626.55

For his use and possession of the vehicle from July 30,
1994, until August 30, 1994, Defendant has incurred rental,
towing and cleaning charges in the total amount of $2,504.34 aa
more fully set fQrth in the Closing Contract dated s.ptember
